Ostrolenk talks to Constitutional Scholar Bruce Fein on the recent rising of the US security threat level, and why America should be using a criminal model, rather than a war model, to fight terrorism. While the criminal model is not flawless, and issues of state sovereignty must be acknowledged, it is far superior to the war model. The war model, in contrast, seeks to scorch the earth as a means of protection, yet Fein argues this ultimately breeds resentment and make us less safe.
