WARIRANThis is the bizarre and dark mindset of many in the MAGA-RAH-RAH rabble. Good comment on it, from Daniel Davis…
LEBANONIt looks like the IDF is remaining consistent in its pillaging and plunder of occupied territory, not to mention its record of killing innocent people.
Ms. Amal Khalil received death threats via text/WhatsApp messages from an Israeli phone number in September 2024 (with some reports noting an initial threat around August 2024 and a reiteration in mid-September).
She said the messages came from “the Israelis,” “Mossad,” or an “Israeli enemy” number and were attributed to the IDF in many reports. People have confirmed the number as an Israeli-govt number.
The sender(s) knew details of her movements between villages in southern Lebanon.
Key alleged content (paraphrased from her accounts and the reported message):
“We know where you are and we will reach you when the time comes.”
Demands that she leave southern Lebanon immediately, stop reporting from the south, or flee (e.g., “I suggest you flee to Qatar or somewhere else”).
Graphic death threats, including variations of “sever your head from your shoulders,” “cut your head from your body,” or “keep your head connected to your shoulders” if she didn’t comply. LINK
And is Israel preparing for a wider US-assisted invasion into Lebanon?
Aaron Mate thinks that, indeed, Netanyahu will move more forces into and kill more people in Lebanon
STRAIT JACKETDavid Stockman is correct.
David Stockman’s numbers check out—and they highlight a glaring inconsistency in the official narrative around the US Navy’s “total control” of the Strait of Hormuz. In his post, Stockman directly challenges Trump’s claim: “We have total control over the Strait of Hormuz. No ship can enter or leave without the approval of the United States Navy.” Stockman points out that the normal ~20 million barrels per day (mb/d) of oil and products that typically flow through the strait to the global economy is now “essentially 0.0 b/d—except for all the Iranian oil that is sneaking through the ‘blockade’ to the tune of 1.2 million barrels per day.” He’s quoting independent tanker-tracking data, and the figures align closely with what’s being reported right now.
- Independent trackers confirm Iranian crude and condensate exports have continued at roughly 1.1–1.5 mb/d even after the US-enforced restrictions began.
-STILL, the world flow is highly restricted by this US aggression and the Iranian response. Headline: “JPMorgan sees Iran oil system hitting shut in threshold within 15 days” LINK
-AND MintPress News reports the US Navy seized another Iranian-linked tanker, despite Trump’s recent unilateral extension of a fragile ceasefire that Iran has abided by without formal agreement. the ship in the MintPress News video has been publicly identified by name as the M/T Majestic X (also referred to as Majestic X or Majestic-X). It is a large crude carrier (VLCC oil tanker, IMO 9198317, previously named Phoenix/Phonix, Guyana-flagged or described as stateless/sanctioned). US forces seized it on April 23, 2026, in the Indian Ocean (INDOPACOM area, between Sri Lanka and Indonesia) while it was transporting Iranian oil in violation of sanctions. Note, this was not even CLOSE to Iran or the Strait of Hormuz.
Subscribe now
And trump just amped the rhetoric, talking about “shoot to kill” Headline: “U.S. seizes Majestic X tanker in Indian Ocean” LINK
These interdictions, including additional tankers seized in the Indian Ocean around April 21-23, risk escalating tensions by disrupting oil flows while both US and Iranian forces continue vessel seizures.
This is a very good piece on it all, from Jacob Hornberger, of FFF.org Headline “An Unseen Consequence of the U.S. War on Iran – The Future of Freedom Foundation” LINK
CUBANext week, the Senate is to vote on what should not be needed, a “War Powers Resolution” re Cuba. The US Constitution’s requirement that Congress issue a Declaration of War before engaging in even a blockade (essentially what the US has been doing to Cuba since the 1960s and the US now is getting closer and closer to an attempt to overthrow the government there) is obvious. Beyond that, even IF Congress declared War, that would give the politicians no more ethical power to tell you to pay for it. **US HITS SPLC WITH FRAUD CHARGESHeadline: “DOJ hits Southern Poverty Law Center with criminal charges – NBC New York” LINK This is a big deal. THE SPLC is one of the biggest wielders of the “strategy of tension” approach of demonizing conservatives and libertarians, calling them racist etc, to create tension situations, even as, so says this grand jury indictment, the SPLC was funding high-ups in well-known racist groups in the US, and, likely, getting funding from CIA-tied operatives via proxies like the LA Times (where Morris Dees got his original seed money, after building a massive phone and mail contact base, AND after Dees represented in court members of the KKK.) Dees co-founded (with Joe Levin Jr.) Southern Poverty Law Center (SPLC) in 1971, built his fortune as a direct-mail marketer selling cookbooks and other products in the 1960s. In 1969 he sold the business to Times Mirror—the parent company of the Los Angeles Times—reportedly for $6–7 million. He used that windfall and his marketing expertise to launch the SPLC and turn it into a fundraising powerhouse, mailing alarmist appeals about the KKK and hate groups to Northern liberals. Critics have long called the operation a “flimflam” scheme: the SPLC amassed a half-billion-dollar endowment while spending relatively little on actual litigation. Dees’s 1980 divorce from Maureene Bass Dees exposed further personal controversies. Court documents and testimony alleged he conducted multiple extramarital affairs, including a sustained relationship with another woman, and that he attempted to molest his 18-year-old stepdaughter with a sexual device. These revelations, combined with Dees’s 2019 firing amid internal charges of sexual harassment and workplace racial discrimination, have fueled long-standing accusations that the SPLC’s celebrated founder prioritized personal gain and power over the civil-rights mission he publicly championed. Please note that the “strategy of tension” might seem like an esoteric term for those deliberately working to cause political fighting and funding various blocks in order to gain political power and funds (for themselves or their friends, or both) But the activity is not the original problem, and the people who engage in it are only able to do so because political power influences money, and the polis creates interest blocks that do not work in comity, through productive, positive commerce and free will. The state, in its normative sense, is what facilitates and incentivizes this underhanded activity, by pushing all people into one arena to fight.
PLZ watch the above… On a personal note, the SPLC often attacked MRCTV when I was writing for them (this, prior to my departure and the MRC embrace of Zionist Israeli activities).
IMMIGRATION POLICE STATE-THE NINTH CIRCUIT COURT dug the hole deeper. Not only did they not call out the unconstitutional and immoral ICE, not only did the judges not cite the feds for sending armed goons into CA without a request from the CA legislature or Governor (according to Article Four, Section Four of the US Constitution), they court allows for the ICE goons to not ID themselves and allows them to wear masks. As David Knight discussed on his program today, this is alarming and works into both the Immigration Police State and the rest of the police state imposed on us. Headline: “Homeland Security Is Making “Smart Glasses” To Collect Intelligence on Americans - The Free Thought Project” LINK
-AND a reminder, from yesterday, about how HIPAA was designed by the feds to allow them to get your medical information without a warrant. Headline: “Did CA hospital release ICE shooting patient’s medical records without consent?” LINK Well, here is the bill as it was turned into statute, and you can read for yourself all about the “unique healthcare identifier” the HHS gets to issue to anyone who visits any medical center touched by federal money. THE STRAIT DOPE
First, Trump is NOT stopping Iranian-related shipping. Recent shipping data from Vortexa, Lloyd’s List, and outlets like WSJ and Reuters confirm multiple tankers transited the strait with minimal disruption, contrasting Trump’s public claims that the measure is crippling Iran’s finances at $500 million daily in losses.
It is IRAN that is in charge - HEADLINE: “Iran’s IRGC Seizes Two Ships in the Strait of Hormuz - News From Antiwar.com” LINK MORE
But remember, Trump says the US is in the “Driver’s Seat” here… Here is Zerohedge on Iran being smart not to be too ready to negotiate with the US thug patrol:
But, don’t worry at all about supply shocks. The US banking-political-arms-maker gang says all is fine.
Meanwhile, perhaps Trump will push up oil and gas import prices so high, domestic fracking will become more attractive than it has looked at its price level… How nice (wink- sarcasm)
Have no fear!! Trump told everyone the US is brimming with more arms!
Money for the MI:
Everything cool - War spending is really, really good for living standards. (wink)
But someone else also is making cash…
More short-selling by insiders in the last few days…
The US Iraq relationship is splitting further, thanks to the US attack on Iran generating support in for Iran in Iraq Headline “Report: US Increasing the Pressure on Iraq to Reduce Ties With Iran - News From Antiwar.com” LINK
And… The US has suspended cooperation and funding for Iraq’s security forces (including counterterrorism coordination, training, and financial support) until Iraq forms a new government. Iraqi officials told The New York Times this was explicitly tied to demands that Baghdad dismantle Iran-backed militias “attacking US interests” (how quaint of the US occupiers and mafia).
Reports (including from The National and WSJ references) say the US has halted shipments of physical US dollars to Iraq. These dollars are proceeds from Iraq’s oil sales, which the US controls via accounts at the Federal Reserve Bank of New York (a legacy of the 2003 invasion). One shipment worth hundreds of millions was reportedly blocked. Iraq’s Central Bank denied a full cutoff, but the pressure tactic is real
and has been used before. LINK!

US-MEXICO-DRUGS-CIA
Recent reports (published yesterday and today) confirm that two U.S. CIA operatives were killed in a car crash in northern Mexico this past weekend while participating in a counter-narcotics operation. (LINK) The incident occurred in the state of Chihuahua (near the U.S. border). The two Americans, along with two Mexican state investigators from the Chihuahua State Investigation Agency, died when their vehicle skidded off a mountain road, plunged into a ravine, and exploded as they were returning from helping destroy several clandestine drug laboratories (producing synthetic/chemical drugs linked to cartels). Initially, U.S. and Mexican authorities described the Americans as “U.S. Embassy staff” or “instructors” involved in routine training or binational cooperation. However, multiple U.S. officials later confirmed to major outlets that they were CIA operatives participating in a ground-level raid. This has sparked controversy in Mexico. LINK
President Claudia Sheinbaum has ordered a federal investigation into whether the operation violated Mexico’s constitution or national security laws (federal approval for U.S. involvement is normally required; this appears to have involved state-level forces without full federal coordination).
ECONOMY
Hey, remember learning about the US Constitution? Remember how the cats who wrote it and claimed power over other people set some limits, so called? Remember how they installed an amendment process to add or subtract claims of power? And recall how they ENUMERATED what each branch could do, and how? Well, it seems that few people are bothered by Trump again declaring an “emergency”, this time, about fuel. Some MAGA-ites do a spin on the M.O. of previous Presidents, such as Joe Biden, who declared “Climate” a “national emergency” (the Constitution offers no “power” to declare anything an “emergency” that the Pres unilaterally can “handle”), and claim that there is a “national security” (again, defined however they want to define it) aspect to this, so they think that gives them cover, which is false. No. April 20, Trump invoked the Defense Production Act (note, there is no War, so what would be the constitutional pretext? - There isn’t one…) to expand domestic petroleum, refining, natural gas, and related infrastructure capacity. This was framed in headlines as declaring a “national gas emergency” (or national emergency over gas) in response to surging gas prices caused by oil market disruptions from the ongoing Iran conflict and issues in the Strait of Hormuz. He referenced his earlier, broader “national energy emergency” declaration from January 20, 2025 (his first day in office), but the specific gas-focused actions and White House documents tied to this announcement are dated April 20, 2026. News coverage (e.g., Express, Newsweek) appeared the following day, confirming the timing… LINK

Trump appeared on CNBC this morning and continued to rattle his economy-killing sword at Iran. Here is the full interview.
Here is one of the key segments, wherein Trump reiterates that he is ready to resume kinetic attacks inside Iran unless Iran capitulates to his demands, demands that still force Iran to drop all nuclear refining for energy, and force Iran to relinquish control over the Strait of Hormuz. Since the Strait technically is Iranian and Omani water, the attempt of the US or any other nation or set of nations to militarily threaten Iran-Oman to give up control of the strait is an act that runs counter to the long-running international paradigm of 12-mile water control off a coast of a nation for that nation, without dispute.

WARIRANWitkoff and Kushner are reported to be headed to Pakistan for “talks” that Iranian officials already said are non-starters because the IDF already had breached the Lebanon ceasefire, the US attacked a freighter yesterday, and the US demands Iran give up important ballistic missile defense and nuclear energy production. The “ceasefire” between the US and Iran is set to expire Wednesday. Trump’s approach is to threaten. HEADLINE: “Trump Threatens To ‘Blow Up’ the ‘Whole Country’ of Iran if Deal Not Reached - News From Antiwar.com” LINK
And Trump again changes his narrative and claims he is attacking Iran over nuke weapons. He claimed he set back Iran by years when he also made up a story last year and attacked a nuclear energy facility, potentially putting millions of people in danger of radioactive fallout. Then, he claimed he was engaging in attempted “regime change” because he felt so strongly about the “people” of Iran, even though the ‘protests’ there were subsidized by the US and Israel, they were armed by the US, and had advice from Mossad agents, as Mike Pompeo admitted four months ago. Trump then went back to the nuke weapons argument, then, when he attacked Iran and Iran responded by closing the Strait of Hormuz to US-Israeli-tied traffic, Trump said he was attacking Iran because Iran closed the Strait. It looks like the Iranian government cannot escape his perfidy. In fact, even when they engage in “negotiations” he or the Israelis assassinate the Iranian negotiators, and present demands that Iran cannot abide, demands such as ZERO nuclear enrichment in Iran! Here is Trump, today, making more nonsense… The Talking Heads once sang, “Stop making sense, making sense.” Trump fulfills that, in spades
And, of course, the MAGA-Mind tells us that the Iranian government is repressive and evil, as if, even if that were true, that gave the MAGA mind the ethical authority to demand that you pay for their crusade against “eeeevil”. SO, how come Mike Huckabee is, basically, letting this act of desecration (one of many by the IDF) slide?
Since Lebanon is mixed with the Iranian-US-Israeli issue, here is more evidence of IDF attack-desecration of Christian sites (not that those are the only important matter, of course, or the MOST important, but I want to provide this evidence in case people who back the IDF tell you this recent attack on the Statue of Christ is an anomaly)
From 2024:
But, whatever one does, one should not think that the US backs war crimes or engages in them… The Judge and Scott Ritter touch on that twisted mindset, as we see Mike Waltz conveniently claim that hitting electricity generation plants and rail lines and desalinization plants in a desert locale that is a target of US aggression — that such activity is not criminal.
MORE:
According to Larry Johnson, forces in the White House witnessed Trump wanting to use the nuclear codes, to nuke areas of Iran. This could be true, or it could be a message from the Trumpers to threaten Iran, or it could be an attempt by disgruntled Trump staff to add more fuel to his removal fire.
The economics are unraveling in the Middle East. DOMESTIC FASCISM - THE FDAMany folks in the US end up arguing the merits or demerits of a particular drug when it comes to the federal government “allowing” people to voluntarily ingest such substances. On their polis-based “constitutional” level, this is prohibited by the so-called “rules” of the Constitution. The states would have to vote for an Amendment to allow for such prohibition. But, more important and more fundamental, no one has a right, even if they put it into a “Constitution”, to tell others that they can or cannot ingest something - an act that brings no harm to another person. Here, Joe Rogan, despite being all over the map on politics, makes a valid point about the prohibition of psychedelics in the 1970s… LINK from ABC
TARIFF TERRORISMAs we discussed last week, today begins the “door is open, not really to you” process for business owners to apply for return of the tariff taxes they had to pay on imported goods after Trump unconstitutionally imposed them last year. In February, the U.S. Supreme Court ruled 6-3 in Learning Resources, Inc. v. Trump (consolidated with Trump v. V.O.S. Selections, Inc.) that IEEPA does not authorize the President to impose tariffs, only to “block products” for the purpose of what he calls “national security”. That, latter, also is unconstitutional, but the Supreme Court continued to promote that nonsense. Chief Justice John Roberts wrote the majority opinion (joined by Justices Sotomayor, Kagan, Gorsuch, Barrett, and Jackson). The Court held that the statutory phrase “regulate … importation” in IEEPA (50 U.S.C. § 1702(a)(1)(B)) does not include the power to levy tariffs or duties. On the face of the IEEPA, the SCOTUS is correct. The “International Emergency Economic Powers Act” of 1977 (Pub. L. 95-223; codified at 50 U.S.C. §§ 1701 et seq.), magically allows the President, after declaring a “national emergency” (however he wants to define it — try finding that in the US Constitution) with respect to an “unusual and extraordinary threat to U.S. national security, foreign policy, or economy that has its source in substantial part outside the United States”, to “investigate, regulate, or prohibit” various economic transactions, including “importation or exportation of … any property in which any foreign country or a national thereof has any interest.” Congress members at the time claimed that they enacted IEEPA to curb the broader emergency powers that had existed under the Trading with the Enemy Act while still giving the executive flexible tools for genuine peacetime emergencies. In other words, they wanted to skirt the US Constitution beyond the breach of the Trading with the Enemy Act. How nice of them…
After the SCOTUS ruling in Feb, Trump’s pirates immediately shifted to an equally unconstitutional 1960s statute, to reimpose some of their tariff taxes. The 1960s-era statute (actually a subsection of a statute) is Section 232 of the Orwellian “Trade Expansion Act” of 1962 (Pub. L. 87-794; codified at 19 U.S.C. § 1862). This subsection authorizes the President, after an investigation and determination by the Secretary of Commerce that an article is being imported “in such quantities or under such circumstances as to threaten to impair the national security,” (defined by him) to “adjust the imports” of that article. Adjustments can include imposing tariffs, quotas, or other restrictions (or negotiating voluntary export restraints with “trading partners” - notice how the government doesn’t allow YOU to decide your trading partners, they put it into statist terms, negating individual choice and action). It is the primary statute presidents have used for “national security”–based tariffs (e.g., Trump’s steel/aluminum tariffs in his first term and certain product-specific tariffs in his second term), and it, also, is unconstitutional, because it grants to the Chief Executive the power to unilaterally impose tariffs based on his belief or proffered rationale of “national security.” In the first case, full blocks are allowed by the IEEPA, so the SCOTUS ruled that Trump could not use it to impose tariff taxes, but such blocks are unconstitutional, overall. In the latter case, of the “Trade Expansion Act”, which is not a “trade expansion” but grants the Pres power to RESTRICT trade, the US Constitution doesn’t grant the Congress power to cede its power to the Executive Branch (hence the difference in names btwn the LEGSILATIVE and EXECUTIVE Branches!)
Now, big companies with big legal teams will be able to try to recover some of the cash they had to pay. Small companies and end-consumers? Nope.
KEVIN HASSETT AND HIS ENDLESS ECONOMIC CLOWN SHOW
National Economic Council Director Kevin Hassett has portrayed the Trump administration’s policies as unleashing immediate U.S. oil capacity, American economic dominance, and substantial tax relief via the “One Big Beautiful Bill.” Here is the video from his recent clown show, which you will find linked via David Stockman (below)
These claims, however, overlook policy legacies, economic realities, and fiscal trade-offs. Hassett asserts the U.S. oil industry has ready capacity to supply the world with far more crude. Yet Biden-era restrictions significantly retarded exploration and recovery. The administration canceled ANWR leases, restricted over 74% of the Arctic Coastal Plain, and imposed leasing pauses and environmental rules in the Gulf of Mexico. Even with Trump’s November 2025 reversals and congressional action in December 2025, new offshore and ANWR projects typically require 4–10 years from lease to production due to permitting, infrastructure, and drilling timelines. Baker Hughes rig counts in April 2026 hover near 543–548 (down 7% year-over-year), with EIA forecasting U.S. crude output essentially flat at ~13.61 million barrels per day in 2026. Meaningful supply growth will not materialize for at least another year. LINK
Hassett also credits the U.S. as the primary driver of the world economy. While the U.S. leads in nominal GDP ($32.4 trillion projected for 2026), China holds the top spot by purchasing-power parity ($44.3 trillion) and dominates manufacturing and global commodity demand. China’s scale exerts greater influence on worldwide growth and supply chains. LINK
Finally, Hassett claims retirees and tip earners will average $5,500 (based on his statements of the upper and lower “tax savings” and dividing by 2) in tax savings from the Big Beautiful Bill. The legislation offers a temporary $6,000 senior deduction and tip-income relief (up to $25,000), yet analyses show far more modest average benefits—often around $670 for many seniors and lower for typical tip workers after phase-outs and brackets. Critically, Hassett omits the bill’s massive fiscal cost: independent estimates project it adds roughly $3.4 trillion to federal deficits over a decade. Higher borrowing will pressure the Federal Reserve to monetize debt, risking renewed inflation and eroding real gains. LINK
Hassett’s sunny narrative deserves tempering with these grounded realities.
Here is U of Chicago Pro Robert Pape on the truth about US energy provision, from his appearance today on Redacted.

It looks likely that FISA will be reauthorized, despite folks such as Thomas Massie trying to stop it or include in it a mandate for a judicial warrant. Kyle Anzalone offers Judge Napolitano keen thoughts on the matter, and we want to keep in mind that the US Constitution doesn’t grant “permission” for anything. It is a claim of power over people who are supposed to be free, but, within its rules even the Constitution does not differentiate permission for spying on foreigners. That simply is not built into the system. Any attempt to gather anything from any target must see any level of government get a public warrant, issued by a judge, citing the person to be searched and the items sought.

Welcome, fellow Conspirators!
Although “peace talks” (properly read: “US shakedown of Iran” talks) are scheduled to resume this mid-week (and the “ceasefire” expires Wednesday - even though it never really started, thanks to Israel), Iran reportedly fired at two ships attempting to move through the Strait of Hormuz contrary to the rules laid out by Iran this week. This comes on the second day of Israel also breaching the “agreement” the US laid out with Iran that Israeli occupation forces would stop firing on Lebanon. The IDF continued to bomb southern Lebanon, intentionally blowing up houses, and raising the proverbial middle finger to any sort of peace process. What a surprise.

OVERALL US MILITARISM - BAKED INYes. It is difficult to disambiguate all the multitudinous ways that the US uses the tax cash it steals, and this is especially true when it comes to the “you are unpatriotic if you question it” US base system, abroad, and in the States.
UKRAINEUkraine fired 207 drones at Russian targets (many, civilian) over the last 48 hours. This will lead to Russian retaliation, and if any European assistance was part of this (one of the drones was a Flamingo “FP-5”, designed in England and built in Abu Dhabi by UK companies), including European manufacturing plants all the way from England to the Baltic, the Russians might retaliate against those plants. The St. Petersburg Economic Forum is coming up in June. If Ukraine tries to strike the city while that is happening, Russia likely will retaliate against European arms manufacturing sites.

ECONOMICSTrump’s tariffs partially were shot down (appx $175 BILL worth) by the Supreme Court two months ago. Sooo, after big delays, the Trumpites finally have allowed for the “rebate application portal” to open this week. It’s farcical. LINK Why? Let’s take a close look…
These tariffs were struck down as unlawful by the Supreme Court in February 2026 (in Learning Resources, Inc. v. Trump). And, of course, the portal is not an automatic payout system—importers must proactively opt in, submit detailed claims via the “Automated Commercial Environment (ACE) portal”, and meet strict documentation requirements. It sure is curious how the government can so easily claim that you pay it, but you are forced to navigate a maze, even after the SCOTUS said part of the tariff Tumpery is bogus (they SHOULD have noted it all was unconstitutional - and we know that the very act of govt forcing someone to pay something is immoral).
Small-business advocates, attorneys general, legal analysts, and importers have three main lines of “process” criticism, which all encompass the fact that rebates are difficult (or impossible) for smaller businesses to obtain.
One! Small importers lack the compliance teams, lawyers, consultants, and technical infrastructure that large firms have. The process requires:
Setting up or accessing an ACE portal account (setup can take 3–4 weeks; many small businesses don’t have one).
Enrolling in electronic ACH (automated clearinghouse, the main U.S. electronic funds transfer system operated by NACHA [National Automated Clearing House Association]) refunds.
Submitting precise claims that could be rejected for formatting errors or missing Chapter 99 tariff codes. (LINK)
Navigating a phased rollout that initially excludes about one-third of claims (roughly $55 billion worth).
The system is described as “deceptively easy” on the front end but with heavy back-end scrutiny. Critics say this creates a bureaucratic nightmare that favors big companies and forces smaller ones to either hire expensive help, sue in the Court of International Trade, or sell their refund rights to Wall Street investors at steep discounts (sometimes pennies on the dollar).
Key sources criticizing the small-business burden:
NPR (Feb 2026, still relevant post-rollout): Small-business owners describe needing lawyers and time-consuming paperwork they don’t have the bandwidth for. One owner called it frustrating that there isn’t a simple process. https://www.npr.org/2026/02/24/nx-s1-5723862/trump-tariffs-refunds-small-business
Notus (lawmakers’ concerns): Senators and small-business advocates warn the convoluted system leaves smaller firms behind because they lack legal/financial experts. https://www.notus.org/economy/lawmakers-worried-small-businesses-trump-tariff-refund-system
Cato Institute: The non-automatic, paperwork-heavy ACE/CAPE process “punish[es] small companies” that lack sophistication; many will be unable to get timely refunds. https://www.cato.org/blog/apparently-government-cant-refund-trumps-illegal-tariffs-easily-it-collected-them
New York Attorney General Letitia James and 17-state coalition (March 2026): The portal disadvantages small businesses and individuals without resources to navigate a “complicated application process or sue.” They urged Congress to legislate automatic refunds. https://ag.ny.gov/press-release/2026/attorney-general-james-calls-congress-pass-legislation-requiring-tariff-refunds
2. Consumers cannot file for rebates, even though the costs were mostly passed on to them. Tariffs are paid by importers (the “importer of record”), not end consumers. Refunds therefore go only to businesses—not households or individuals who faced higher prices on imported goods (groceries, clothes, toys, etc.). A CNBC CFO Council survey found that while many companies plan to seek refunds, none intend to pass the money back to customers.
Key sources:
CNBC: “Tariff refunds unlikely to benefit consumers” — companies keep the money. https://www.cnbc.com/2026/04/13/tariff-refunds-unlikely-to-benefit-consumers.html
Time magazine: Consumers “are not eligible to apply directly for refunds.” https://time.com/article/2026/04/17/tariff-refund-cbp-import-duties-trump/
AG James coalition letter (cited above): Explicitly calls for legislation to make businesses reimburse customers who bore the “financial burden.”
3. The legal and bureaucratic morass of trying to get a rebate. The process is far from straightforward:
Not automatic; claims can be rejected, delayed, or require additional protests/litigation (especially for already-liquidated entries).
Portal limitations: Initially handles only ~63% of claims; unliquidated or certain anti-dumping entries are excluded.
Many importers are filing parallel lawsuits in the Court of International Trade (over 1,000 new cases since March) because they don’t trust the portal alone.
Potential government appeals, system glitches from high volume, and further delays (processing could take 60–90+ days, with interest accruing to taxpayers).
Dual-track strategy recommended by lawyers: file both administrative claims and sue.
Additional sources on the legal complications:
Reuters: Companies are scrambling and worried about glitches, last-minute Trump administration moves, and system crashes. https://www.reuters.com/legal/government/companies-scramble-tariff-refunds-us-prepares-launch-claim-process-2026-04-17/
New York Post: Portal initially unable to process a third of requests. https://nypost.com/2026/04/02/business/tariff-refund-portal-will-initially-be-unable-to-process-a-third-of-requests/
Sooo, while the portal provides a mechanism for businesses to recover funds, it is overly complex, excludes consumers entirely, burdens small businesses disproportionately, and risks turning into a years-long legal slog. Some small-business coalitions are still pushing Congress for automatic refunds to fix these problems.
