  • Too Similar? Monster Energy Kills Ubisoft's Gods And Monsters (VL313)
When Ubisoft's "Gods and Monsters" video game had its name suddenly changed to the far less poetic "Immortals Fenyx Rising", many questioned the alteration. But by far the most frequent of these questions related to the intellectual property status of the name. Could it have been rejected? Could someone have opposed it?
    Enter Monster Energy.
Like a Fenyx from the ashes, trademarks will rise...in Virtual Legality.

  • Ninja Returns To Twitch! The Past And Future Of The Dr Disrespect Saga (VL Extra)
When Mixer announced its closure this summer, and Twitch banned Dr. Disrespect not a week thereafter, one could be forgiven for assuming that the earlier event might have had some effect on the latter.
Indeed, here in Virtual Legality we suggested as much, stating that Twitch's freeing up of value in the Dr. Disrespect contract in such circumstances was not that unusual for the more "litigiously" minded companies out there, and also... that such value *might* just find its way into the pockets of personalities like Ninja and Shroud.
An insane theory? Perhaps. But with Ninja announcing his return to Twitch today, there can be no question that the streaming giant felt that it had money to spend.

  • Apple Sues Back! "Epic Undertook Its Conduct With Malice And Fraud" (VL310)
Phase 2 of the "Epic vs Apple Legal Universe" continues with Apple's own dose of fiery rhetoric, not only in defending against Epic's complaint, but also in attempting to take the fight back to Tim Sweeney and company.
What are the strengths and weaknesses of Apple's arguments (and argument style)?
What are "punitive damages" and how does Apple want them to be used to punish Epic's alleged "fraud"?
And just why are we back in the world of 70 page document filings, anyway?
Sometimes Apple wonders why it even brings the thunder...in Virtual Legality.
