One of the more unusual strategies that people across the country are using against former President Donald Trump in the 2024 election is to get him barred from appearing on the ballot. This approach would undoubtedly take several percentage points off of his tally. And the rationale that people are using to attempt to bar President Trump from appearing on the ballot lies in the 14th Amendment to the U.S. Constitution.
This amendment was enacted shortly after the Civil War in order to keep former members of the Confederacy out of the government. And as such, in the modern context, opponents of President Trump are making the argument that he was involved in an insurrection—and therefore, as per the 14th Amendment, he should be barred from serving in office.
Looking across America, 31 different cases have been filed in 26 different states, all looking to get President Trump off the ballot in those individual municipalities. In each one of these states, there has been at least one lawsuit filed looking to get President Trump kicked off the ballot.
However, what appears to be happening is that this effort is failing one state at a time—with many judges (some of whom actually even agree that President Trump was involved in an insurrection) still refusing to take him off the ballot.
