  • Judge CARLTON W. REEVES: ORDER GRANTING QUALIFIED IMMUNITY
The Constitution says everyone is entitled to equal protection of the law – even at the hands of law enforcement.·       Over the decades, judges have expanded legal doctrine to protect law enforcement.·       The resulting doctrine, called “Qualified Immunity,” has not just evolved but morphed into Absolute Immunity,·       This has left judges with few viable options and the need for change.
This story starts with a man (Jamison) driving his Mercedes-Benz CLK-Class convertible, which he had purchased 13 days before from a car dealer in Pennsylvania to his home in South Carolina. The journey takes him through Mississippi.
Jamison didn’t,·       look like a “suspicious person·       make an “improper lane change.
Further, Jamison wasn’t·       suspected of passing counterfeit $20 bills·       mentally ill and in need of help.·       driving over the speed limit. No, Jamison was a Black man driving his new Mercedes convertible. His mistake was being black and in the wrong place at the wrong time.
From Officer McClendon’s testimony.Officer McClendon says he stopped Jamison because the temporary tag on his car was “folded over to where [he] couldn’t see it.” ·       It must have been held with only two bolts, but it had four.
Officer McClendon asked Jamison for “his license, insurance, [and] the paperwork on the vehicle because it didn’t have a tag.”·       Jamison provided his bill of sale, insurance, and South Carolina driver’s license.
Officer McClendon's background check using the El Paso Intelligence Center (“EPIC”), the National Criminal Information Center (“NCIC”), Jamison's criminal history, and the VIN on his car all came back Clear.·       But he never told Jamison.
Next comes inconsistencies and intimidation from the officer.McClendon asks Jamison if he could search his car. Jamison asked him, “For what?”·       “to search for illegal narcotics, weapons, large amounts of money, anything illegal.”
First Request to Search.·       ...the officer changes the conversation to: what kind of work do you do? I’m a welder.Second Request.·       ...he had received a phone call reporting that there were 10 kilos of cocaine in Jamison’s car.·       Jamison said No.Third, Forth Request to Search.·       Officer: “Come on, man. Let me search your car.”Fifth Request to Search.·       “I got the phone call [about] 10 kilos of cocaine.” McClendon continued to bring up,1.       “the 10 kilos of cocaine,”2.        asserted that the car was stolen,3. …and asked how many vehicles he owned, and he claimed that Jamison did not have insurance on the car.
Jamison finally gave up. “As long as I can see what you’re doing, you can search the vehicle.” ·      McClendon searched“from the engine compartment to the trunk to underneath the engine to the back seats to anywhere inside the vehicle.” · In his deposition, he did not find “anything,” and· The search dog did not find “anything.
In total, the stop lasted One hour and 50 minutes.

    INDICTED AND FACING PRISON
I’m Dr. Marc Blatstein. I spent time in Federal Prison, and now I’m here to help you on your journey. After the video, for more, check out PPSRUS.com.With work, I was able to get my license to practice reinstated.·      Prison is Temporary.
Knowledge and Preparation will help build back the confidence you’ll need to get through this process.
    ·      Since you’ve heard that the DOJ and Feds have been asking questions, their case against you is mostly complete, with a 98% Conviction Rate.
    ·      Hiring a legal team doesn’t just mean they have experience; they also need a proven track record of successfully defending cases like yours.·      The choices you make today - will help you tomorrow.
Building your Online reputation takes consistent work - over time.·      Some companies can offer to do this for you, but the Google algorithms are excellent, and when they stop adding quality content, all of your efforts get reversed. I spent thousands, only to have it fail.·      Next, no individual or company can guarantee their efforts. One way or another, this requires your efforts. Either 1st) you pay someone else forever to post content online, or 2nd) you begin doing it yourself slowly over time (the tortoise and the hair theory…).
What can you do?·      Purchase your name = Your Personal = Now Your Domain Name.·      If you've started a business, this too is good
Begin adding content, which could include,·      What you are doing in prison (in personal growth and development -which turns into Your Release Plan),·      Add your past CV (or Resume),·      Write your Autobiography, which builds on your Narrative·      Share with your lawyer to ensure it doesn't conflict with your defense.

  • PROBATION, WHILE ON SUPERVISED RELEASE
I’m Dr. Marc Blatstein. I spent time in Federal Prison, and now I’m here to help you on your journey. After the video, for more, check out PPSRUS.com.With work, I was able to get my medical license reinstated in full.·      Prison is Temporary.
Knowledge and Preparation will help you regain the confidence you’ll need to get through this process.·      Since you’ve heard that the DOJ has been asking questions, their case against you is mostly complete, with a 98% Conviction Rate.·      Hiring a legal team doesn’t just mean they have experience; they also need a proven track record of successfully defending cases like yours.·      The choices you make today - will help you tomorrow.
Another reason why a well-written Personal Narrative could influence your probation officer.·      Before Supervised Release, your Probation Officer (PO) will have inspected your future home and reviewed your BOP file, which includes your Presentence Report (PSR).·      If you have not written a narrative, all they will read is Your INDICTMENT – which isn’t that flattering.·      But with your NARRATIVE written and weaved into your PSR (and attached), your PO may have a slightly better view of who you (as a person) are.·      Remember they have a large caseload, and you are one of many persons they supervise. Make it easier for them to judge who you are.·      For most, you could be under supervision for several years.·      It would be much easier for all if your PO read a file from the BOP that included your Personal Narrative, which you wrote.·      This officer will review your PSR (Presentence Report) beforehand and come to a preconceived notion of who you are.·      This is one more reason why having your NARRATIVE and Release Plan embedded and attached to your Presentence Report (PSR) is helpful to ensure a successful supervised release.·      This is one more reason to know who your stakeholders are, how they view you, and their expectations.
Probation officers are essential to your transition back into society during supervised release.·      If you own your own business and want to be self-employed, you can be if your job or company was not involved in your Charge.·        But you may not be allowed to be the boss until you are off supervised release. Instead, whoever has been running the business can hire you at a ‘normal wage’ and earn the confidence of the PO that they will be available onsite or by phone as needed. You will be available onsite during your shift for unscheduled visits.·        Some of your short-term responsibilities include being available should they call or stop by any time.·      In the long term, you must stay out of trouble, you may be drug tested regularly, you must not have firearms, and you must complete a financial form monthly.

The Residential Reentry Managers (RRMs) have a limited number of beds available nationwide, which means that while mandatory, they are highly selective when it comes to accepting new inmates into their facilities and, in turn, home confinement programs, as they are also responsible for supervising those individuals.·      This is because they want to avoid any issues that may result in sending inmates back to prison (which makes them look bad to Their Supervisors). Therefore, they rely on recommendations from BOP Case Managers to determine a person’s (inmate's) suitability for placement.·      Engage in constructive activities and develop a well-thought-out release plan.·      Earn your GED and start taking college courses if applicable.·      This is your time to start exploring any interests you may have by reading nonfiction subjects (philosophy, history…, etc.) or painting if that is your passion. Just find something, and it will begin to take your mind away (a bit) from prison—as this is temporary, you will be released.·      If you've been through college or grad school (doctor, lawyer, PhD, etc...) or have business or life experience, offer to teach a class and give credit to the Case Managers.·      Remember that RRM and BOP Case Managers are employees responsible to their supervisors. Everything we do makes them look good or bad, so no promises here; keep moving forward.
The BOP is opening Day Reporting Centers Nationwide, where you are on home confinement (as these have no beds).·      They consider factors such as your risk level, progress while incarcerated, and ability to comply with the program's rules and regulations.·      By developing a solid release plan and demonstrating your commitment to your post-release goals, you can increase your chances of being accepted into a halfway house or home confinement program and successfully reintegrating into society.

Preparation. With a Routine and a Detailed plan to follow before you enter prison, you'll have a general idea of what to expect.·      This is important because, on day 1, nobody wants a surprise,·      Things usually do not go according to plan - this is where sticking to a Routine is a core value.·      Expectations. 1. His Presentence Investigation Report explained that he “is truly sorry for putting himself, the court, and his family through this, and this will never happen again. He said he has been thinking about how he got into this situation, his thinking patterns, and what he can do differently in the future, including choices regarding his associates.”

Education and Bettering yourself in prison.
    2. BOP Case Manager wrote:
    ·     "I have over 20 years of experience within the BOP, and very rarely have I come across an inmate who has truly worked on himself from the day of his admittance in the custody of the BOP. It's rare to see someone genuinely bettering themselves for a successful return to society."
    ·     ..." A valuable, trustworthy, and indispensable asset - a true testament of an individual who has not only educated himself but also many of his peers as he prepares for re-entry back into society."

The court ruled that there is no clear basis in the statute to categorically prevent district courts from considering non-retroactive changes in the law as a factor in compassionate release decisions. Appellate precedent and 1B1.13 do not prohibit the inclusion of such factors in the compassionate release calculation.

  • CASE MANAGERS LACK PRD CALCULATORS; AS THE BOP CENTRAL OFFICE HAS NO ANSWERS, LEAVING AIC – IN CUSTODY BEYOND THEIR PROJECTED RELEASE DATE (PRD)
This 2013 BOP Memo was written five years before the First Step Act.
Still, in 2024, there is no calculator to assist case managers in moving men and women out of institutions sooner. Forbes: 7/18/2024 Walter Pavlo
In a June 24, 2010, memorandum, "Revised Guidance for Residential Reentry Center Placements," and an April 14, 2008, memorandum, "Pre-Release Residential Reentry Center Placements following the Second Chance Act of 2007."
The two home confinement options they endorsed.
    1) Placement under the supervision of an RRC in aa HH or HC, or2) Placed under the Federal Location Monitoring (FLM) program operated by U. S. Probation, where available.3) Both are cheaper than keeping AIC incarcerated when they could be released with some beginning to make restitution payments.
**This is a perfect example of why the personal narrative and an ever-growing release plan with a history of spending one's time in constructive activities could smooth out the process and get you that case manager's HH or HC recommendation for the RRM.
The Caveat is that when dealing with the BOP or the courts, unfortunately, there are No Promises or Guarantees.
BOP's new video was released to clarify the rules under which First Step Act credits are earned and applied.

    The Disconnect.
Case managers on the front lines of implementing this law are encountering problems because of their understanding and interpretation of the law and halfway house capacity issues.
Jeremy Cooper, NCRO Correctional Programs Administrator.
You can "stack" the 2nd Chance ACT HC and then add your FTCs toward it, BUT THAT's NOT HAPPENING.
    Why?
Case Managers don't have a Current Projected Release Date (PRD) or a calculator to see anyone's real-time transition date to halfway house,” Cooper said.
With no calculator, there can be no stacking, and this calculator has been
    promised for months.
Dr. Gabel, FTC-related issues using the Administrative Remedy Process. Case managers are unaware of these rules; 'the process is broken.' Many staff do not understand the nuances of the law1.       The process (§2241) can take months to over a year to even reach the district court, sometimes too late2.       Case Managers are left to (be the middle child), telling AIC that “The BOP Central Office” advised they have no update or information regarding their projected date of leaving the institution.3.       At times, they are held until after that date.
