We wrap up the series by describing how to practice fixed fee.
The name of the game and the secret is to be proactive in everything you do. It's like playing a game of tennis. The ball can never be in your court. It always needs to be returned as quickly as possible.
The lawyer must drive the case forward, not the judge, not the opposing party, and not your client. It is also essential to work with an assistant or paralegal who is on the same page with the lawyer regarding driving a case forward. This may require re-aligning incentives.
I also discuss how to refund in a fixed fee scenario. The ethics rules require refunds to be based on a percentage of the work completed. Refunds are not time bound.
At the end of the day, the reality is that clients are much happier with fixed fee, than with hourly billing. Our firm sees higher satisfaction scores from clients. Also, expectations around money are easier to manage.
Cases get over faster with fixed fee. This makes the client happy as well. There are many other benefits to practicing fixed fee and a law firm. It is worth the time and effort.
