    • Twitter has two different TOS agreements. One that is specific to the EU, EFTA States and the UK. And a second one for the rest of the world. 
    • Twitter isn’t responsible for any content that is posted on their platform, the person who posted the content is responsible and owns the content rights. 
    • Twitter reserves the right to remove content that violates their user agreement.
    • When using the Twitter service you maybe (definitely will be) exposed to content that you might find offensive, harmful or inappropriate.

    Google Terms of Service Highlights:

    • Arbitration Agreement: No 
    • Interesting Word: Merchantability - Salable; of quality and type ordinarily acceptable among vendors and buyers. 
    • Google acknowledges no one reads the Terms of Service: We know it’s tempting to skip these Terms of Service, but it’s important to establish what you can expect from us as you use Google services, and what we expect from you.
    • Google recently updated their Terms of Service and completely reformatted the design to be more consumer friendly. It's a step in the right direction.
    • Users own the IP rights to the reviews they submit through the Google Maps product
    • Users can turn off ad personalization features on Google by going to the Ads Settings page. 
    • These Terms of Service are Google's general Terms of Service. Each of Google’s individual products have their own specific Terms of Service users should read.

  • Quibi Terms of Service

    Tonight you will be listening to the Quibi Terms of Service. Last Updated on May 6th, 2020. Narrated by Scott Elchison.


    Quibi Terms of Service Highlights: 

    • Word Count: 6198 
    • Arbitration Agreement: Yes
    • New Word: Tortious - constituting a tort; wrongful. 
    • Quibi explicitly calls out in section 1 (registration) users are not allowed to use a password for the Quibi service that is already in use on another service. 
    • Similar to Disney, Quibi gives users a license to access content, not ownership. 
    • Based on section 6 (voting) Quibi is/will be making some of their content interactive.
    • Section 2 (subscriptions) has an interesting call out about Quibi’s fee structure. They are able to charge users for new features, content or additions to the App that may be made available from time to time. Makes you wonder what they are working on. 
    • Apple is a 3rd party beneficiary of Quibi’s terms of service and has its own section within the TOS (section 25). Basically, section 25 calls out what Apple is and isn’t responsible for when a person uses the Quibi service.

    • Disney explains the impact of arbitration on consumers very clearly: YOU ARE GIVING UP THE RIGHT TO LITIGATE A DISPUTE IN COURT BEFORE A JUDGE OR JURY.
    • The Passwords and Security clause states you aren’t allowed to share your Disney account information with anyone: You agree that you will not share your account or account information with others. You are responsible for taking reasonable steps to maintain the confidentiality of your username and password, and you are responsible for all activities under your account that you can reasonably control.
    • You are buying access not ownership of Disney’s products. When you purchase a product from Disney you are buying a license to access the product: This is a license agreement and not an agreement for sale or assignment of any rights in the Disney Products.
    • Disney subscription products (cough cough Disney+) will auto renew on your payment method: By signing up for a subscription, you agreed that your subscription will be automatically renewed and, unless you cancel your subscription, you authorized us to charge your payment method for the renewal term.

    Netflix Terms of Use Highlights: 

    • Word count 4147
    • Arbitration Agreement: Yes

    • appearing or stated to be true, though not necessarily so; alleged "the purported marriage was void"
    • If you are traveling and have download content be careful if/when you connect your device, you may lose access to your downloaded content. 
    • Some Offline Titles may not be playable in certain countries and if you go online in a country where you would not be able to stream that Offline Title, the Offline Title will not be playable while you are in that country
    • Netflix actually explains what arbitration means/is rather clearly.  
    • Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award and nothing in this Arbitration Agreement shall be interpreted as limiting any non-waivable statutory rights. 
    • You need to send an physical letter by certified mail to file a claim (it can’t be an email but Netflix can email you)

    Facebook's Terms of Service narrated by Scott Elchison.


    Facebook Terms of Service Highlights:

    • Facebook doesn’t have an arbitration clause. 
    • You can have your Facebook account memorialized upon death or incapacity (but not disappearance. All my Tiger King fans out there know what's good). 
    • When you delete content on Facebook, it’s no longer visible to other users, however it may continue to exist elsewhere on Facebook’s systems because immediate deletion is not possible due to technical limitations. If this is the case your content will be deleted within a maximum of 90 days from when you delete it. 
    • Your content may also not be deleted if the content you are trying to delete has been used by others in accordance with the license you grant to Facebook when you agree to their terms of service and that person has not deleted the content. 
    • You give Facebook permission to use your name, profile picture and information about actions you have taken on Facebook next to or in connection with ads, offers, and other sponsored content that Facebook displays across their Products, without any compensation to you.
    • Always ask yourself how a company makes money before agreeing to your next terms of service agreement. It is a simple question that will help you better understand if you are a consumer of a product or the product that is being sold.
