October is National Domestic Violence Awareness and Prevention Month.

On today’s show, we’ll be in conversation with Tracy McCarter, a nurse and grandmother who was jailed after her husband died of a stab wound that was inflicted while Tracy was defending herself from a violent attack. Her story is chronicled in a new book called Radical Acts of Justice: How Ordinary People Are Dismantling Incarceration. That book is by our second guest, Jocelyn Simonson, a Professor of Law at Brooklyn Law School. She writes and teaches about criminal law, criminal procedure, evidence, and social change. Her scholarship explores ways in which the public participates in the criminal process and in the institutions of local governance that control policing and punishment. In particular, she studies bottom-up interventions in the criminal legal system, such as bail funds, copwatching, courtwatching, and participatory defense, asking how these real-life interventions should inform our conceptions of the design of institutions in the criminal legal system, the discourse of constitutional rights, and the meaning of democratic justice.

Early on Saturday Morning, Hamas led a militant raid on Israeli settlements around the outskirts of the Gaza Strip, flying over border fences In paraglides, bulldozing Israeli border fences, and assaulting Israeli colonial settlements just outside the fiercely controlled Gaza Strip. In the days since, Israel has declared war on gaza, has killed many Palestinians, has leveled buildings in Gaza, and has called on its military reserves to prepare for a ground war. Meanwhile, Palestinian liberation fighters have continued to fight back, breaking through more border fences, taking control over land and apparently trying to build a land bridge between the Gaza strip and the west bank. This is a new chapter in a many decades-long struggle for land.

Continuing our conversation about the renewed war for land in Palestine, we bring the conversation home to the Bay Area, in conversation with Suzanne Ali, from the local chapter of the Palestinian Youth Movement, a transnational, independent, grassroots movement of young Palestinians dedicated to the liberation of our homeland and people; along with Lara Kiswani, the Executive Director of the Arab Resource and Organizing Center, which organizes for racial and economic justice and the dignity and liberation of our Arab, and Muslim communities here in the Bay Area. She is also Palestinian.

When juvenile courts were first created more than 100 years ago, they were imagined as a therapeutic space where specially-trained public servants and a friendly, caring judge would help children and families. Our guest today illustrates how that vision never came to pass, and how the procedures and policies of family court are based in a heritage of racism and a disdain for poverty. We are joined by Jane Spinak, the Edward Ross Aranow Clinical Professor of Law at Columbia Law School, where she was the founding board chair of the Center for Family Representation. Her latest book is titled, The End of Family Court.
