It's News Day Tuesday! Sam and Emma break down the biggest headlines of the day. But first they speak with Ian Millhiser, senior correspondent at Vox, to discuss the end of the Supreme Court term, including the blockbuster decision regarding presidential immunity. Sam and Emma begin with updates on Biden and Trump’s differing reactions to the recent Supreme Court decision, Biden’s campaign for president, AOC’s articles of impeachment for the Supreme Court, Biden’s environmental, workplace, and student debt policies, Israel’s continuing violence, the disbarring of Rudy Giuliani, and Hurricane Beryl, before highlighting the interesting change of perspective that Justices Roberts, Alito, and Kavanaugh all seemed to have undergone on that whole “holding Presidents to account” thing. Ian Millhiser then joins, diving right into the complicated task of reconciling the Supreme Court issuing to landmark – and wildly contradictory – decisions the last week, including the overturning of the Chevron Deference Doctrine – which drastically shackles the federal government – and the granting of presidential immunity for “official” acts – which (obviously) fully unleashes the president’s power to rule. Expanding on this, Millhiser, Emma, and Sam unpack the common thread of the self-empowerment of the judiciary, with the former decision essentially putting administrative choices in the hands of the Court and the latter presenting a central distinction (whether the act is “official” or not) that can only be decided by the Court. After tackling how the “immunity” decision changes the perspective on both former (e.g. Watergate) and ongoing attempts to hold presidents to account, and what these decisions tell us about the Courts fascist tendencies and general incompetence, Ian gives his take on how the Chevron decision might come back to bite the conservative Court in the ass, and wraps up with a brief assessment of the Supreme Court’s decision in Moody v. NetChoice.

And in the Fun Half: Sam and Emma unpack some major stories developing behind the scenes of the Democratic machine as Carl Bernstein and Nancy Pelosi make telling comments about Joe Biden’s future as the Democratic presidential candidate. They also parse through Biden’s lackluster response to the Supreme Court’s Immunity decision, new polling (including internal Democratic Party numbers) on Biden’s failing candidacy, how Kamala Harris might perform as his replacement, and what that VP conversation could entail. Jimmy Dore and Candace Owens ponder why we care about Jewish trauma, plus, your IMs!

Happy Monday! Sam and Emma speak with Melissa Jacoby, law professor at the University of North Carolina, Chapel Hill, to discuss her recent book Unjust Debts: How Our Bankruptcy System Makes America More Unequal. First, Sam and Emma run through updates on SCOTUS’ affirmation of presidential immunity, Joe Biden’s Presidency, Boeing’s plea deal, Bannon’s prison time, Oklahoma and Texas Supreme Court decisions, the failure of the US aid pier in Gaza, Israel’s attempted annexation of the West Bank, the French snap elections, and the Bolivian coup attempt, before diving deep into the Supreme Court’s recent decision to officially place the President of the United States above the rule of law, and unpacking what exact acts might fall in the purview of this decision. Professor Melissa Jacoby then joins, briefly giving her own reactions to recent SCOTUS developments, before diving into the concept of bankruptcy in a society that runs on debts as a much-needed safety valve for the individual (or family), a need directly contrasted by the staunch moral stigma around the “personal-failing” of bankruptcy when it comes to people – a stigma that is not applied when it comes to corporations. Stepping back, Professor Jacoby walks through the major role the 2005 bankruptcy act (BAPCPA) played in making the bankruptcy system even more inaccessible for the individual, walking through various stories told in “Unjust Debts” that exemplify the problematic and unreliable role bankruptcy plays in practice, and why the contrasts between Chapter 7 and 13 bankruptcy (and who is filed into which) exacerbate these issues. After expanding on the particular role race plays in the bankruptcy system, Sam, Emma, and Melissa briefly touch on how corporations can take advantage of bankruptcy law – particularly when it comes to avoiding paying fair damages – and wrap up with hopes for the future of bankruptcy law and policy.

And in the Fun Half: Sam and Emma unpack the developing conversation around Biden’s future as the Democratic candidate for president, with Rep. Jamie Raskin and Mika Brzezinski exemplifying the Democratic establishment’s worried (and worrying) response, and parse through the politics that got us to this point. They also touch on Donald Trump’s continued use of “Palestinian” as a derogatory term for Democrats, Biden’s leadership problems, and Bannon’s prison Tim, before wrapping up with some (satirical) ponderings about how SCOTUS’ presidential immunity decision could play out in practice, and the Trump Campaign’s new tact for the Black vote (it’s a doozy!), plus, your IMs!

Jamelle Bouie then joins, as he gives his take on various compounding issues that faced Biden – from his vocal performance to his all-around coherence – before they parse through and highlight some examples, including pivoting a Roe v. It’s an EmMajority Report Thursday! She speaks with freelance writer and author Arthur Goldwag to discuss his recent book The Politics of Fear: The Peculiar Persistence of American Paranoia. Then, she's joined by Manpreet Kaur Kalra, development economics & legal scholar with an emphasis on business and human rights, to discuss her recent piece in In These Times entitled "The Landmark Ruling Against Chiquita Exposes the Failure of Voluntary “Corporate Social Responsibility”, co-authored with Anna Canning. First, Emma responds to the military coup attempt in Bolivia that was beaten back by President Arce, organized labor, and the Bolivian people in the nation's capital, La Paz. Afterwards, Emma speaks with Arthur, and they trace the history of paranoia in American politics, and how that history intersects with the rise in anti-Semitism, conspiracy theories, and hatred on the right today. Arthur traces back the racial, ethnic, and religious animus on the right even further back then contemporary American racism and anti-Semitism, discussing the history of anti-Masonic tropes in American history, which also dovetailed with another great American prejudice: hatred towards Catholics and Catholicism, which dissipated mostly only after the election of John F. Kennedy in 1960. Arthur reckons with a question from an MR IM'er as to whether there is a capacity for this conspiratorial, hate-filled energy to be translated and minimized, potentially into a outlet that isn't characterized by those things, into something more pro-social. He's not convinced. Then, Emma is joined by Manpreet to discuss her reporting on the ruling against Chiquita, the banana company that funded paramilitary groups in Colombia. Manpreet discusses the particulars of the lawsuit, the history of paramilitary groups in Colombia during its pitched, extended Civil War, how companies would gain footholds with those groups, and what this ruling means for corporate governance and its social responsibility.

And in the Fun Half, Emma and the MR Crew are joined by Matt Binder and Brandon Sutton, as they discuss yet another day's worth of expectation setting by Congressional Republicans ahead of tonight's Biden-Trump debate. This time, Tennessee Rep. Andy Ogles touts his "No Juicing Joe" legislation in the sake of transparency (i.e. forcing President Biden to admit whether he's taken mind altering stimulants while in office). Next, Peter walks Sam and Emma through the various major decisions that have come out of the Court in recent weeks, first looking to Moore v. US’ narrow address of tax law, what it means for the future of a wealth tax, and what (if any) pathway exists to get around this conservative court’s absurd requirements for the federal government, also looking to US v. Rahimi role in cleaning up the mess the Court set for themselves two years prior with NY State Rifle & Pistol Assn., Inc. v. Bruen’s requirement that gun regulations be consistent with the “nation’s historical tradition” of 2A regulations, and why this entire fiasco is a perfect representation of the problems with this SCOTUS’ reactionary tendencies and pseudo-originalism. After briefly assessing a final decision in State Dept. v. Muñoz, and how it may fit into a future attack on marriage equality, Shamshiri, Sam, and Emma wrap up the interview by pondering the future of this Court under a theoretical second Biden term.

Happy Monday! Sam and Emma speak with John Ganz, writer of the Unpopular Front newsletter on SubStack, to discuss his recent book When the Clock Broke: Con Men, Conspiracists, and How America Cracked Up in the Early 1990s. First, Sam and Emma run through updates on Netanyahu’s rejection of (supposedly) his own peace plan, Israel’s pivot to Lebanon, another State Department resignation over Biden’s Gaza policy, this week’s primaries, Biden’s polling numbers, the Supreme Court’s agenda, flight attendant labor action, and DeSantis’ vetoing of all state arts grants, before parsing through some stories that help explain who George Latimer, primary opponent to Jamaal Bowman, really is. John Ganz then joins, diving right into his metaphor of the broken clock, inspired by the right-wing’s 1990s movement to “break the clock” of social democracy and Francis Fukuyama’s concept of the Neoliberal consensus as the “end of history,” and how it provides a lens into the evolution of the far-right GOP we see today. Ganz then walks through some of the major players in the end of conservatism as we knew it, including the GOP establishment’s rejection (and the voters’ embrace) of KKK Grand Wizard David Duke, the shortcomings of George H. W. Bush’s establishment centrism, and the fore-knowledge of libertarian Pat Buchanan, who would go on to serve as a central rhetorical influence for the presidential campaign of one Donald Trump. Expanding on this, John, Sam, and Emma explore how this era saw the conservative establishment begin to embrace the talk-show culture-war populism of Rush Limbaugh, which, alongside Bill Clinton’s elitism and assimilation to Reagan economics, allowed for the GOP to somehow frame its anti-democratic and anti-working class policies as an anti-elitist anti-establishment agenda. After diving a little deeper into the right wing’s ability (internationally) to frame itself as the ideology for-the-people over the first two decades of the 21st Century, Ganz touches on Biden’s presidency as a continuation of the left wing’s inability to progress its (supposedly progressive) politics, wrapping up the interview with a brief assessment of the future of the US’ two political parties post-Trump and Biden.
