    ·     Prison is Temporary.
Knowledge and Preparation will help build back the confidence you’ll need to get through this process.
    ·      Since you’ve heard that the Feds have been asking questions, their case against you is mostly complete, approaching a 98% Conviction Rate.
    ·      Hiring a legal team doesn’t just mean they have experience; they also need a proven track record of successfully defending cases like yours.
It is crucial to thoroughly review your Presentence Report (PSR) before your sentencing hearing to ensure that all the facts are presented accurately.
    ·      If you find any misrepresentations of facts, you must catch them and request that the Probation Officer (PO) correct or add the new content before your hearing.
    · Inaccuracies in the PSR can significantly impact the outcome of a sentence and eventual placement and will follow you forever.·      Your clients’ PSR is an essential document that gives the court a detailed overview of their criminal history,·     The INDICTMENT is the government narrative or you, and if you do not speak up for yourself, the four corners of that document will surely sentence you.·     If you weren’t the “ringleader” or the person giving orders, verify that; otherwise, your security level will likely increase.
    ·     Judges know that crimes Do Not Happen in A Vacuum. Therefore, your NARRATIVE is your one opportunity to explain what happened in your life without making excuses for what you did.
It is important to note that your PSR includes your narrative, which provides additional context and details to ensure that your PSR accurately reflects your circumstances and mitigating factors.
    ·      Your client's NARRATIVE should include information about their role in the nature and circumstance of the offense and their personal history and characteristics under 18 U.S. Code § 3553.
    ·      Attaching their NARRATIVE and weaving the applicable parts into their PSR (as well as inserting it as an attachment) is the only way to ensure that it becomes a permanent part of your file.

Provide openings for your client to feel comfortable enough to ask questions so they can learn what goes into a narrative, why it’s important, what Prison is like, what happens on day one, what you can bring, plus much more.
At sentencing is your chance to answer your judge's questions:·      Why and What Happened that caused you to break the law?
    ·      Do you have remorse for the victims you’ve harmed, and are you willing to accept responsibility for your actions?·      THE MOST IMPORTANT PERSON YOU’LL FIRST MEET IS THE PROBATION OFFICER WHO INTERVIEWS YOU.•       Their job is to write the official Presentence Report, which dictates your future, and then they provide a sentence recommendation to your judge.·      Putting your story into words (your narrative) followed by a conversation with your judge at sentencing can impact your sentence either below the guidelines (for the better) or above the guidelines (making it worse).

Why?Sierra v. JacquezAn Example of Why You Need to Document Your FSA Credits: The Petitioner thinks (apparently not written and documented, plus he has many other issues) he has earned 365 days of FSA time credits and is entitled to immediate release. The BOP has submitted the Petitioner's FSA Time Credit Assessment, which shows That He has earned 75 FSA time credits.INSURANCE IS SOMETHING WE DON'T WANT TO PAY FOR - BUT ARE GLAD IT'S THERE WHEN YOU NEED IT.·      On the outside, it is Home, Health, or Auto; in prison, it's Documentation.·      Consider detail when documenting everything that you do.·      This includes every meeting with staff (no matter how insignificant),·      Document each FSA Program you attend in chronological order, including other constructive things you do to increase your personal growth and development while in prison. Be prepared for things not to go right – because they won’t. Stay out of trouble.
    ·      When you have a concern, the BOP encourages using the Administrative Remedy Process to address all Grievances.
    ·      Only you can control your emotions, as intense as they may be.
    ·      Don’t innocently borrow someone’s Cell Phone,
    ·      Do your Job – Don’t pay someone else to do it; BOP staff will know, and,
    ·      Don’t refuse any FSA Programs.
    ·      Disappointment can come from many sources. It can be external and present as bad news from home, loved ones, or counsel.
    ·      Or it can originate internally, presenting in many forms: a borrowed cell phone when you were lonely, but otherwise, you have been on the “straight and narrow.”
You've been taking your First Step Act (ETC) Programs, earning Good Time Credits (GTC), and having a job that helps you pass the time.
    ·      Then, 10 months later, your case manager informs you that a cell phone was found, and it had a number on it that matched one on your contact list. Is it possible?
    ·      They ask you if you have anything to say.
    ·      Do you lose your GTC and your ETC and get put in the Hole/SHU with a new charge and more prison time? Or do you Snitch?
    ·      This is why we prepare you before you go with Knowledge of the Dos and Don’ts and a plan for using your time constructively and Developing a Routine.
    ·      The Routine: Finding a job you like, a bunk to sleep in, FSA Program Classes to attend, and books to read that you are interested in (albeit non-fiction history, math, art, philosophy, biographies, etc.) while writing short paragraphs on the subject matter that you would like to remember. At the same time, these notes become part of your Release Plan.
    ·      The BOP Staff will eventually find out. I, too, saw these things, but it never crossed my mind.
    ·      The closest I came was when someone offered to share their Cigar with me one day. I loved having a cigar while anchored after a very relaxing day of sailing. This Was Not Relaxing, and I Had No Interest because I was too scared of getting caught –but it was tempting – just not That tempting.

The state of parole. In 2022, parole approval rates varied widely. Only 8 states had grant rates above 50%, with Wyoming having the highest rate at 78%. Alabama and South Carolina had the lowest rates at 10% and 13%, respectively. South Carolina's 2023 data show a drastic drop to a 7% approval rate.
Parole boards often default to denial, placing the burden of proof on incarcerated individuals to justify their release. This is problematic because the board often considers factors beyond the applicant's control, such as the availability of programming or education in prison, or unchangeable aspects, such as the nature of the offense. Individuals have little influence on the outcome when release hinges on these factors.

  • AIC WOODLEY SUES (§2241) BOP FOR ETC EARLY RELEASE
I’m Dr. Marc Blatstein.  I’m here to help you on your journey.
Administrative Remedy: The processPetitioner: ALPHONSO WOODLEYRespondent: The BOP§ 2241
The BOP has agreed to the following facts.·       WOODLEY was sentenced to a term of imprisonment of 120 months, with 60 months of supervised release, after his conviction for a drug conspiracy offense.·       Based on projected good conduct time,  April 8, 2027;·       However, because of Earned Time Credits (ETCs) and a completed Drug Abuse Treatment Program (RDAP), his PR date is now April 8, 2025.·       The BOP has applied 365 days of ETCs toward his release date and 445 days of ETCs toward time in a residential reentry center (RRC). He is currently eligible for placement in an RRC, and the BOP has notified him that he will be placed in an RRC in Tampa (his release location) on September 4, 2024.·       According to the BOP, placement to an RRC is made to the extent that resources and bed space permit, and it is not required if no space is available·       In response to the petition, The BOP argues that the place WOODLEY confinement falls within the BOP’s discretion, with which this Court has no authority to interfere. The BOP argues that two statutes apply here.
    SHALL?
    First,
    ·       18 U.S.C. § 3624(b) grants the BOP the authority to designate the place of a prisoner’s confinement and to transfer a prisoner to a different facility, not reviewable by any court.”
Second, The transfer §3624. Subsection 3624(c) includes the following;(1)    In general. – The Director of the BOP shall spend a portion of the final months of that term (not to exceed 12 months), RRC …
    (2)    Home confinement authority. – The authority under this subsection may be used to place a prisoner in home confinement for a shorter period of 10 percent of the term of imprisonment of that prisoner or 6 months. The BOP shall,(3)    Section 3624 provides that the BOP must, to the extent practicable, ensure that a prisoner spends “a portion” of his final 12 months under conditions that will prepare him for reentry into the community.
Numerous courts have held that the BOP has no discretion to delay or refuse the transfer - transfer is mandatory.·       Dec. 22, 2023) (agreeing with the interpretation);·       Under a plain reading of this provision of the FSA, which includes the word “shall,” the BOP is required to transfer under Subsection 3624(g).
Numerous courts have held that transferring an eligible prisoner to prerelease custody is mandatory.·       IT IS THEREFORE ORDERED BY THE COURT THAT the petition for habeas corpus under 28 U.S.C. § 2241 is hereby granted and  (WOODLEY) be transferred to prerelease within 30 days of the date hereof.
