3:05pm- On Saturday former President Donald Trump revealed that he expects to be arrested on Tuesday for hush money payments disturbed to adult film actress Stormy Daniels in 2016. In response to the possible arrest, Trump implored his supporters on Truth Social to protest. National Review’s Andrew McCarthy writes, “[t]here seems little doubt that Manhattan District Attorney Alvin Bragg’s indictment of Donald Trump is imminent…All that said, though, reports that Trump will be arrested on Tuesday are premature and probably inaccurate. 3:20pm- According to reports, Manhattan District Attorney Alvin Bragg has a long history of reducing felony charges to misdemeanors—so now, in the case of Donald Trump, why is he elevating an alleged misdemeanor offense to a felony? It seems clear any indictment is politically motivated.
3:30pm- The Wall Street Journal Editorial Board writes that “[a]n indictment of a former President must be for serious offenses with indisputable evidence.” They go on to point out the limitations of an indictment: “A key prosecution witness would be Michael Cohen, Mr. Trump’s former lawyer who is an admitted felon. Mr. Trump might claim in his defense that his payments were made to shield the affair from his wife. He has publicly denied an affair with Ms. Daniels. 3:40pm- FLASHBACK: Congressman Thomas Massie (R-KY) grilled former Trump attorney Michael Cohen. On Twitter, Rep. Massie stated, “[D]isbarred attorney Michael Cohen is the least credible witness I ever questioned during my time on the House Oversight Committee. He [admitted] that as President Trump’s attorney, he took unsolicited actions.” So, isn’t that testimony enough to let Trump off the hook?
4:05pm- While appearing on CNN’s State of the Union with Jake Tapper, New Hampshire Governor Chris Sununu—who is no fan of Donald Trump—argued that a potential criminal case against Trump could “build a lot of sympathy” for the former president.
4:10pm- CNN Legal Analyst Elliot Williams suggested that Manhattan District Attorney Alvin Bragg’s potential indictment of former-President Donald Trump is “not a slam dunk case many people wish it was.”
4:30pm- Who Won Social Media? Yes, we are doing it early…
4:40pm- During a press conference on Monday, Florida Governor Ron DeSantis responded to rumors that Donald Trump would be arrested later this week. Gov. DeSantis referred to Manhattan District Attorney Alvin Bragg as a “George Soros-funded” prosecutor.

5:05pm- The Drive at 5: While speaking with the press outside of the White House, President Joe Biden said it was “not true” that his family members took any money from Chinese businesses. Meanwhile, even CNN’s Erin Burnett concedes that new revelations suggesting Biden family members received $1 million from Hunter Biden’s foreign businesses associates “doesn’t look good.”

6:05pm- On Monday, President Joe Biden signed Senator Josh Hawley’s (R-MO) “COVID-19 Origin Act of 2023” into law. The bill will declassify all intelligence related to the origins of the COVID-19 pandemic.
6:15pm- On Monday, Joe Biden issued the first veto of his presidency. Eleanor Mueller of Politico writes, “blocking the repeal of a Labor Department rule that permitted retirement investing tied to environmental and social goals.” The legislation had received bipartisan support from Senators Jon Tester (D-MT) and Joe Manchin (D-WV) and Congressman Jared Golden (D-ME).
