On Legal Matters, we talk to Osborne Molatudi, Founder of Molatudi Attorneys and Employment & Labour Law Expert, about a recent ruling by the Johannesburg High Court that ssections of the Basic Conditions of Employment Act (BCEA) and the Unemployment Insurance Fund (UIF) Act have been declared unconstitutional because, when it comes to “maternity leave”, they unfairly discriminate against mothers and fathers, surrogate parents, and those who adopt children.
Judge Roland Sutherland suspended the declaration of invalidity for two years to give parliament time to “cure the defects”. This means that the ruling has to be confirmed by the Constitutional Court, and the minister of labour may note an intention to apply for leave to appeal it. What does all of tis mean, Osborne Molatudi, our labour law expert joins us to give a better understanding of this high court judgement.

The Minister of Finance is set to deliver his midterm budget on Wednesday which revises economic predictions and implements urgent adjustments to expenditure. Some economists predict possible tax increase and some salary cuts and expenditure cuts on some essentials from government. Earlier today, legal representatives for Life Esidimeni NGOs continued arguments in the North Gauteng High Court in Pretoria. The investigation seeks to determine if anyone can be held criminally liable for the deaths of the 144 mentally ill patients during their relocation from Life Esidimeni facilities in June 2016. The legal representatives of the families of deceased patients say there’s enough evidence to prosecute those responsible for their deaths.
