A strongly worded ruling by judge Elias Matojane in the High Court in Pretoria yesterday, found that the Head of Gauteng Hawks, Shadrack Sibiya can go back to work. The judge dismissed the acting Hawks head Berning Ntlemeza's application for leave to appeal an earlier ruling that set aside Sibiya's suspension. The court found that Sibiya's suspension was unconstitutional as Ntlemeza does not have powers to suspend him. Sibiya was suspended in January this year, for his alleged role in the illegal rendition of Zimbabwean suspects in 2010.
