Agent Hull’s testimony in the Tyler Robinson preliminary hearing gave us a much better look at how prosecutors are trying to move this case forward. The judge is not deciding guilt at this stage, instead he’s trying to determine if there is reasonable cause to bind Tyler Robinson over for trial in the shooting death of Charlie Kirk at Utah Valley University. Pay attention to the way investigators place Robinson on the UVU campus multiple times on the morning of the shooting, first in shorts and a red shirt, later with a blue backpack, and then later again in different clothing while walking with what Agent Hull described as “a gait or a limp.”
Prosecutors used the video evidence to track the person they identify as Robinson moving toward the rooftop where he allegedly laid prone at the corner of the roof before the shot was fired. Then, he ran with something in his hands to the corner of the rooftop where he scaled down the building and ran into a nearby wooded area. He didn’t take the stairs, and the video supports the claim that the clothing matched that worn by Tyler Robinson when he was seen going to the rooftop. The important question for today is not whether every issue has been proven for trial. It’s whether the state showed enough reasonable cause to move this case forward to a trial. This powerful testimony may also support the prosecution’s larger argument about planning, preparation, premeditation, flight, and eventually a possible death penalty case. Until a decision is made by a jury, Tyler Robinson is presumed innocent unless and until proven guilty in court.
