  • Can California HOAs Ban Trump, Pride & BLM Signs?

TO OUR HOA HELL PODCAST LISTENERS:

We recorded this episode of HOA HELL two weeks before the tragic and horrifying events of September 10, 2025, in which Charlie Kirk was murdered. We are deeply saddened and outraged by this cowardly act of violence.

At HOA HELL, we hold firmly to the principle that free speech is one of the most fundamental cornerstones of our nation. Whatever one’s political, social, or cultural views may be, every person has the right to their opinions and to express them in the public forum without fear of harm to themselves or their property.

We share this message in the spirit of reaffirming that principle, especially during this time of grief and reflection.

That being said, here’s what you’ll learn from today’s episode of HOA HELL:

✅ The difference between commercial and non-commercial speech in HOAs, and why it matters.

✅ Where signs may be displayed on your property and exclusive-use common area, and when HOAs may prohibit items on common area.

✅ The size limitations of your flags, banners, and signs, beyond which the HOA may regulate.

✅ What HOAs may regulate within the size limitations protected by statute.

✅ How some boards try to use Penal Code § 11411 to get around your free speech rights.

If your display is non-commercial, within statutory size/material limits, and on your property or exclusive-use area, your HOA’s power to restrict is very narrow. Strong reactions from neighbors, even in the face of threats of violence, are not a legal basis for the board to order removal of otherwise protected speech.

  • California HOA Enforcement, ADUs & Elections: 5 Disputes to Watch in 2026

Top 5 HOA battles are coming for California homeowners in 2026. In this episode of HOA HELL, attorney Michael Kushner breaks down the disputes that will define HOA life in 2026, from AB 130 enforcement to insurance shocks, aging infrastructure, ADUs, and the rise of recalls. If you live in an HOA, now is the time to get informed and prepare.

🎯 What You’ll Learn in This Episode:

✅ Why AB 130’s $100 fine cap is already fueling confusion, fine stacking debates, and more lawsuits.

✅ How soaring insurance premiums and shrinking coverage create compliance problems with CC&Rs and hidden gaps homeowners only catch by reviewing their HOA’s policies.

✅ Why aging infrastructure and weak reserves are driving massive special assessments, and how annual assessment limits interact with special assessment mechanics under the Davis-Stirling Act.

✅ What California’s ADU push means inside HOAs, including limits on aesthetic control, fees that target ADUs, attempts to expand setbacks beyond city requirements, and other creative ways that HOAs try to interfere with homeowners’ ADU rights.

✅ Why HOA recalls will spike in 2026, including a predicted 30% increase, as boards mishandle enforcement, insurance, and maintenance while owners get more organized.

California’s HOA landscape is heading into a turbulent year. Laws like AB 130 are creating costly uncertainty, insurance markets are collapsing, and infrastructure demands are piling up. For homeowners, the battles of 2026 will decide whether communities hold their boards accountable or sink deeper into financial and legal chaos.

  • HOA Member and Tenant Rights: What California Law Says

In this episode of HOA HELL, attorney Michael Kushner breaks down the critical differences between the rights of HOA members and tenants who reside in the community. From elections and board participation, to the use of amenities, the discussion highlights what tenants can and cannot do in HOA communities, and where the ultimate responsibility always falls (on the property owner/member).

🎯 What You’ll Learn in This Episode:

✅ How HOAs can ban short-term rentals and why grandfathering rules matter.

✅ The key rights that tenants do not have, including voting, board participation, recalls, and demanding documents under Civil Code § 5200.

✅ What tenants can do, including using common area amenities such as pools, gyms, and clubhouses.

✅ How owners can be disciplined for tenant behavior.

✅ How courts view the financial and vested interests of tenants versus owners, and why that impacts HOA disputes.

Tenants and members may share space in HOA communities, but their rights and responsibilities are far from equal. This episode explains exactly where those lines are drawn and why owners must understand the risks that come with renting out their property.

  • Your HOA Can Regulate Your Remodel, But the Rules Must Be Reasonable

Most California HOAs have the power to regulate how you remodel, landscape, or modify your property. But under Civil Code § 4765, that power has strict limits.

Your HOA can’t deny your application based on vague aesthetics, personal preferences, or unwritten standards. Their rules must be published in the governing documents, and their decisions must be reasonable, consistent, and backed by clear written explanations. That includes citing the specific governing document-based provision that supports any denial by the HOA.

✅ Architectural standards must be reasonable. They cannot be arbitrary or inconsistent.

✅ All denials must be in writing and reference provisions of the governing documents supporting a denial of your plans.

✅ Boards cannot move the goalposts or make up rules as they go.

If your board is dragging its feet, applying double standards, or refusing to explain the basis of its denial of your plans, they’re not just being difficult, they’re violating California law.

  • California AB 130 Update: Predictions Come True as HOA Chaos Unfolds

In this follow-up episode of HOA HELL, attorney Michael Kushner revisits AB 130 just weeks after it went into effect, and confirms that the fallout is happening exactly as he predicted. From client consultations to opposing counsel discussions to upcoming press coverage, the consensus is clear: AB 130 is already creating confusion, lawsuits, and unintended consequences.

🎯 What You’ll Learn in This Episode:

✅ Why AB 130’s capping of HOA fines at $100 is already creating havoc.

✅ How ambiguities in the law are fueling confusion among homeowners, HOAs, and even reporters.

✅ Real client examples showing how the $100 fine cap is encouraging risky behavior.

✅ Why HOAs are now (or will soon be) either doing nothing or turning to costly lawsuits instead of fines.

✅ How insurance coverage plays into enforcement actions and special assessments.

✅ The growing divide between competent attorneys and those touting AB 130 as a “gift” to homeowners.

✅ Why both bad HOAs and bad HOA members are the only real winners under this law.

✅ How good HOAs and good attorneys are being forced into no-win situations.

✅ Why the legislature may need to revisit AB 130 to plug the holes before the damage escalates further.

AB 130 was purportedly passed to rein in excessive fines. Instead, it is already destabilizing California HOAs, leaving homeowners with more uncertainty and bigger risks than before.
