In his ruling, Berman made clear that the new federal Epstein transparency law leaves no ambiguity: Congress intended these records to be opened, and the courts are obligated to follow that mandate. He dismissed the government’s familiar attempts to stall—claims of “ongoing investigations,” potential harm, or procedural barriers—pointing out that federal authorities had ample time to act and repeatedly failed. His message carried an unmistakable edge: protecting the system’s reputation is not a valid reason to keep the public in the dark.

At the same time, Berman cautioned against expecting some blockbuster revelation hidden inside the files.
