In the final hours before Judge William Sullivan declared a mistrial in the Lindsay Clancy murder trial, defense attorney Kevin Reddington asked the judge for a one-hour pause. He used the time to file an emergency petition with the Massachusetts Supreme Judicial Court, arguing the lone holdout juror was biased against people with mental illness and had refused to follow the court’s instructions on reasonable doubt.

Justice Dalila Argaez Wendlandt held a brief hearing over Zoom. The court denied the petition. Sullivan declared the mistrial.

The emergency filing was the last in a series of moves Reddington made during the final days of deliberation. He asked Sullivan to dismiss the holdout. He asked the judge to survey the panel on lesser charges. He argued the foreperson’s notes showed the holdout was intractable. Sullivan declined each request.

Clancy had pleaded not guilty to three counts of first-degree murder in the deaths of Cora, 5, Dawson, 3, and Callan, 8 months. The jury split eleven to one after seven days. The prosecution had argued during the trial that Clancy’s fall from a second-story window was not a sincere attempt, a characterization the defense used to argue the prosecution had alienated the panel.

The criminal trial ended in a mistrial. The civil lawsuits are just beginning. Patrick Clancy and Lindsay Clancy have both filed suit against the medical providers who treated Lindsay before the January 2023 deaths of their children Cora, 5, Dawson, 3, and Callan, 8 months. Both lawsuits name the same defendants — psychiatrist Dr. Jennifer Tufts, nurse practitioners Rebecca Jollotta and Julie Paul, Aster Mental Health, and South Shore Health.

Patrick’s wrongful death complaint alleges his ex-wife was prescribed eight psychiatric medications in a three-week span. Lindsay’s malpractice suit alleges undiagnosed Bipolar I disorder with postpartum onset and a course of uncoordinated polypharmacy that triggered a psychotic break.

The criminal trial at Plymouth Superior Court produced five weeks of conflicting psychiatric expert testimony. The jury deadlocked eleven to one and could not resolve the competing diagnoses.

Seven days of deliberation. More than thirty-six hours behind closed doors. Eighty-plus witnesses. Three hundred exhibits. And when the jury in Lindsay Clancy’s murder trial finally reported to Judge William Sullivan for the third time that they could not agree, the split was eleven to one.

Defense attorney Kevin Reddington said the eleven wanted to acquit. The holdout, reportedly a male juror, would not follow the majority. Sullivan declared a mistrial at Plymouth Superior Court.

Clancy had pleaded not guilty to three counts of first-degree murder in the deaths of her children Cora, 5, Dawson, 3, and Callan, 8 months. The defense argued postpartum psychosis and overmedication drove her actions. Prosecutors said she planned the killings and acted rationally.

Reddington tried everything in the final hours. He asked Sullivan to dismiss the holdout. He asked for a lesser-charge poll. He filed an emergency petition with the Massachusetts Supreme Judicial Court. The court denied it. The mistrial stood.

DA Timothy Cruz must now decide whether to retry. Sullivan scheduled a September 29 status conference.

Barry Morphew is facing a new legal problem while awaiting trial in Suzanne Morphew’s death. A Colorado judge says video from an alleged Denver hit-and-run clearly shows Morphew during an encounter that prosecutors now say matters to his bond.

According to the court, Morphew refused to provide his name or identification and indicated he didn’t have insurance. He then made the other driver a specific offer for the damage.

She declined and said police were being called. The judge says Morphew left afterward, nearly hit another person, and drove over a curb.

Morphew has pleaded not guilty to first-degree murder. Judge Amanda Hopkins ordered him confined to his home with no ordinary exceptions. Prosecutors want further restrictions because they argue his conduct shows a willingness to evade authorities.

One number in that exchange now sits at the center of a much bigger problem.

Look past the verdict watch and the Lindsay Clancy case has become something much stranger.

We are judging the jurors for failing to agree. We are judging Patrick Clancy for how he grieves, where he lives, whom he married and why he forgave Lindsay. And we are judging prosecutors for pursuing a first-degree murder case that Kevin Reddington says never included a plea offer.

Tony Brueski takes all of it apart.

The jury heard psychiatric professionals reach fundamentally different conclusions about Clancy’s criminal responsibility. Patrick became a target of unsupported theories despite no public evidence implicating him. And the justice system now faces the difference between punishment, treatment and protection.

Three children are dead. Nothing about that changes.

But if every person surrounding the tragedy must also satisfy an angry audience, we may be asking the wrong people to prove themselves.

Tyler Robinson entered a not-guilty plea after Judge Tony Graf sent the Charlie Kirk case to trial on aggravated murder and six other charges. Prosecutors say their preliminary case includes campus surveillance, a rifle recovered near the alleged escape route, DNA evidence and private communications they characterize as admissions.

Robinson remains presumed innocent. His attorneys have challenged identification and DNA interpretation, and they argue the state has not shown that a single rooftop shot knowingly endangered other people enough to support death-eligible aggravated murder.

That plea preserves those challenges and leaves room for later negotiations, although no deal has been announced. The defense has not publicly offered a developed alternate-shooter theory. One exchange prosecutors presented from Robinson’s roommate goes directly to responsibility without resolving what defense his lawyers will ultimately take to a jury.

There is a persistent assumption that Lindsay Clancy rejected some compromise and forced everyone into this trial.

Her lawyer says that never happened.

Kevin Reddington says prosecutors did not offer a plea deal. With three first-degree murder charges, the case went before a jury deciding whether Clancy was criminally responsible, guilty of varying homicide offenses or not guilty.

Tony Brueski asks what the prosecution ultimately wants the justice system to accomplish.

Nobody disputes the enormity of what happened to Cora, Dawson and Callan. The dispute is whether Clancy was legally responsible while experiencing the mental illness both sides acknowledge existed.

If prison provides punishment and psychiatric confinement provides treatment plus public protection, which objective matters most?

And when prosecutors, defense experts, state experts and now jurors cannot agree, maybe the unresolved question is bigger than Lindsay Clancy herself.

Apparently there is now an internet-approved timetable for grieving your children, and Patrick Clancy failed to consult it.

Patrick eventually relocated to New York and remarried after losing Cora, Dawson and Callan. He also publicly forgave Lindsay and has described her as someone who became terribly sick rather than the monster strangers expected him to describe.

Parts of the online true-crime world have responded by dissecting Patrick instead.

There is no public evidence connecting him to the deaths of his children. That has not stopped unsupported theories and suspicion surrounding his personal life.
