A contract is a legally enforceable exchange of promises.  When a Buyer makes an offer on a property, once signed by the Seller a Contract is formed.  That Contract is legally enforceable.  Unless a provision allows for cancellation (like the inspection period) the Contract is binding.  Can a Seller just cancel the contract?  And what do you do if he tries?

On today’s Real Estate Finder Podcast, Matthew and Staci are joined once again by Jill Glanzer.  We discuss a variety of real estate topics that came up this week, including bizarre country club rules, requests for furniture and required addendums.

It might not be happening as much as last year, but multiple offer situations still exist.  When making an offer and time is a major factor, getting the offer to the listing agent quickly might take precedence over a few other things like an inventory list of included furniture. 

Little known fact outside a country club: Not all golf carts are the same. Every country club has different rules regarding golf carts. Do your homework when showing or selling country club properties because these thing tend to come back later with fines and miscommunication costs money.

We are constantly asked about the state of the real estate market by both Buyers and Sellers.  Supply and demand as always sets the market.  The year ends with more supply and inventory is available. Yet, sellers aren’t lowering their prices as quickly as they did in cooler markets. Last year, buyers were all competing for limited properties to buy. This year, buyers have more options and can slow their roll, see a property more than once and ask questions.

A multiple offer situation can be stressful. During Covid, almost every sale was a multiple offer situation and although the speed was stressful, it went quickly.

Today, multiple offer situations still happen but the urgency or race against the clock seems to be a thing of the past. We can contact all agents and ask for an offer (if they are submitting) so their buyer doesn’t get left out.

What is FIRPTA?  It is the withholding of a percentage of the sales price when the Seller is a non-Us person.

Why?  So the IRS can get paid.

We talk about both. We also clarify the difference between the "Escrow Agent” and the "Closing Agent.” The only thing more confusing is that the Buyer’s Agent is also known as the Selling Agent! Matt also wants to address the Realtor’s role in the pre-closing Walkthrough.  

On today’s episode, we discuss politics for about 25 minutes. Is that 25 minutes too much? If you’re voting in Palm Beach County, Florida, take a seat and tune in. If you’re voting elsewhere, you might find our chat interesting. If you don’t vote, what’s wrong with you!?

There’s a few words and terms in real estate that often trip up agents. We start with the difference between the Escrow agent on the offer and the Closing Agent. Please listen to the differences and make sure your offers reflect the appropriate escrow agent.

Another confusion term is Selling Agent. The Selling Agent is the Buyer’s Agent who sold the property to the buyer. The Listing Agent lists the property for sale and represents the Seller. 

The Walkthrough is a time when the buyer makes sure the property is how it was when they last saw it, it’s not a time for negotiation.
