My name is Marc Blatstein. In 2006, I, too, was Indicted and convicted of a felony and lost my medical license. To call this a life-altering event, at best, was an understatement. With work, I got my license to practice reinstated in full. ·      The Lesson: Prison is Temporary.
My goal in this series is to provide you with the information you’ll need to survive and navigate these times. Knowledge and Preparation will help build back the Confidence you’ll need to get through this process.·      Since you’ve heard that the DOJ and Feds have been asking questions, their case against you is mostly complete, with a 98% Conviction Rate.·      Delaying to act now is at your peril.·      Hiring a legal team doesn’t just mean that they have experience; they also need a proven track record of successfully defending cases like yours.·      The choices you make today - will help you tomorrow.
Right after the Interview,·        Counsel sends a follow-up letter (#2) to clarify topics that need further explanation. It happens.·        Then rehash the Sentencing Guidelines, restating your arguments.·        If not already completed, please provide statistics for cases similar to yours, including those of your judge or other judges in nearby districts, that support your recommendations.
To show your dedication to your client's case and improve the likelihood of a positive result, it's important to go above and beyond to build a strong connection with the probation officer. Don't hesitate to take this crucial step and contact the probation officer today. Please note that there are no guarantees for your efforts, but you'll never know if you don’t try.
Review the PSR before it becomes official and gets handed to the Judge.

  • AFTER YOUR ATTORNEY’S FIRST MEETING WITH YOUR PO AND BEFORE YOUR PSI – FOLLOW-UP WITH A LETTER
INDICTED AND FACING PRISON. ·     The Lesson: Prison is Temporary.
After your 1st meeting with the Probation Officer, follow up  Letter (#1) that:1. Humanize your client while advocating your defense strategy.2.  Review the documents the officer needs and by what date.3.  The date(s) their final PSR dictation and final objections are due.4.  What dates are best for the Interview? It should be at least three months away.5.  A Sentence and Placement Recommendation may possibly be suggested.6.  Sentencing Guidelines Calculations (specifically if these are complex cases involving multiple counts, various guidelines, and calculations), providing a detailed explanation that is easy to understand as these officers are not attorneys (preferably in person), will likely be appreciated by the officer.7.  Restitution/Foreclosures, Supervised Release. Financial Restitutions are to compensate the victim, and forfeiture and fines are to punish the defendant. Supervised Release (SR), while no one wants it, needs to be in the J&C as they are requirements for early release to HH or HC. Therefore, what is the least amount of time under SR, six months?8.  If you feel that an enhancement is on the table, consider why that may not apply, but if it does, admit it and say so.9.  Present the defense’s version of what happened; to do this, you need all the information from the prosecutor. A well-written Narrative with a Release Plan is also strategically helpful.10. This can also become part of the Allocution and be woven into the Release Plan and Narrative.11. Attach salient points from a few Character Reference letters (look at my character letter section.) The remaining letters can be provided and left with the Probation Officer at their PSI.12. Mental Health Evaluation. Most individuals have some mental health issue that goes undiagnosed. If your clients face a large sentence, and you have the slightest doubt as an attorney, Get Them Evaluated.·     Even if the client is just taking anti-anxiety medications, should there be an underlying condition, this is their future.·     Whether you use that information is up to the client and counsel.·     If that medication contributed to the charges, and it was within the 12 months before your arrest, then you may qualify for RDAP, which needs to be included in their PSR.13.    Include in the Personal NARRATIVE pictures of the client and their family. The Narrative could also be one with a 10-minute Video and could have more impact on the judge.·     Counsel, at their first meeting with the probation officer, can ensure they fully understand the case and our position.·     This personal connection can significantly impact the outcome, making it crucial for the defense to take every necessary step to ensure the best possible outcome.·     If you lose at trial (most do), don't despair. You can still present your case interpretation and make a compelling argument by scheduling a personal meeting with the probation officer.·     Remember that probation officers are often overwhelmed with their workload, so it's important to accommodate their schedule and document requests.

  • The Probation Officer, Your Interview And Best Practices
Welcome to my video series, " INDICTED AND FACING PRISON." I know firsthand how surreal and overwhelming this experience can be. That's why I'm here to provide you with crucial daily information. You can navigate these challenging times with knowledge, preparation, and confidence.
The DOJ and Feds have been asking questions; their case is mostly complete. With a 98% conviction rate, the odds are not in your favor. However, knowledge is power, and it's in your hands. Delaying your next step could have severe consequences.
Your future is at stake, so hiring a legal team with a proven track record of successfully defending cases like yours is critical. Don't just settle for experience; choose a team that can get you the best outcome. Make the right choices now, and you can move forward with confidence.
The Probation Officer who conducts your interview also writes your Presentence Report, which will stay in your file forever – for life. They also have the ear of your judge, who depends on them to learn all they can about you and make sentence and placement recommendations.
If contacted early enough, they may still have an open mind if they have not spoken with the prosecutor. But if they had already spoken with the Prosecutor before they ever met or spoke with the defense team, and all parties waited until the interview – they may have already been influenced, just not in your favor.
Your attorney's initial efforts are spent setting up a personal meeting with your officer to learn what they already know, share your defense strategy, and learn the due date for their final presentence report dictation.
These Officers are often overworked and have little time, which is one reason it is very helpful to learn what they need and by what dates. It would be appreciated if they could provide everything spell-checked in an organized format 1-2 weeks before the formal interview.
If the case is complicated, taking the extra time for counsel to meet with and review the Sentencing Guidelines and the defendant’s personal background could benefit your defense and future.
Also, ask if getting a copy of their PRESENTENCE REPORT WORKSHEET early is possible. This is a very helpful guide to follow, and a personal narrative should include all of the worksheet categories, making it easier for the officer to follow and ensuring that your information is included.
At the interview, the officer has the time to get to know you personally while asking any remaining questions that they may have.
Supervised Release. While this is something to avoid, the caveat is that having supervised release in your order is a must to get early release to either Halfway House or Home Confinement. Possibly, supervised release can be ordered for several months. I do not know, as this is not legal advice but an idea.
Thought should be given to creating a release plan, as judges want to know that you’ll not be back in their courtroom. BOP case managers and residential reentry managers will be interested in learning about your plans for work after you’re released.

  • YOUR JUDGE IS KNOWN FOR BEING HARD AND STRICT, SO MAKE SURE TO BE PREPARED AND RESPECTFUL.
Different judges have varying sentencing styles; some may be more lenient, while others may take the opposite approach. #PPRSUS, #BOP, #PSR, #WhiteCollar, #crime, #psi, #lawyer, #attorney, #ppp, #MoneyLaundering, Hello, and thank you for tuning into INDICTED AND FACING PRISON.
My name is Marc Blatstein. In 2006, I, too, was Indicted and convicted of a felony and lost my medical license. To call this a life-altering event, at best, was an understatement. With work, I was able to get my license reinstated in full —·      The Lesson: Prison is Temporary.

Approach all Judges with Respect and Do Not draw the Anger of the Court (i.e., Witness Tampering). A well-written NARRATIVE and Allocution may move the hardest of judges.
Decisions will be based on various factors, including the Sentencing Guidelines, Enhancements, your Criminal History, Personal Safety Factors, are just some of the content that can sway the Probation Officer's Recommendation regarding your sentence and placement to your judge.·      Probation Officer's (PO) Recommendation: Your PO is the Most Important Person in Your Life.·      Sentencing Guidelines: Verify that your Unofficial PSR is accurate.·      Personal Safety Factors: If you were Not in Charge, Not the Kingpin, the PSR should reflect this; being wrong puts you at a possibly higher security level.·      Enhancements: Verify and challenge inaccurate facts with your attorney, if relevant.·      Your Criminal History.
However, as a defendant, your efforts in preparing for your PSI can make a significant difference. Accepting responsibility for your actions and genuinely expressing remorse for the victims you have harmed can work in your favor.·      A skilled attorney who understands "their" judge's likes and dislikes beforehand is crucial.·      A well-written Personal Narrative will be integral to your Presentence Report and reflect the unique perspective woven together into your Report.·      Organized and prepared accurately and comprehensively before being given to the probation officer, again 1-2 weeks before the interview, they allow them to be included in your official PSR—Under Seal.

To increase your chances of a favorable outcome, it is recommended that you provide your Officer with all the requested documents, including your Biographical Background (such as medical records), Personal Identification, and a well-written Personal Narrative and Release Plan. You may also consider providing these in both written and video formats, as this can make it easier for the judge to understand who you are as an individual.
Before submitting your materials to your Probation Officer, please ensure they are proofread, organized, and submitted 1-2 weeks before your interview. Your Probation Officer can copy and paste your written version into your Presentence Report while physically attaching the original document to the report.
How well you are prepared for your Presentence Interview will affect your sentence and eligibility for the needed Medical Care and specific First Step Act Programs.
Prepared and comprehensive, it allows you to request a sentence that’s within The Guidelines and includes all of your Biographical Background and Personal Identification Information. Requested, organized, and delivered to the Officer one to two weeks before the interview, provides them with the time needed to fill out their Probation Report Worksheet.
Then, during the interview, the probation officer has the time to get to know the defendant personally and ask any remaining questions they may have. Further, they may appreciate your efforts in getting them the necessary information, showing that you respect their time.
In the end, your P.O. may come away from your meeting feeling that you are quite different than the person described in your Indictment as you came to the interview prepared, more than any other defendant they have interviewed recently. This, in turn, could result in a favorable recommendation to the Judge (as Judges look to them for their input regarding your sentence and BOP placement) along with a favorable Presentence Report.
