The jury in the Lindsay Clancy trial is back at it, beginning their 4th day of deliberations. As of this morning, the jury has already deliberated for 17 hours, which makes this verdict watch one of the longest in recent high profile murder trials. We go over what the judge’s options are if the jury says they’re deadlocked. While the state of Massachusetts does not allow an Allen charge, they do have another type of charge, called the Tuey-Rodriguez instruction. It’s certainly controversial and considered a last ditch effort to encourage jurors into a compromise.

One week shy of the 30th anniversary of the shooting death of Tupac Shakur, 63-year-old Duane Davis was found guilty of murdering the rap icon on the Vegas Strip. It only took the jury three hours to convict Davis, after two weeks of testimony and nearly 30 witnesses. The prosecution effectively used Davis’ own words, both written and spoken to convince the jury of 12 that he was the mastermind behind the killing. In fact, we didn’t hear a peep from the jury of 9 women and 3 men all day: no questions, no requests for evidence, nothing. Day four of deliberations will begin promptly at 9am tomorrow, making this verdict watch already longer than some of the most recent and high profile murder cases in the country.

As we continue to await official word from the Lindsay Clancy jury, conspiracy theorists online are creating their own headlines. At issue, two jurors reportedly walked into court today wearing pink, and folks online are claiming that means those jurors are signaling their support for the Massachusetts mom, after hundreds of women showed up in pink outside the courthouse last week in defense of Lindsay Clancy and women’s mental health issues. The chatter online has grown so loud, that some people are demanding a mistrial.

More than two dozen countries around the world have special laws to prevent a new mother from being convicted of murder if she kills her own child within 12 months of giving birth. That means a jury would not be considering first or second degree murder charges against Lindsay Clancy if the same exact scenario happened in most other western, industrialized countries. It all dates back to the “Infanticide Act of 1938” which allows for manslaughter charges to be brought against a mother who kills her child under a year old because “the balance of her mind was disturbed by reason of her not having fully recovered from the effect of gibing birth to the child.”

The jurors in the Lindsay Clancy trial will begin day three of deliberations as they weigh competing medical diagnoses, along with any of their own personal experiences with parenting, motherhood and mental illness. Legal experts say it’s likely an emotional and overwhelming task for jurors, as they determine whether or not mental illness prevented the Massachusetts mom from knowing right from wrong as she strangled her three young children. Meantime, there was an interesting development outside of the courtroom: Dr. Avram Mack resigned from his position at a Delaware children’s hospital immediately after wrapping up his highly contentious testimony where he said Clancy was not suffering from postpartum psychosis.
