In this episode, Dr. Mason Marks, Assistant Professor of Law at Gonzaga University School of Law and Affiliated Fellow at Yale Law School's Information Society Project, discusses his article "Emergent Medical Data: Health Information Inferred by Artificial Intelligence," which will be published in the UC Irvine Law Review. Marks begins by explaining how technology companies derive "emergent medical data" from traces of information created by and about consumers, and how emergent medical data differs from traditional medical data. He recognizes the beneficial potential of emergent medical data, but observes that the costs associated with it are already apparent and substantial. He argues that the government should regulate emergent medical data in light of those risks. Marks is on Twitter at @MasonMarksMD.
