It was purposefully designed, as a method to avoid the problems with 4th amendment protections. However, the modern application of the FISA justification has no lawful basis.
•  Beginning in/around 2012, after the Dept of Justice National Security Division was created by President Barack Obama and Attorney General Eric Holder, the use of FISA warrants were extended to include electronic searches of captured information held within the National Security Agency (NSA). This was the database into which former NSA employee Edward Snowden was creating the search engine software.
• The capturing of information was relatively new; technology was still being developed. Rapid scale-ups of archives and data processing was underway. Various iterations of the search tools and processes were being tested and deployed.
• Prior to 2010/2012 we were mostly talking about emails, phone calls and text messages. However, as more and more technology was deployed, the interfaces expanded. Today, almost every electronic interface is captured/stored within either the NSA database, or a private sector database with connections to the NSA search portals.
• The important part to understand is all of the data collected is searchable. Then you move on to ‘how’ can the data be searched.
• The ‘how’ is where FISA comes into the picture as the justifiable mechanism that permits the federal government to search the database.
• The existence of the database is no longer argued. The govt has now moved beyond justifying the existence of the stored data, and now the only point of contention is ‘how’ and ‘when’ the government may exploit it.
• This is where the DOJ-NSD, FBI, U.S. Intelligence Community, Congress and even the Judicial Branch claim the FISA laws protect the unlawful exploitation of the search capability. However, did you know there is not a single example of a FISA search application to the FISA Court that has ever passed Inspector General review.
• Prior to President Trump’s authorization of the OIG in 2017, no one was ever permitted to review, check or audit the government submissions to the FISA Court. From the moment the DOJ National Security Division was created to permit the enhanced search review, not a single oversight mechanism was ever in place.

• As soon as President Trump permitted the Office of Inspector General to start looking at filled out FISA applications, and justified FISA search documents created by users who were searching through the database, what they discovered was a non-existent accountability system.

When it flirted with activation in 2023, Claudia Sahm herself urged caution because of pandemic era distortions, but she also stressed that if it flipped cleanly, it meant the labor market was weaker than the glossy headlines implied. Fast forward, and the revisions now show that’s exactly what happened. In August 2024, BLS benchmark adjustments erased 818,000 jobs.

By February 2025, another 589,000 were gone. And just recently, Treasury Secretary Scott Bessent flagged that another 800,000 could be stripped out. Add to that the steady drip of downward revisions through 2025, June flipping from a modest gain to a net job loss and the labor market has been overstated by somewhere between 2.3 and 2.4 million jobs since April 2023. Like i said in my previous post that kind of wholesale rewrite hasn’t happened since 2009, when the BLS had to admit it had massively overstated payrolls heading into the financial crisis. And history shows that these benchmark adjustments aren’t just statistical clean up.

They almost always surface at turning points, the stagflationary recession of the mid 1970s, the double dip downturn in the early 1980s, and the collapse of 2007-09. They’re usually evidence that the economy was already much weaker beneath the surface, and the headline strength was more illusion than fact. Which brings us back to the Sahm Rule. On the charts today, the indicator looks muted, sitting well below the 0.5 threshold. But that’s because the unemployment rate itself has been calculated off job counts that are now being revised down. If those missing millions of jobs had been reflected at the time, the unemployment rate would have been higher, the Sahm Rule would have ticked up, and the U.S. might already be shown as having tripped into recession

In other words, the Sahm Rule didn’t miss, the inputs did. Once the revisions are fully baked in, history may show it was flashing red in 2023 while policymakers insisted on labor resilience. That’s what makes this so consequential. For two years, the Fed leaned on the strong jobs market as its justification for keeping rates higher for longer. But if those jobs never really existed, then the Fed was tightening into fragility. That turns its high for longer stance into a policy error built on faulty data. Which is why the September 17, 2025 cut is unlikely to be a one off. As these revisions settle and the depth of labor weakness becomes impossible to deny, the Fed won’t just be trimming for optics. It will be forced into a broader pivot in 2026 acknowledging, belatedly, that the Sahm Rule was right all along.

Three, if in fact, these numbers are true, it shows that President Trump was right about the Federal Reserve. They are too late. And because of the bad numbers, they likely would have been cutting in June, (if) we believe the numbers.

And four, I can tell you that the one thing this administration is not going to do, and we are not going to let the Democrat media surrogates do, is, during President Biden, (Vice) President Harris's campaign, they told the American people it's a vibe session. You don't understand how good you have it. President Trump was elected for change. And we are going to push through with the economic policies that are going to set the economy right, I believe, by the fourth quarter. We are going to see a substantial acceleration.

Trump Tariffs Go From Terrifying To Indispensable To Prevent A Bond Market CrashÂ

•  Financial Times  Trump’s tariffs are now a key factor keeping Treasury investors on board (the same tariffs that were widely blamed for the relentless selling back in April). According to the paper, the tariff revenues – which so many of the establishment economists never even considered in April – are now seen as a crucial income stream that offsets the costs of the Big Beautiful Bill, and  investors are now counting on hundreds of billions of dollars raised by the remaining tariffs to offset Trump’s tax cuts and keep a lid on US borrowing.

• Ngo also noted that it is not unusual for people involved in a criminal investigation to obtain legal counsel. It is a matter of protection. But this has not stopped people from accusing Mary Grace Westman of the worst of mothering and evil equal to her child's act.
• However, Ngo strives to demonstrate that there appeared to be a "values misalignment" between Mary Grace and James Allen. Mary Grace was a traditionalist and a devout Catholic. James Allen Westman was neither conservative nor religious. These divided ideals and moral focus may have been what led to their divorce in 2013, when Robert Westman was only 10. A divorce, as mentioned by Ngo's source above, which was fraught with difficulty. Mary Grace Westman worked at Annunciation Catholic Church as parish secretary for five years before she retired, and received glowing praise from her superiors at the church.

The deployment also involved regular U.S. Marines under the same authority, but a federal judge ruled on September 2, 2025, that the use of these forces for domestic law enforcement activities violated the Posse Comitatus Act (18 U.S.C. § 1385).

Notably, the Insurrection Act was not used for this action.

The 9th Circuit Court of Appeals found the Posse Comitatus Act claim premature in its June 19, 2025, ruling because, at the temporary restraining order (TRO) stage, the plaintiffs had conceded that using federal forces solely to protect federal personnel and property would not violate the Act. Additionally, the plaintiffs presented no evidence that the National Guard members were engaged in any other activities, such as participating in arrests or other law enforcement functions prohibited under the Act (18 U.S.C. § 1385). The court noted that the plaintiffs did not yet contend that Guard members had in fact participated in any such violations, but they could pursue the claim later with additional evidence, such as at the preliminary injunction hearing.
