HOAs across California are still trying to deny homeowners the right to build Accessory Dwelling Units (“ADUs”) even though Civil Code section 4751 says they can’t. In this episode of HOA HELL, attorney Michael Kushner breaks down what your rights really are under California law.
✅ What California law actually protects and what HOAs often get wrong.

✅ The specific steps to take when your ADU plans are blocked or delayed.
This episode is for California homeowners who are planning, or currently fighting, to build an ADU on their property. Don’t let your HOA intimidate you, delay you, or stop you from using your own property as the law permits.

In this episode of HOA HELL, attorney Michael Kushner exposes the often-overlooked role that management companies play in California HOAs and how that role can spiral into abuse, neglect, or outright misconduct if left unchecked.
Kushner walks listeners through exactly how management companies are hired, what their contracts say, and what they’re legally allowed, and not allowed, to do. He breaks down common red flags that signal mismanagement, and explains what tools homeowners can use to fight back even though the management company doesn’t report to them directly.
This episode arms homeowners with a powerful roadmap to spot missteps, request critical documents, organize fellow members, and demand board accountability. It also explains why you usually can’t sue the management company directly and why that doesn’t mean you’re powerless to stop the abuse.
🎯 What You’ll Learn in This Episode
✅ Why management companies aren’t supposed to run your HOA.
✅ What management contracts say, how they work, and how to get a copy.
✅ Red flags that your manager is crossing the line or neglecting their job.
✅ What duties can never be delegated, no matter what the board wants (even though they often are).
✅ How to push your board to fire, replace, or rebid a bad management company.
✅ Why you usually can’t sue the manager directly, but how to hold them accountable anyway.
If you're dealing with unresponsive managers, rising costs, or unexplained board decisions, this episode gives you the legal clarity and leverage that you need to take action.

Bad HOAs have a bad habit of removing trees from the common areas without warning, without a vote, and without any plan to replace them. But unless the trees in question pose a risk to people’s health and safety, that kind of unilateral action is likely a violation of California law.
In this 1-Minute Attorney Tip, HOA attorney Michael Kushner explains how boards are bound by the Davis-Stirling Act and the CC&Rs when it comes to common area landscaping. Mature trees that provide shade, privacy, or noise protection can’t just be cleared away (with no replacements planted) without obtaining the consent of the members.
🎯 What You’ll Learn in This 1-Minute Tip:
✅ Why your HOA can’t remove common area trees without proper process.
✅ How unauthorized removal may violate both the CC&Rs and Davis-Stirling Act.
✅ What qualifies as a legal “emergency” justification and what doesn’t.
✅ How homeowners can challenge the decision and demand restoration.
Mature trees are valuable assets and that provide a lot of value to HOA members, and HOA boards can’t unilaterally decide to destroy HOA assets without following the proper steps.

California’s new law capping HOA fines at $100 per violation is being celebrated by some as a win for homeowners. But in this episode of HOA HELL, attorney Michael Kushner breaks down why AB 130 is not the reform it appears to be, and why those so-called experts who support the law didn’t think through the consequences Kushner discusses. Based on his deep dive into the statute and its fallout, Kushner exposes how the law’s vague language, unintended consequences, and political underpinnings will actually create more chaos, more litigation, and more costs for homeowners across the state.
🔍 What You’ll Learn:
✅ What AB 130 actually changed in Civil Code § 5855 and what it left dangerously vague.
✅ Why the $100 fine cap could backfire, especially in cases of ongoing or repeat violations.
✅ How the law might actually lead to a spike in lawsuits and increased HOA dues for everyone.
✅ The hidden due process problem buried in the new “agreement” clause.
✅ Why this law had NOTHING to do with homeowner rights, and everything to do with the governor’s de-urbanization policy, state control, and political agenda.
✅ How one self-described “HOA thought leader” implied that he helped pass AB 130, but clearly failed to think through or address the myriad consequences that will flow from the new law.
If you live in a California HOA, this episode is a must-listen. The law may be new, but the consequences are already starting to hit.
