  • Can My HOA Fine Me for Leaving My Trash Cans Out Too Long?

Your HOA says you left your trash cans out too long and hits you with a fine. Is that legal? In this HOA Q&A, attorney Michael Kushner explains when trash can rules are enforceable and where boards often go too far.

🎯 What You’ll Learn in This HOA Q&A:

✅ That HOAs are allowed to adopt rules about trash can timing.

✅ Rules must meet the requirements of Civil Code § 4350.

✅ Why next-morning deadlines are likely valid, but 7:00 p.m. deadlines may not be.

Michael breaks down how reasonableness and consistency define whether your HOA can fine you for something as routine as taking the trash out.

In this episode of HOA Hell, attorney Michael Kushner tackles real-life mental health scenarios in California HOAs and explains how disability protections intersect with nuisance rules. You’ll hear how FHA and FEHA apply, where boards cross the line with harassment, public shaming, or refusing reasonable accommodations, and what practical accommodations and processes actually look like.

✅ How mental health conditions are treated as disabilities under FHA and FEHA, and why accommodations are required while health and safety remain paramount.

    ✅ Examples of reasonable accommodations.

✅ Where boards go wrong, from automatic “nuisance” labels to refusing the accommodation process and breaching confidentiality about a resident’s condition.

✅ How to request accommodation the right way.

These takeaways give homeowners a playbook for asserting rights, proposing reasonable solutions, and pressing boards to engage in the required interactive process without crossing into harassment or selective enforcement.

  • California HOAs and Crime: What Your Board is Required to Do

In this episode of HOA Hell, attorney Michael Kushner explains what California HOAs are actually required to do, and not required to do, about crime and safety within their communities.

🎯 What You’ll Learn in This Episode:

✅ HOAs are not private police and are not guarantors of anyone’s safety.

✅ HOA boards have a duty to exercise reasonable care regarding the common areas under their control by, for example, repairing safety features (e.g., lighting, gates, locks, cameras, or access systems).

✅ To the extent that an HOA’s governing documents include certain safety features/amenities like those listed above, HOA’s have a duty to repair/maintain such components if they stop working properly.

✅ HOAs are not obligated to install surveillance cameras or other safety features throughout the entire property unless their documents make them obligated. But HOAs might be required to install some new features, depending on budget constraints, that have never existed if it’s reasonably necessary to protect the health and safety of the members, residents, and visitors.

✅ Boards might also have a duty to notify the membership when safety features are not functioning, especially if there have been “incidents” related to the safety features’ absence.

In short, this episode establishes that an HOA’s responsibilities are to take reasonable measures to ensure the safety of the community and to strictly abide by its governing documents when it comes to the maintenance, repair, and replacement of safety/crime-related amenities.

  • California HOAs: What is a Fiduciary Duty?

In this episode of HOA Hell, attorney Michael Kushner breaks down what “fiduciary duty” actually means for California HOA boards and why it matters to your rights, your money, and your quality of life. You’ll hear plain-English examples of the two duties that make up the fiduciary duty in the HOA setting (i.e., the duty of care and the duty of loyalty), and you’ll learn how transparency defeats self-dealing, what confidentiality really requires, and the specific steps homeowners can take when they spot red flags.

🎯 What You’ll Learn in This Episode:

✅ What the term “fiduciary duty” consists of in the context of your HOA board, and why it’s a higher standard than ordinary “duties” you might owe to others.

✅ What the duty of care and duty of loyalty are.

✅ Practical red flags to watch for and how to investigate for potential breaches by your board.

✅ Why ongoing board inattention to maintenance, finances, and minutes constitute breaches of fiduciary duty.

Fiduciary duty touches many types of HOA disputes. By understanding what the duties of care and loyalty are, homeowners can identify breaches early and act before small problems become financial or safety crises.

✅ What an ADR demand means in the context of HOA disputes and the Davis-Stirling Act, and the risk of refusing to offer to participate in it.

  • AB 130 Capped HOA Fines at $100—But Don’t Celebrate Just Yet

California’s new law, AB 130, caps HOA fines at $100 per violation. On the surface, that sounds like a win for homeowners. But not so fast. AB 130 is actually a disaster of a law, and in this 1-Min Attorney tip, HOA attorney, Michael Kushner, explains why.

Rather than curbing HOA abuse, AB 130 is already fueling more ADR demands (the precursor to more lawsuits), more confusion, and more board misconduct. A lot of HOAs are going to go down one of two roads: (a) they’re either going to be confused about the ambiguity and vagueness of the law, and error on the side of doing nothing (i.e., not enforcing the governing documents), which hurts good HOA members; or (b) they’re going to wash their hands of fining as a means of enforcement (for fear of running afoul of the law because of uncertainty and then facing the prospect of paying a homeowner’s attorney’s fees), and instead will just initiate more ADR demands (and if necessary, more lawsuits).

🎯 What You’ll Learn in This 1-Minute Tip:

✅ The law’s vague language is already creating costly disputes.

✅ Homeowners are telling us: “I’ll just pay the fine as the cost of doing business.” That’s the opposite of deterrence.

This isn’t reform. It’s chaos. And homeowners (or so-called expert attorneys who should know better) who think AB 130 is a panacea against bad HOAs are in for a rude awakening.

📌 Read more in my articles on AB 130: https://mbkchapman.com/blog/california-hoa-fine-limits-ab-130/ and https://mbkchapman.com/blog/ab-130-financial-commitment-loophole/.

  • Selective Enforcement in California HOAs: How to Prove It and Fight Back

In this episode of HOA Hell, attorney Michael Kushner breaks down one of the most common homeowner complaints that his law firm (MBK CHAPMAN) hears from homeowners. Selective enforcement. If your HOA fines you while letting neighbors slide for the same thing, or if your HOA allows others to build things on their properties but denies you permission to build the same type of thing, then your HOA is engaging in selective enforcement, and that’s against the law. In this episode, Kushner explains how to recognize and deal with selective enforcement when it’s happening to you.

🎯 What You’ll Learn in This Episode:

✅ What “selective enforcement” means in plain English and how it shows up in day-to-day HOA life.

✅ Why selective enforcement is illegal in California HOAs under Civil Code § 4350.

✅ How to build proof with neighborhood comparisons, photos, and video, plus practical cautions about using drones and respecting the privacy rights of others.

✅ Using a Civil Code §5200 records demand to obtain minutes and committee notes to help you establish patterns.

✅ A case study showing how documented inconsistency led to a favorable outcome.

Selective enforcement is not only illegal, it’s enraging when it happens to you. But you don’t have to accept it. With the tips Kushner offers in this episode, you’ll be in a good position to fight back if your HOA tries to treat you differently than others.

  • California HOAs: Service Animals, Emotional Support Animals, and What Homeowners Must Know

In California HOAs, service animals and emotional support animals are not the same, and confusing them leads to conflict. In this episode, attorney Michael Kushner explains what your HOA can and can’t ask, when ADA does not apply, how FHA and California fair-housing rules come into play, and what real-world limits (leash/control, nuisance, waste) still apply. If your board is hassling you about your animal, this episode is for you.

    What You’ll Learn:

✅ The core difference between service animals and emotional support animals.

✅ The two questions an HOA may ask you when it comes to your service animals.

✅ What HOAs cannot demand from you when it comes to service animals.

✅ Why ADA generally does not govern HOAs.

✅ Legal risks associated with falsely claiming that your animal is a service animal.

✅ Practical steps you should take if your HOA violates your rights.

Both service animals and emotions support animals play critical roles to the people who depend on them, and the law is crystal clear regarding what HOAs can and can’t do. Don’t let your HOA violate your rights.

  • Can Your HOA Ban Yoga or Stretching in Your Front Yard? The Law on HOA Aesthetic Overreach

Believe it or not, some HOAs in California have started citing homeowners for doing yoga, stretching, or light exercise in their own front yards. They claim that such activities violate vague “community aesthetic” standards. But under California law, boards can’t enforce made-up rules or govern your private behavior based on personal preference.

In this 1-Minute Attorney Tip, HOA attorney Michael Kushner explains why HOA rules must comply with Civil Code § 4350, which requires that any operating rules be clear, objective, and reasonably applied. Boards cannot enforce vague aesthetic language, especially not against activities that are quiet, lawful, and harmless.

🎯 What You’ll Learn in This 1-Minute Tip:

✅ Why vague “aesthetic” rules aren’t a blank check for your HOA.

✅ When behavior like yoga or stretching is legally protected.

✅ What Civil Code § 4350 requires for HOA operating rules to be enforceable.

✅ How to challenge unfair citations and force your board to back down.

Boards don’t get to govern lifestyle or taste, and the law doesn’t let them make up rules as they go.
