This is the second part of our "Ocean of Motions" review. On February 11th, all discovery and motions were due and so the bombardment occurred. We pick up with a brief review of Part 1 and continue with the motions for more journalist notes and edited footage. The commonwealth has filed a request to amend the Gretchen Voss redacted notes ruling as well as a request for notes, audio and video that were edited out, but in possession of Fox 25 TV in Boston. Ted Daniel, a reporter and journalist for Boston's Fox 25 had and exclusive interview with Karen Read that aired following the Superbowl.

Additional motions covered in this episode are the addition of attorney Mark Bederow to the DREAM team as well as his representation of Doctor Turtleboy in a separate but related case.

Finally, we cover the motion for reciprocal discovery and the defense's motion to reconsider the ruling on reciprocal discovery. There's a lot more to still review, but lets take it from here fellow hawks!

With a due date of February 11th for Motions and Discovery, there's no surprise that both the Commonwealth of Massachusetts and the Defense team for Karen Read went to town like a college senior at 3:00am with a final paper due by 8:00am. Not only was there an influx of motions, an ocean of motions if you will, but we also had some additional surprises on February 11th. This episode is part one, covering the motion to extract and obtain forensically sound video footage of the sally port surveillance system, The Supreme Judicial Court's Decision on the appeal on behalf of the defense regarding the verdict and possible commitment of double jeopardy, the motion to obtain Fox 25's audio and video footage as well as journalist Ted Daniel's notes and finally, the latest addition to the DREAM TEAM. We aren't even half way through this subject matter. Wings up hawks! We are ready for flight!

Did you catch the February 6th motions hearing in Dedham District court? Well, if you did, you might have been just as uncomfortable as the rest of us as both Alan Jackson and Hank Brennan agreed that the dumpster fire before them was delivered by an unspecified predecessor. As ADA Adam Lally sat there, I prayed for the camera to zoom in, however.....no such luck. Welcome to another episode of Retrial....where we discuss the on-going shenanigans before trial 2.0. Will the motion for cost recovery be approved? IS there still Sally Port video out there? Does Lally need an ice pack for those glutes? Yikes.

Things are moving quickly as we loom towards April 1st and the determined date for Trial 2.0 to begin. As a follow up to Battle Of The Experts first part episode, this episode answers some of the questions that we were left with on Friday. Judge Beverly Cannone returned two notes and responses to motions heard on Friday morning. The first was her response to Boston Magazine reporter Gretchen Voss Third Party filing. The motion sought to prevent Ms. Voss from having to turn over personal notes. The second motion heard was the request to qualify Richard Green as a defense expert via the Daubert-Lanigan hearing process. The judge responded and requested that both the Commonwealth and Defense be ready for more motions to be heard this week coming up. Stay tuned for more follow up at the end of the week regarding the still outstanding motions.

Oh so many motions! The second episode this week and it's only the beginning. The hearings of motions continue while new ones are simultaneously being dropped and responded to. The defense team has requested to cancel the Daubert-Lanigan hearing of forensic digital expert, Richard Green. However, before they get to that, an additional amicus brief had been filed by Boston Magazine reporter, Gretchen Voss.

In this episode, an update as to the motion for discovery of the journalist's notes which had been partially redacted is made by the Commonwealth, while Gretchen Voss, as a 3rd party, is requesting to not un-redact as well as consider excluding the sharing of all of her audio recordings and hand-written notes from June 2023, when she sat with Karen read for an interview. Ms. Voss Article, A Killing That Tore A Town Apart, has been the subject of discovery. The Commonwealth is convinced that the journalist is sitting on Inculpating evidence. Did Karen confess?

Oh boy! The world of Commonwealth of MA Vs. Karen Read has been rife with chatter regarding the latest motion filed by the Defense team. As of right now, they're looking for the state to cover their blunder in misleading an expert and sending him on a wild goose chase. What bigger ramifications could this snafu have?

Dr. Marie Russell recently concluded her second day in a Daubert-Lanigan hearing, in order to requalify as an expert for Trial 2.
