This podcast features the reading of my short analysis published by the European University Institute (which builds upon another short analysis published on the Corriere della Sera a few days ahead; see the previous podcast, in Italian), regarding certain untold aspects of the Dutch government perspective during the 4-day-long negotiations held between the Head of Governments of the Member States of the European Union, aimed at agreeing on size and ground rules of a common (post-)pandemic recovery plan.

The management of the COVID-19 pandemic in Italy is complicated by the not easy political-institutional dialogue between the central government and the local administrations of Regioni, bedeviled by the desultory power-sharing design determined with the 2001 constitutional reform (so-called "devolution" to the Regioni, which changed Title V of the Constitution and, in particular, Article 117).
[Article 120 of the Constitution (the emergency power of the central government to bypass the local governments, in this case "for public safety and security") is not considered here]
In this podcast, I gather three analogies that I typically resort to during the introductory class in my EU crash course for non-lawyers.
The analogies allow to draw some clear lines and develop a quick preliminary understanding of what the EU is i) by comparison with the US, ii) what is not (intended to be anyway), and iii) what are mission and powers of EU Institutions in relation to its Member States.

La gestione della pandemia da COVID-19 è complicata dal non facile dialogo politico-istituzionale tra governo nazionale e giunte regionali, dialogo complicato dalla pasticciata distribuzione dei poteri tra Stato e regioni determinato con la riforma costituzionale del 2001 (cosiddetta "devolution" alle regioni, che ha cambiato il titolo V della Costituzione e, in particolare, l'articolo 117).
Questo podcast offre una breve illustrazione del problema.
L'articolo 120 della Costituzione (il potere emergenziale del governo di sostituire del tutto le regioni, in questo caso "per l'incolumità e la sicurezza pubblica") non è considerato in questa breve analisi.
