  • Deep Dive | Episode 7 | Once again, Sheinbaum resorts to the ridiculous mexican Hispanophobia

In the midst of postmodernity, economic globalization, cultural, religious, and even political plurality, Claudia Sheinbaum once again appeals to the anachronistic Hispanophobia that we Mexicans are incapable of overcoming.

She used a video that "demonstrates" that other countries are “nice” because they apologize... That's the level...

It's strange that she resorts to this kind of immature tricks, being a scientist and constantly proclaiming herself as a leader of the avant-garde and in tune with the times, but no. Instead of adopting a position of integration, of brotherhood among peoples, and fostering greater interdependence and interaction between nations, she does not. Once again, she turns to childhood traumas as a way of engaging in banana republic politics.

Hispanophobia is natural among Mexicans, and it's not rooted by chance. It's no coincidence that two emperors were executed. Agustín de Iturbide was shot in 1824, and Maximilian in 1867.

This Hispanophobic sentiment has been reinforced by school textbooks. The Mexican History book for 5th grade, whose first version was published in 1962, was already highly critical of Spain’s colonial rule over Mexico, and the more recent editions have not changed the tone.

The seed of hatred towards Spaniards dates back much further.

When Mexico had just gained independence from Spain, there was always the fear that the "motherland" would attempt a reconquest. And these fears were confirmed not once, but twice.

It was well-known that King Ferdinand VII had every intention of reclaiming Mexico for his monarchy, and perhaps he did not succeed thanks to José Bonaparte, Napoleon’s brother, standing in his way. But the truth is that there was an expedition financed by the King to reconquer Mexico, led by Brigadier Isidro Barradas. He departed from Cuba and arrived on the coasts of Tamaulipas with three thousand Spanish soldiers, who were defeated by Antonio López de Santa Anna. Santa Anna, in turn, used this incident as propaganda to establish himself as the savior of Mexico, who had prevented the country from becoming a colony again.

Ironically, it was Antonio López de Santa Anna, the very same fool who ended up losing more than half of Mexican territory, so this 'heroic feat' is not remembered. However, after that incident, Hispanophobia became fully embedded in the Mexican DNA.

Curiously, it was Porfirio Díaz who refined Mexican Hispanophobia, thanks to his obsessive Europeanization as a synonym of national development—something that the writers of history later used against him.

Great thinkers like Octavio Paz and Samuel Ramos pointed out with precise accuracy the absurdity of Mexico’s rejection of its Hispanic father and the dogmatic embrace of its Indigenous mother. The intellectual circles that favored the Revolution defined Hispanophobia as something revolutionary and new, and Hispanism as reactionary and conservative. They disguised the Indigenous roots as emancipation and decolonization, attributing to it a non-existent cultural and historical maturity, and identified the right-wing perspective as a shameless group of defenders of Spain’s efforts to civilize the Americas.

All this serves to illustrate the ridiculousness we face today: we are in conflict with our second-largest trading partner over a few paragraphs in a 5th-grade textbook.

This is the 'caliber' of our Presidency, which continues to insist on a stupid and anachronistic demand: an apology from a country that no longer exists to another country that no longer exists.

Like it or not, we are the children of miscegenation, we are entirely different citizens. But still, we remain victims of an absurd narrative exploited politically to keep the "chairiza," the "solovinos," and the addicts of the 4T entertained in an endless and boring episode of *Siempre en Domingo*.

  • Deep Dive from @elreportero | Episode 6 | Emasculated opposition; PAN, PRI, and MC opt to play dead and betray Mexicans

In Mexico, there is no longer an opposition. It's over. It's dissolved. It's lost.

And nothing benefits Morena more than having a cartoon-like opposition. An emasculated opposition.

This is what has happened with the PAN, with the PRI, and to a certain extent, with Movimiento Ciudadano.

'Alito' Moreno, with the consent of the Electoral Tribunal to remain as leader of the remnants of the PRI, owes Morena a huge favor. Needless to say, he no longer even counts as a reference.

The National Action Party (PAN), in about a month, will be saying goodbye to its failed leader, Marko Cortés, who has done nothing but push this opposition party into a spiral of decline, leaving behind his puppet, Jorge Romero, to continue the legacy of debacles and stupid occurrences.

The case of Movimiento Ciudadano has its own story. Samuel García only reaps setbacks and scandals, Jorge Álvarez Máynez maintains his streak of stubbornness, nonsense, stupidity, idiocy, trivialities, and foolishness for the enjoyment of memes, and practically leaves behind a lone figure who has yet to make any significant mark, which is Pablo Lemus, who is just beginning his term as governor of Jalisco, so it’s still too early to tell if he will become an important or interesting opposition figure. The MC benches in the Chamber of Deputies, and particularly in the Senate, have opted to keep their heads down after the embarrassment that followed the revelation that Samuelito funded Luis Donaldo Colosio Riojas's campaign with public money.

In this way, the PAN, PRI, and MC have become a group of pets that Morena looks at with disdain, tolerating them as company but keeping their leash tight.

It suits Morena to have a cartoonish opposition to legitimize its overwhelming margin of action, as it serves to "legitimize" the appearance of democracy in the eyes of the international community, while in reality, it functions like a Chihuahua dog that makes a lot of noise but serves to disguise Morena as a 'friendly animal lover.'

It suits Morena to have a soft opposition, as it acts as a perfect deterrent for any dissenters. Who in their right mind would dare to threaten to switch to the opposition benches when they are nothing more than rotten plankton in the ocean of stupidity?

Having such a servile, crawling, bootlicking, fawning, cowardly, and submissive opposition demands keeping them happy. Through perks, benefits, and crumbs, Morena positions Bucareli (Interior Ministry) as the source of VIP kibble for the submissive ones until the next elections, calmly knowing they will continue losing 50% of their positions with each cycle.

This opposition is already a corpse rotting in the sun. However, there are still a handful of brave citizens who boldly point fingers at the abuses of power. There are journalists who face censorship from their own newsrooms and draw attention to the abuses, injustices, violations, excesses, overreach, illegality, arbitrariness, and despotism of Morena.

While this happens, what we predicted in this column a few months ago has come true: PAN, PRI, and Movimiento Ciudadano have betrayed their voters with laziness, inaction, and a shameful bowing down to power. They have shown no qualms in betraying the Mexican people.

  • Deep Dive from @elreportero | Episode 5 | What would happen if the Mexican Supreme Court rejects the Judicial Reform?

And what if a suspension is granted that freezes the implementation of the judicial reform while the Supreme Court resolves the controversy?

This is a bit of a futurology exercise I did with lawyers and legal experts.

First of all, let’s start with a solid fact: with the reform, the justices of the Supreme Court of Justice of the Nation (SCJN) will be out of a job next year. They are guaranteed to be unemployed the following year.

So, under this principle and premise, there’s a possibility that they might have the guts and courage to declare the suspension of the judicial reform's implementation. After all, what do they have to lose if everything is already lost?

If this happens, then the National Electoral Institute (INE) would not be able to proceed with organizing the judicial elections for next year.

If this happens, given the positions we’ve seen entrenched between the three branches of government, we might think that the Executive and Legislative branches could reject this ruling and pressure the National Electoral Institute to proceed with the electoral process despite the Supreme Court’s rejection.

We would then be openly immersed in a constitutional crisis, and it raises the question: to which branch will the INE answer? The Executive, the Legislative, or the Judicial branch in order to make the elections legal or not?

At this moment, the Executive and Legislative branches have more real power than the Judicial branch because they have social legitimacy and control the state's coercive institutions.

This could happen because there are deficiencies in how the reform was approved, and also due to substantive issues, which, by the way, even Ricardo Monreal acknowledged yesterday, stating that it contains flaws and drafting problems.

So, the justices currently sitting in the Supreme Court would have to order the maintenance of the status quo, which would mean keeping the judges and, of course, the justices in their positions.

What would happen in that case?

Technically, the Executive would be empowered to send the police to remove them from office.

Yes, you heard right. The police would have to go arrest the judges and justices, especially the justices.

If the Executive decided to go to the extreme of sending the police to remove the justices from office, what would they do? In a surge of constitutional zeal, the justices might go so far as to chain themselves to their desks to avoid being removed by the police.

The mere thought of such an extreme scenario is frightening. A resistance by members of the Federal Judiciary, besides being a very radical confrontation, would carry significant political costs, especially on the international stage, against the administration of Claudia Sheinbaum, who has always claimed to believe in democracy, but in reality, her actions show the opposite.

I insist, of course, that this is an extreme scenario, but as I said at the beginning, what do the justices have to lose if they’re going to be out of a job next year anyway if the judicial reform stays as it is? They have every incentive to sacrifice themselves in a public spectacle and immolate themselves in the eyes of not just Mexicans but also international scrutiny.

Such a dramatic scenario would be a loss for Morena and Claudia Sheinbaum.

The constitutional lawyer I conducted this futurology exercise with emphasized that this would be an unthinkable extreme. But if Mexican history teaches us anything, it’s that the impossible happens with bizarre ease.

If something of this magnitude were to happen, the ousted justices would go down in history — for some — as heroes, but the true villains of this story would be the Morena party members, with Claudia Sheinbaum Pardo at the helm as the executioner of Mexican democracy.

  • Deep Dive from @elreportero | Episode 4 | Morena is right: is a coup d'état

What Mexico was missing: a constitutional crisis following a coup d'état.

I agree with the members of Morena; they are right when they say there was a coup d'état—but it was perpetrated by them!

The coup began with the hijacking of the National Electoral Institute (INE). Despite all legal and illegal measures, the leadership of the INE, through trickery and schemes, fell into the hands of Morena.

Next came the Electoral Tribunal, with the plot openly and brazenly acknowledged by López Obrador himself when he refused to appoint the two missing ministers "to avoid the appointment of conservative ministers." Those three were the ones who carried out the coup against Magistrate Reyes Mondragón, handing the presidency of the Electoral Tribunal to a loyalist of Morena, Mónica Soto Fragoso.

After that, it was easy to seize the Chamber of Deputies, magically turning 54% into 74%.

In the Senate, things were even simpler, as Morena only had to dig into the muck to find the most foul-smelling figures in the form of the Yunes to secure the votes, even kidnapping an elderly man to twist the arm of another senator from Movimiento Ciudadano.

And so, the judicial reform passed quietly, riddled with vices and drafting errors, and was already published in the Official Gazette, flagrantly violating the separation of powers by attempting to turn the Judiciary into an appendage of the Executive.

This forces the Supreme Court of Justice to review the many comments and criticisms raised regarding the constitutional interpretation of the reform, even though it has already been published in the Official Gazette. No matter what the sycophants say, no matter how much the loyalists bark, no matter what the hardcore supporters shout and spit, it doesn't matter. At this moment, the Supreme Court of Justice is not beholden to what is written in the judicial reform. It is its duty to review the constitutional amendments, even to approve them, but only if they do not violate principles that are above everything else: human rights and civil rights.

What would happen if the Supreme Court finds that the constitutional amendment does indeed violate the principles of access and balance for citizens to obtain swift justice? It would demand the process to be corrected, and then Morena, starting with the president, would reject the Supreme Court of Justice: a lovely constitutional crisis.

The mere mention of this makes Mexicans—and particularly the markets—tremble in fear.

And there is something the coup carried out by Morena didn’t foresee: the time between publication and implementation.

Eight months is a long time for many things to happen.

Because the constitutional amendment to the Judiciary violates the fundamental right to impartial justice for the governed. International treaties signed by Mexico instruct that our country must be a nation of laws with an independent judicial system.

Morena will always have its orangutans ready to make fools of themselves as often as they are told, such as Ms. 'learning curve,' Lenia Batres Guadarrama, who shamelessly was one of the first to bark 'coup d'état,' an utterly ridiculous outburst.

But looking at it without passion, Batres Guadarrama is right: it is a coup d'état—but perpetrated by Morena—a constitutional crisis courtesy of the Morena party.

    9 min

  • Deep Dive from @elreportero | Episode 3 | Slamming the Table: Claudia Sheinbaum Asserts that the SCJN Cannot Review Constitutional Changes

The first firm stance by Claudia Sheinbaum on the Supreme Court of Justice of the Nation's (SCJN) proposed review of the Judicial Reform. Citing Articles 39 and 135 of the Political Constitution of the United Mexican States, the President stated to the Supreme Court that it is not authorized to review constitutional changes, that it cannot examine or alter them.

In a very concise and self-serving explanation, of course, Claudia Sheinbaum outlined the reasons why she believes the Supreme Court of Justice cannot and should not review constitutional changes.

Naturally, this also begins to reveal how her presidency might play out when confronted with issues she doesn't like or that are inconvenient for her.

Her morning argument was that the Supreme Court of Justice cannot review something already enshrined in the Constitution and even published in the official gazette. "They can't review what I told the people was in their best interest, what we, as members or part of the wise and good people, informed our social base was beneficial for them. They cannot review what we have instructed the people to consider good for them."

Claudia Sheinbaum is now starting to show glimpses of how she will wield power.

It's quite ironic that just ten years ago, the Morena party demanded a constitutional review in light of constitutional changes pushed by Enrique Peña Nieto's administration. Back then, they argued that the Supreme Court did indeed have jurisdiction.

But because the modification now comes from them, it seems the same reasoning no longer applies.

For now, there's an open and direct confrontation, citing the very Constitution itself.

The Supreme Court of Justice took too long to carry out this review, which is why Sheinbaum is not entirely without reason.

The SCJN will also likely delay responding to this bold move by Sheinbaum, allowing supporters of the Fourth Transformation (4T) to flood the discourse with references to Articles 39 and 135 of the Constitution to validate the constitutional change and the profound modification of Mexico's judicial system.

References to the "will of the people" were also made in Germany in 1939. Similarly, they used the people's will to justify outrages and, later, truly horrible things.

Today in Mexico, the force of social voting is being used to push through a reform that could eventually work against the very people they claim to love so much.

It is typical of autocrats to invoke the will of the people to do whatever they please.
