The Independent Communications Authority of South Africa ICASA, will have to exercise its discretion when reviewing a decision to grant licences to Top TV, to broadcast three pornography channels. The Western Cape High Court has dismissed 'On Digital Media's application, for leave to appeal a ruling, that the communications authority must revisit its decision. The Prosecutor of the International Criminal Court has asked the court to grant her leave to appeal a decision by the Chamber not to refer Kenya to the Assembly of States Parties over non-compliance with the court. The appeal comes just days after Fatou Bensouda announced that she was withdrawing charges against Kenya's President Uhuru Kenyatta, arguing the Kenyan Government's non compliance with her office's investigation compromised their ability to investigate those responsible for post election violence in 2007/8. A Coalition of NGOs has slammed the Kenyan government's alleged intransigence and rejected it as a victory for Africa's position against the Court. Sherwin Bryce-Pease reports.

Alleged murder mastermind Shrien Dewani will today know his fate. The British businessman is on trial for allegedly orchestrating the murder of his wife Anni four years ago in Cape Town.
