This evening on Legal Matters we discuss the issue of Remedies for non-Promotion and Demotion within the workplace. Many arguments arise in the workplace regarding promotion to an existing post, perhaps upon retirement or resignation of the existing office holder, or even to a newly created post. Most employees are of the opinion that because they are already employed by the employer, or because they are already employed in that particular department or have a number of years’ experience in the post, that they are entitled to be promoted, or that they have an entitlement to receive preference above any other applicants. Questions is that perception, correct? Does the employer have a right to employ someone from outside for that post? Why don’t they consider people from within? To answer these questions and some of your questions we’re joined by Ms. Zanele Chauke, Director in the Employment and Labour law dept at Molatudi Attorneys based here in Sandton.
