Reuben Clark Law School, discusses her article "The Historical Origins of Judicial Religious Exemptions," which will be published in the Notre Dame Law Review. Barclay begins by describing the current state of the law on judicial religious exemptions, as well as the conventional wisdom on the history of such exemptions. She argues that the conventional account misunderstands how antebellum judges understood their role in the interpretation of statutes in relation to constitutional principles.
