Neukom Professor of Law at Stanford Law School and Director of the Stanford Program in Law, Science and Technology, discuss their article "Abandoning Trade Secrets," which will be published in the Stanford Law Review. They begin by explaining what trade secrets are and what they protect. They describe the conventional association of trade secrets with patents and observe that analogizing to trademark could be more helpful. They argue that trade secret law should draw on the trademark abandonment doctrine, and explain how it would improve trade secret policy.
