Thirty years ago, the Supreme Court issued a decision that held that the First Amendment does not protect people from skirting laws because of their religious beliefs. That case was brought by an Oregon man, Al Smith, who had been denied unemployment benefits when he was fired for ingesting peyote at a religious ceremony. But in recent years, the court has been chipping away at the precedent set in that case.
