  • Episode 179 – An ill-tempered mule that kicks innocent children
The Ruddock Report is morally and ethically flawed from beginning to end. It was conceived the bastard offspring of two different animals, the father being the Right Wing horse of the Liberal Party and which forced itself on the weakened mother, the moderate donkey in the same herd. It was then nurtured on a steady diet of religious freedom propaganda by a panel stacked with theists. The result is an ill-tempered mule that kicks innocent children. With any luck, the Ruddock Report will prove to be a sterile beast and end up in a knackery after an election in May 2019.
We will get on to the Ruddock Report later but first …
    2:10  Suppression Orders
Here at the IFVG podcast, we are ahead of the game.
Last week we spoke about juries and the benefits of judge-only trials for complicated trials and the discussion segued across to discuss judge-only trials in cases where wide publicity may bias a jury against a defendant.
Lo and behold, a few days later, a judge in a high profile Victoria case ordered the media not to report any details about the case.
    A good idea, or not?
    From The New York Times
But the global nature of the internet has blurred the lines, giving local judges the power to threaten any website accessible to local residents, regardless of where the site or its journalists are based.
That includes The Times: The Times is not publishing the latest news of the case online, and it blocked delivery of the Friday print edition to Australia, to comply with the judge’s order. The Times’s lawyers in Australia have advised the organization that it is subject to local law because it maintains a bureau in the country.
Two Times journalists who have been covering the case would be at risk. The judge in the case has threatened journalists with contempt of court charges, which can bring up to five years in prison.
Some publications that have published the news have no full-time staff in Australia and face no such risk. Even naming them appears to be illegal.
Andrews government considers ‘judge-only’ trials for criminal cases
The Andrews Government will consider introducing judge-only trials in Victoria in a move that some lawyers believe could enhance the right to a fairer court hearing.
Despite a number of high profile cases over the years, Victoria remains one of the few places where well-known defendants do not have the option of requesting that a judge alone oversee their criminal trial – unlike their counterparts in NSW, Queensland and Western Australia.
However, this could soon change, with Ms Hennessy telling The Age: “I have asked the Department of Justice and Community Safety for advice on the need for judge-alone trials in Victoria, given their availability in other states and territories.”
8:38 Andrew Broad resigns from Morrison ministry over bombshell sex scandal allegations
Assistant minister Andrew Broad has quit the frontbench in the wake of a sex scandal that could rock the Morrison government, amid claims he met a “sugar baby” in overseas hotels on a trip funded by taxpayers.
Mr Broad has been named in a New Idea magazine feature that says he spent time in Hong Kong with a “blonde beauty” who used the online alias “Sweet Sophia Rose” on a website to connect young women with wealthier older men.
Mr Broad was the first Coalition MP to call for former Nationals leader Barnaby Joyce to resign in February after details of an affair with staffer Vikki Campi...

  • Episode 178 – Forget boats, they come by plane now.
It was Rudd not Morrison who stopped the boats and the big problem now is arrivals by plane. And we discuss “consent” in the context of sub-incision, virgin births and Noam Chomsky.
    1:45 The Fist Was Wrong
    Hi Trevor,
Thanks for the excellent episodes recently. The lively discussions and sensible centrism send you to the top of my playlist each week! Keep up the great work.
Just a small correction on lawyers representing clients who have privately confessed they are guilty.
Basically if you’re a solicitor acting for a guilty client then you can cease acting, but only if the client lets you, and if you’re a barrister then you should actually continue to act for the guilty client. If you continue to act for the client then you cannot tell the court that somebody else did the crime, you cannot say things that are inconsistent with the confession (for example you cannot say the client was somewhere else at the time of the crime), and you are basically limited to arguing that the evidence is insufficient to prove guilt beyond a reasonable doubt.
    Regards,
    Dean Stretton
    Barrister
    6:50 On sub-incision.
From a listener: I had lived and worked in the Kimberley WA for a number of years. I’ve had a number of Aboriginal friends and work colleagues tell me that sub-incision or a form of it is still practised. They refer to it as “Law” and is used by remote communities as punishment for pedophiles, rapist and sometimes young men fathering children out of wedlock. As far as I was told an incision was made at the base or along the penis so that the sperm would not run the length of the penis and the male could not reproduce.
10:36 God Didn’t Get Proper Consent From Mary
From Newsweek: Tucker Carlson and Mark Steyn were not impressed.
Minnesota psychology professor caught the attention of conservative pundits this week after tweeting that God impregnated the Virgin Mary without consent.
Eric Sprankle, Psy.D, an associate professor at the Minnesota State University, angered Fox News host Tucker Carlson and guest commentator Mark Steyn with his Monday comments.
He wrote: “The virgin birth story is about an all-knowing, all-powerful deity impregnating a human teen. There is no definition of consent that would include that scenario. Happy Holidays.”
He later added: “The biblical god regularly punished disobedience. The power difference (deity vs mortal) and the potential for violence for saying ‘no’ negates her ‘yes.’ To put someone in this position is an unethical abuse of power at best and grossly predatory at worst.”
The professor’s stance failed to impress during yesterday’s airing of Tucker Carlson Tonight, with the host and Steyn left fuming over what they called the “dismal” state of atheism in America.
17:47 What is it about Morrison that grates so much?
My BS detector peaks out when Morrison speaks. As Allan Patience says on the John Menadue Blog:
His pronouncements were invariably undermined by the smug grin he manages to stamp on his face when claiming the high ground from a low moral base. He presents as someone hamming it up. He looks like a fake.
But it is since he became Prime Minister that Morrison’s buffoonery has really come to the fore. The baseball caps and cheesy matiness were so confected, so contrived, as to be comical. There are moments when he looks like a mini-Trump.

  • Episode 177 – A Pandora’s Box of Religious Privilege
The Ruddock Inquiry has opened up a Pandora’s box of religious privilege.
The debate about expelling gay students has now widened to include criticism of teaching anti-gay religious doctrine.
1:24 We Won A Podcast Award
It was a small field but a win is a win.
    2:37 A Conscience Vote
Prime Minister Scott Morrison says a Bill to stop discrimination against gay students by religious schools should go to a conscience vote if the parties can’t agree. But he has complicated the deal by adding an amendment preserving the right of religious schools to teach religious doctrine. Legal advice says this swaps one form of discrimination against kids with another.
Sounds like the religious right wing lent on him.
As one reporter suggested, “We have now moved from who can be in schools to the teachings of religions and we are now on a collision course between the secular world and the religious world.” The sort of issue we are heading towards is “can a school teach that it is sinful to be gay?” Shorten squirmed on this issue.
The Fist hopes nothing is resolved and the ensuing shit fight exposes more people to the evils of religious privilege. He said something similar about the marriage equality plebiscite. The religious right should shut up and concede to keep remaining privileges but they can’t help themselves. If they had given in on gay marriage we would not be having this debate.
The religious right are so used to dealing with a stacked hand they have forgotten how to play poker.
You’ve got to know when to hold ’em
    Know when to fold ’em
    Know when to walk away
    And know when to run
    You never count your money
When you’re sittin’ at the table
There’ll be time enough for countin’
    When the dealin’s done
Although a conscience vote would do wonders for the IFVG secular index.
Amanda Stoker said “the concern about removing the protections, without including additional amendments for religious freedoms, was because of the threat of activist parents and activist children. Take for example the situation of a parent or child who wants to be an activist in a religious school. You’ve got a conservative Catholic school and you’ve got a child who wants to run a gay club within the school. That clearly contradicts with Catholic teaching and Catholic schools should have the right to say that’s not within the framework of the values we want for this school.”
The current exemption in S.38(3) of the Sex Discrimination Act
    (3)  Nothing in section 21 renders it unlawful for a person to discriminate against another person on the ground of the other person’s sexual orientation, gender identity, marital or relationship status or pregnancy in connection with the provision of education or training by an educational institution that is conducted in accordance with the doctr...
