With the COVID diagonoses in Trump’s family, there was some question as to whether the Amy Coney Barrett confirmation hearing would continue as scheduled next week. 

Sen. Tom Cotton said Sunday, ““Everyone is eager to be at work when they need to be at work – if they’re on the Judiciary Committee, a week from tomorrow, either in person or virtually – to have the confirmation hearings for Judge Barrett and then have the vote on Judge Barrett this month,” he said.

Since speaking with his colleagues, Cotton said those who have tested positive for the virus are experiencing mild symptoms or remain asymptomatic, including Sens. Mike Lee, Thom Tillis, and Ron Johnson. 

Cotton said every senator who’s been affected by COVID-19 is expected to be back on the Senate floor by the end of this month. He emphasized he’s “confident” every senator whose vote is needed will be in attendance.

President Donald Trump announced in a pre-recorded video at the National Catholic Prayer Breakfast Wednesday morning that he plans to sign a “born alive” executive order, ensuring medical care for all babies, including those born prematurely or after an attempted abortion.

A $1 billion fund Congress gave the Pentagon in March to build up the country’s supplies of medical equipment has instead been mostly funneled to defense contractors and used to make things such as jet engine parts, body armor and dress uniforms.

The Cares Act, which Congress passed earlier this year, gave the Pentagon money to “prevent, prepare for, and respond to coronavirus.” But a few weeks later, the Defense Department began reshaping how it would award the money in a way that represented a major departure from Congress’s intent.

DOD officials contend that they have sought to strike a balance between boosting American medical production and supporting the defense industry, whose health they consider critical to national security. The Pentagon, which as of 2016 employed more than 156,000 people working in acquisitions alone, also has lent its expertise to the Department of Health and Human Services as it seeks to purchase billions of dollars in needed medical equipment.

“We are thankful the Congress provided authorities and resources that enabled the [executive branch] to invest in domestic production of critical medical resources and protect key defense capabilities from the consequences of COVID,” Ellen Lord, the Pentagon’s undersecretary for acquisition and sustainment, said in a statement. “We need to always remember that economic security and national security are very tightly interrelated and our industrial base is really the nexus of the two.”

Judge orders 'The Church at Planned Parenthood' to stop anti-abortion demonstrations

A Washington State Superior Court judge ruled in favor of Planned Parenthood by granting a preliminary injunction against an anti-abortion group, according to a Planned Parenthood spokesperson.

Legal Voice brought a suit against "The Church at Planned Parenthood" in June on behalf of Planned Parenthood of Greater Washington and North Idaho.

Data show Google burying search results from conservative news sites

“New data from the search consultants at Sistrix indicate that online search giant Google may be intentionally burying search results for major conservative news websites to prevent the public from finding and reading them.

Sistrix tracks millions of various search keywords and ranks the number of "hits" a site receives in across all those terms. Conservative site Breitbart, in particular, has seen dramatic decreases in visibility on Google that began in 2017. By last year, Breitbart's Google search visibility ranked near zero.

If a user types in the name "Breitbart" into the Google search engine, the site appears. But when searching news topics in general, the engine returns no Breitbart stories, even if the site has written on the topic. Even when searching for specific Breitbart writers, users have to scroll through pages of returns before finding Breitbart stories.

Another conservative news site, The Daily Caller, was found to be in a similar situation.

Though Google has not responded to the findings from Sistrix, the data have been corroborated by a leaked internal exchange between Google officials following Presidents Trump's 2016 electoral victory.”

Alex Plitsas writes at the Federalist: A recently leaked phone call between then-Vice President Joe Biden and Ukrainian President Petro Poroshenko directly after the 2016 presidential election records Biden badmouthing the incoming administration, saying, “The truth of the matter is that the incoming administration doesn’t know a great deal about [Ukraine]” and that they were unprepared for the transition. 

Biden then told Poroshenko, “I don’t plan on going away. As a private citizen, I plan on staying deeply engaged in the endeavor that you have begun and we have begun.” This attempt to set up a foreign policy backchannel for himself after he left office as a private citizen, could in fact be illegal, a violation the Logan Act.

The Logan Act bars private citizens from engaging in U.S. foreign policy, although its constitutionality remains questionable and no person has ever been convicted of violating it since it was signed into law in 1799. Ironically, this is the same act that, at Joe Biden’s suggestion, the FBI accused National Security Advisor Michael Flynn of violating as a result of a discussion Flynn had with the Russian ambassador to the United States around nearly the same time as Biden’s call with Poroshenko.

The Oregon Catalyst reports that Oregon may be facing a third wave of arson attacks in the state. 

Wave #1: Portland was hit with nearly 100 acts of arson in June during the first outbreak of violent protests, in the aftermath of the George Floyd death. There were nearly 100 arson attacks on Portland over 10-day period.

Wave #2: Then came a rash of police reported arson and suspected arson attempts statewide in late August and September, likely liked to Jacob Blake shooting: Police identified 14 arson crimes so far in that wave.

Emails between Metro Health Department and Mayor John Cooper's office in Nashville suggest that there was some reluctance to release COVID numbers. 

According to emails obtained by Fox 17, on June 30, contact tracing conducted by the MHD found construction sites and nursing homes were the cause of most Nashville coronavirus cases. Both categories had over 1,000 cases tied to each of them. At that time, only 22 cases were traced back to bars and restaurants.

"This isn't going to be publicly released, right? Just info for Mayor's Office?" Leslie Waller from the health department wrote on June 30.

Senior Advisor Benjamin Eagles responded: "Correct, not for public consumption."

But the mayor's press secretary Chris Song released a statement Thursday afternoon saying that the tv station's report was aired with "limited information and without context."

“A recent news story by FOX17 Nashville was published with limited information and without context, using screenshots of Metro emails to falsely accuse the Mayor’s office and the Metro Public Health Department of withholding public health data that had previously been shared with and published by another local news outlet, the Tennessee Lookout, on August 4th, 2020. Emails from the same thread emphasizing the need to publicly release as much COVID-19 data as possible, which were omitted from the FOX17 story, are attached.”

The only problem is that those emails are from the day before, July 29th. The emails in question were sent the following day, June 30.

A month later, Tennessee Lookout reporter Nate Rau asked the health department about rumors circulating that only 80 cases resulted from the city's bars and restaurants.

Rau asked: "The figure you gave of 'more than 80' does lead to a natural question: If there have been over 20,000 positive cases of COVID-19 in Davidson and only 80 or so are traced to restaurants and bars, doesn't that mean restaurants and bars aren't a very big problem?"

As a result, Metro Health Department Official Brian Todd asked five other health officials via email for guidance. "Please advise how you recommend I respond," he wrote.

An unnamed sender, whose contact information was cut out from the emails provided to FOX 17, responded: "My two cents. We have certainly refused to give counts per bar because those numbers are low per site. We could still release the total though, and then a response to the over 80 could be because that number is increasing all the time and we don't want to say a specific number."

Last month, the Nashville Convention and Visitors Corp. estimated that the city's businesses have lost $2.4 billion so far in visitor spending during the coronavirus pandemic and are reportedly losing $100 million every week, according to the Tennessean. Cooper sent a letter last week to Tennessee Governor Bill Lee to request an additional $82.6 million in COVID-19 relief to assist Nashville's tourism industry, music venue, small businesses and expand social resources.

A group of more than two dozen Ohio parents are suing the state's health director over an imposed mask requirement at schools, arguing that the mandate infringes upon their religious beliefs and the ability to raise their children as they wish.

Ohio Department of Health (ODH) Interim Director Lance Himes' order signed August 13 names several exemptions from the mandate, including students with a disability, mental health condition or medical condition, or if an "established sincerely held religious requirement" does not permit the use of a mask, according to the order.

But the complaint argues that the plaintiffs' right to the free exercise of religion has been violated by the order's language, which insists upon a "religious 'requirement' rather than a belief.'"

When Jennifer Miller, a parent in Putnam County's village of Leipsic, attempted to use the religious exemption, she was denied by her child's school district.

"The School District relied upon [Himes'] order, and acknowledged that Ms. Miller had a sincerely held religious belief, but that was factually distinct from a 'religious requirement' and that Ms. Miller would need to provide evidence of said 'requirement' to qualify for an exemption," according to the complaint.

Lee Strang, a plaintiff and constitutional law professor at the University of Toledo, told The Cincinnati Enquirer that the school board is acting like a church court, effectively deciding whose religious belief is "OK" and whose "isn't good enough."

"Plaintiffs believe that the wearing of masks in an educational setting is not conducive to learning and causes emotional, psychological and social problems due to the impersonal and unnatural reality that wearing masks creates," the complaint reads.

Back in 2016 when quarterback Colin Kaepernick started protesting racial inequality during the national anthem, Hall of Fame coach Mike Ditka said he should “get the hell out” of the country because he thought that it was a form of disrespect.

When asked about the lastest shows of piety and protest, Ditka said, “Football's football. It's not a complicated thing. You're playing the game, you're enjoying the game. You don't like the game, get out of it.” 

“It's not for protesting one way or the other. What color you are, what you think, this or that. You play football. That's it. You're privileged. You got a gift from God that you can play the game because you got a body you can do it with. I don't really understand what you're protesting. I played the game. I coached the game for a long time. It makes no sense to me.”

Ditka added: “I would tell those players go to another country and play football there. You don't have to come out. You don't have to come out if you go to another country. You can't! Because the game's only played in this country. And if you can't respect this country, get the hell out of it.”

Coronavirus test prices charged by some hospitals and labs stun consumers, spur questions

“When Lisa Robertson sought coronavirus testing for her college athlete daughter, a pediatrician recommended a small, independent pharmacy in Arlington, Virginia.

Preston’s Pharmacy charged $35 to take a nasal swab specimen and sent it off to a lab, Principle Diagnostics, for quick results. The lab billed her insurance company $864 – more than eight times what the federal Centers for Medicare and Medicaid Services reimburses for COVID-19 tests.

Robertson was surprised her insurer, a Blue Cross and Blue Shield plan with robust benefits for federal employees and retirees, paid the full amount, via a check that she forwarded to the Bethlehem, Pennsylvania-based lab.

It’s a question more are raising. There have been 85 million tests administered, and congressional mandates require insurers to pay the full cost of testing, no matter how much hospitals or labs bill. As routine testing expands to workplaces, universities and professional sports leagues, labs may have found a lucrative niche amid the pandemic.

In July, the House Energy and Commerce Committee sent inquiries to 10 laboratories and hospitals about COVID-19 test prices that ranged from $300 to $6,000.”

“A man who was arrested in Oregon after allegedly using a Molotov cocktail to start a wildfire was later released from jail but rearrested less than 24 hours later for allegedly starting six more small fires.

Domingo Lopez Jr., 45, was arrested after using a Molotov cocktail “to start a small brush fire,” the Portland Police Bureau said in a statement Monday.

“On Sunday, September 13, 2020 at 4:35p.m., East Precinct officers were dispatched to assist Portland Fire and Rescue with a brush fire in the 9600 block of East Burnside Street,” the statement reads. “Officers saw that a section of grass along the I-205 freeway was burning. Firefighters extinguished the fire. No one was injured and no structures were damaged.”

“About an hour later, East officers were flagged down by a witness who pointed out the suspect in a nearby tent,” the statement continues. “Officers arrested the suspect, who confirmed he lit the fire with the device.”

Authorities booked Lopez Jr. into the Multnomah County Detention Center “on charges of Reckless Burning and Disorderly Conduct in the Second Degree,” the statement adds. “Arson investigators are also doing follow-up to see if other charges are warranted.”

The Portland Police Bureau later reported that the same suspect was arrested just hours later for allegedly starting more fires after being released from jail.
