Those policies poll extremely well. The word socialism polls badly. Paul Krugman's Substack draws the distinction clearly: what most Americans actually support is social democracy, a market system with progressive taxation, safety nets, and regulation to limit inequality. Half of Americans cannot meet their basic daily needs. Trump's $2.2 billion financial disclosure dropped the same week as the Colorado primary. Establishment Democrats have been captured by corporate donors, the one percent, and AIPAC, and the voting base is done pretending otherwise.

The headline finding: fourteen of twenty-one study participants, two thirds, had an immediate negative reaction when asked about democracy. Hawk reads quotes from participants by name throughout the study, including a Wyoming homeschooling mother who says she does not like the word democracy, a Michigan retiree who says if they had a democracy it would be a problem, a Wyoming delivery driver who says every small town would be outvoted by cities, and a South Carolina woman who calls democracy two wolves and one sheep deciding who is for dinner.
Hawk also addresses JVL's core thesis, that these voters respond to Trump's illiberalism not in spite of it but because of it, alongside Sarah Longwell's more sympathetic read of the same voters. He engages with his brother's argument that MAGA voters who reject Trump would lose their family systems, friendships, and community standing in doing so, and explains why that argument moves him somewhat but does not change his position. He closes with JVL's conclusion that domination of the political system is not enough for these voters, who want the people who disgust them to simply disappear.

The majority opinion was written by Chief Justice John Roberts and joined by Justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson, and Amy Coney Barrett. Brett Kavanaugh concurred in the judgment while dissenting in part. Clarence Thomas and Samuel Alito dissented, joined by Neil Gorsuch. The court grounded its decision in the historical context of the 14th Amendment's citizenship clause, tracing the language back to English common law, the Dred Scott decision and its widespread condemnation, Attorney General Edward Bates' wartime opinion on citizenship, the Civil Rights Act of 1866, and the court's prior precedent in United States v. Serwer's piece documents the Trump administration's explicitly race-based statements about Haitian immigrants, including claims they all have AIDS, eat household pets, are genetically predisposed to crime, and are poisoning the blood of the country. Samuel Alito's majority opinion declined to repeat any of those statements, substituting his own race-neutral explanations for what they might have meant instead. Justice Elena Kagan's dissent noted that the evidence was plain to see in statements the majority and even Trump's own lawyers could not bring themselves to repeat.
The article brings in legal scholars including Guy-Uriel Charles of Harvard Law, who describes the ruling as setting up an impossible burden for plaintiffs, Anderson Francois of Georgetown, who notes that the administration now needs only a plausible pretext to discriminate while Black plaintiffs need proof no amount of evidence will satisfy, and Melissa Murray of NYU, who calls this a colorblind constitution the architects of Jim Crow would love.
