Court filings for the monumental House vs. NCAA antitrust settlement reveal some potentially troubling provisions. As sports attorney Darren Heitner noted, the settlement “allows the NCAA to subjectively decide if an NIL payment is for a valid business purpose and if it constitutes fair market value.” The NCAA will also have the power to determine which donors constitute as a booster and which don’t. If provisions like these are ratified with the settlement, it could open up new cans of worms when it comes to the chaotic NIL landscape.
