Knowledge and Preparation will help build back the confidence you’ll need to get through this process.·       If the DOJ has been asking questions, they already have you, with close to a 98% Conviction Rate.·      Hiring a legal team doesn’t just mean they have experience; they also need a proven track record of successfully defending cases like yours.·      The choices you make today - will help you tomorrow.
Before Sentencing:1.     Your attorney, who is paid to keep you out of prison.2.     The Probation Officer who Interviews you and recommends a possible sentence and placement to your Judge. SO YES, NOW IS YOUR OPPORTUNITY TO MAKE A NEW ADVOCATE and get all of the information organized and spellchecked, including your Narrative and Release Plan, to them 1-2 weeks Before your interview,3.     The DOJ wants a conviction,4.     The Prosecutor wants you to spend a lot of time in jail because you are a bad person (Remember how your INDICTMENT sounded).
The judge knows all of this, except the only person he/she knows nothing about is you.1.     They know that crimes don’t happen in a vacuum, so how can you humanize yourself to the court to counter the DOJ indictment/Narrative of you?
Inside:·       Communicate respectfully with your case manager.·       Case Managers deal with many different people daily, weekly, monthly, and yearly. They constantly hear the same complaints.·       Do not get a reputation for being a “complainer.”·       They are human and see hundreds of new faces each year. Try to be respectful even when things aren’t going your way, which will happen often: ·       Keep your efforts on getting home. Prison is temporary for you; Prison Staff are here daily as this is their life.

The Criminal Justice Act and the CJA Guidelines (CJA) ensure that court-appointed defense counsel can secure funding for fees and expenses related to retaining experts, investigators, and other professionals, including paralegals and interpreters, to support the defense.
You can currently contract for up to $2,400 in fees in non-capital cases with prior authorization by the presiding judge.·      Investigators', experts', and other professionals' expenses are reimbursable and do not count against the fee maximums.·      If you know that the expert fees will probably exceed the $2,600.00 limit, you will need to apply to the presiding judge for certification that funds over the maximum are necessary.·      This request is forwarded to the Chief Judge of your Circuit Court of Appeals, who holds approval authority.

I’m Dr. Marc Blatstein. I spent time in Federal Prison, and now I’m here to help you on your journey. After the video, for more, check out PPSRUS.com.·     The Lesson: Prison is Temporary.
My goal in this series is to provide you with the information you’ll need to survive and navigate these times because Knowledge and Preparation will help build back the Confidence you’ll need throughout this process.·     Since you’ve heard that the DOJ and Feds have been asking questions, their case against you is mostly complete, with a 98% Conviction Rate.·     Hiring a legal team doesn’t just mean they have experience; they also need a proven track record of successfully defending cases like yours.·     The choices you make today - will help you tomorrow.
Your JUDGE understands that crimes do not happen in a vacuum. Most are also very interested in learning from the defendant, in their own words, what caused them to break the law. What Happened?
How can you share with your judge the events of your life? Start with a well-written Personal NARRATIVE of Your Life - Your Autobiography. The DOJ has already told your life story through your Indictment, which is not very flattering.
    Judges Know that,
    1.   The DOJ: They Want Prison Time. By the time the defendants are aware of the Department of Justice, the investigation part of the case is mostly complete, and the DOJ has a Conviction Rate of 98%, resulting in a prison sentence.·     The time incarcerated is influenced by whether counsel and client choose to go to trial or accept a plea. Whether the defendant has written their NARRATIVE and had an honest conversation with themselves and then the judge at sentencing.·     The court, Probation Officer, and the Judge will all be aware if you (the client) violate before your attorney,
    3.   THE PROSECUTOR: The judge knows that the Prosecutor wants Prison time.·     After the Interview and Investigation, the Probation Officer (PO) will complete their probation report.·     Once you have provided all the remaining documentation, they will draft the official presentation Report (PSR). You may also elect to include your thoughts on sentencing and BOP placement request and the reasons supporting that request.·     Counsel usually knows nothing about their client’s background, but a well-written Personal NARRATIVE (or autobiography life history) can change that.·     Your clients must feel comfortable asking questions, and counsel should be completely transparent about the case.·     As a physician, I know that patients were sometimes hesitant to ask questions to me, ‘The Doctor in the White Coat’ questions, but I did my best to put them all at ease.·     Judges understand that crimes don't happen in a vacuum and want to hear from you, now the defendant.·     They want to understand the circumstances that resulted in you breaking the law and standing before them today.

    My Comment:
The Defendant must pay attention to what they are and are not allowed to do once placed on pretrial release. They must not lie on any documents or to anybody.
    ·      At the start of the legal process, a magistrate judge will introduce the charges.
    ·      Depending on the severity of the case, a few release options are available, including personal recognizance, secured bond, bail, or being remanded at that time.
    ·      Pre-trial supervision is under an Officer of The Court
    ·      Then they're taken into custody by the US Marshals, where they're arrested, fingerprinted, photographed, and have a DNA sample taken.
    ·      Pre-trial services are where the Court Clerk will inform them of their rights and restrictions. Pay attention.
    ·      It is essential to note that they must be fully compliant and respectful throughout the process. Now is not the time to anger your judge.
    ·      Firearms are not allowed (and may not be allowed in your home), and you may be required to wear an ankle bracelet to monitor your movements. This may be cellular or require a landline.

Comprehensive Preparation for The Presentence Interview that includes a well-written NARRATIVE and preparation for the Allocution1.      The goal enables the court to consider sentences outside the guideline range. It’s important to note that the government typically does not provide this (helpful) information voluntarily to the defense.2.      Counsel will outline each factor for the PO to consider:3.      Document that the Defendant Does Not Have More than:Four criminal history points:a prior 3-point offense, ora prior 2-point violent offense, nor did they use violent threats.4.      The offense did not result in death or injury.5.      The defendant was not an organizer, leader, manager, or supervisor.6.      The defendant has truthfully provided the Government with all information and evidence.7.      If the probation officer is open to a variation, persuading the court to impose a sentence below the guideline range could be made at this time.8.      The PSR can also provide information about a defendant’s educational, vocational, and avocational interests, which can facilitate a recommendation for placement in a facility with appropriate programs to enhance rehabilitation and successful return to society.
Knowing what programs and medical care each BOP facility provides will help their client make a specific placement request and document program availability in that facility, paired with the defendant's needs, as referenced in their PSR.

It is essential to prioritize and evaluate cases where there’s abuse or trauma.·      Whether or not you believe it was a contributing factor, seeking an 'expert's recommendation' is crucial.·      Should you need an expert who would be accepted by the court, getting an expert recommendation from the prosecutor is wise, as it would make their attempt to challenge their results as the recommendation was theirs.·      High-strung white-collar defendants believe they are fine when they may not be.·      Therefore, getting that second opinion consultation is recommended for their benefit.·      This may also be when their list of prescriptions comes to light.·      Due to the high incidence of mental illness in functioning adults, both in and out of prison, addressing this issue now could be a significant mitigating factor.
FYI: Judges prefer to speak with and question the treating physicians rather than only experts at the sentencing hearing.
Is this you?1. You’re exceptionally bright, prosperous, highly functioning, skilled, and motivated; you work long hours for acceptance, money, and privileges.2.  Are you an obsessive-compulsive perfectionist?3.  Do you suffer with depression and anxiety?4.  What was your drive to be personally and financially successful? Think back to growing up.5.  The result could be a generally law-abiding person who finds themselves engaging in inappropriate or illegal behavior.6.  With a proactive medical consultation, a diagnosis of bipolar disorder can be crucial before the presentence interview and sentence mitigation.7.  According to the most recent statistics from the U.S. Sentencing Commission, only 6% of inmates were granted downward departures for diminished capacity (U.S.S.G. §5K2.13) despite 50% of inmates displaying symptoms of mental health issues. This raises crucial questions about the sensitivity of judges to mental health concerns.8. Conversely, the problem could lie with defense counsel, who might not invest sufficient time in fully exploring their client's social and psychological history. -Tess Lopez, Probation Officer

  • MENTAL ILLNESS: OVERLOOKED IN CRIMINAL WHITE-COLLAR CASES
Welcome to my video series, INDICTED AND FACING PRISON
My name is Marc Blatstein. In 2006, I, too, was Indicted and convicted of a felony, and losing my medical license almost broke my soul. With work, I was able to get my license reinstated in full.My Takeaway: Prison is Temporary.
Providing you with Knowledge and Preparation will help you build back the confidence you’ll need to navigate through these challenging times.·      Since you’ve heard that the DOJ has been asking questions, it’s more than likely their case against you is mostly complete and has a 98% Conviction Rate.·      Hiring a legal team doesn’t just mean they have experience; they also need a proven track record of successfully defending cases like yours.·      The choices you make today - will make a better tomorrow.

FYI: Judges prefer to speak with treating physicians rather than just your experts during the sentencing hearing.1.  The defendant is exceptionally bright, successful, and highly functioning.2.  Highly skilled and motivated, they work long hours for acceptance (to feel better about themselves - and not be considered a failure), money, and privileges.·      Was there a traumatic backstory that you uncovered through their history and Personal Narrative?3.  Is the defendant an obsessive-compulsive perfectionist?4.  Do they suffer from depression and anxiety?5.  What is their overwhelming desire to be personally and financially successful?6.  The result could be a generally law-abiding person to engage in inappropriate or illegal behavior.7.  With a proactive medical consultation, a diagnosis of bipolar disorder can be crucial before the presentence interview.8.  According to the most recent statistics from the U.S. Sentencing Commission, a mere 6% of inmates were granted downward departures for diminished capacity (U.S.S.G. §5K2.13), despite half of the inmates displaying symptoms of mental health issues. This raises crucial questions about the sensitivity of judges to mental health concerns.9.  On the other hand, the root of the problem could be the defense counsel, who might not be investing sufficient time in fully exploring their client's social and psychological history.  -Tess Lopez, Probation Officer.

  • THE IMPORTANCE OF UNDERSTANDING YOUR JUDGE'S PREFERENCES - BEFORE YOU MEET
The Importance of Understanding Your Judge’s Nuances - Before You Meet.  The information in this series and on PPRSUS.com (and PPRSUS Resources) is readily accessible and completely Free to all. Should you wish to engage my services, my contact information is at the end.                                            INDICTED AND FACING PRISON: NOW WHAT. My name is Marc Blatstein. In 2006, I, too, was Indicted and convicted of a felony and lost my medical license. To call this a life-altering event, at best, was an understatement, as medicine and surgery were all I knew. With work, I got my license reinstated, and for that, I was grateful.·      The Lesson: Prison is Temporary.
My goal in this series is to provide you with the information you’ll need to survive and navigate these times. Knowledge and Preparation will help build back the Confidence you’ll need throughout this process.·      Since you’ve heard that the DOJ and Feds have been asking questions, their case against you is mostly complete, with a 98% Conviction Rate.·      Delay acting now is at your peril.·      Hiring a legal team doesn’t just mean they have experience; they also need a proven track record of successfully defending cases like yours.·      The choices you make today - will help you tomorrow.
Whether you're facing a plea or a trial, you need all the help you can get to navigate the intricate nuances of Your Judge's court.·      That's where a Federal Defender’s assistance comes in, should you not be intimately familiar with your judge’s likes and dislikes. They can offer invaluable guidance that increases your chances of success.·      Another crucial aspect to consider is the judge's preferences, which can make or break your case.·      Again, a federal defender can help you understand whether this judge reads sentencing memos (how long is too long?) and character letters (is there a current amount that isn’t too much?) and whether they will allow the person writing the letter also to speak.·      What do they think of a Video or printed Narrative (or both)·      Knowing this specific information regarding the judge's likes and dislikes can also be a game-changer.
However, that's not all.·      External factors like BOP overcrowding or staff shortages can also affect the availability of necessary programs and medical services that can impact your client's future.·      That's why learning your judges’ feelings on these issues is crucial. As I am writing this, I have a client who surrendered to a Satellite Camp where the BOP stated there was RDAP, only for the person to learn that the RDAP program had been closed due to a lack of staff.·      By taking the time to understand the judge's preferences and external factors that may affect the case, you can position yourself for success and achieve the best possible outcome.·      A local Federal Defender is an excellent resource for you and your team to learn your judge's preferences.
