In a parallel development, the U.S. Supreme Court has denied Karen Read's emergency request to pause her retrial. Justice Ketanji Brown Jackson, acting on behalf of the court, issued the denial without providing an explanation. Read's legal team had argued that retrying her on charges of second-degree murder and leaving the scene of a fatal accident would violate the Double Jeopardy Clause, citing statements from jurors in the first trial who claimed they had unanimously agreed to acquit her on those charges. However, since no formal verdict was announced before the mistrial was declared, the courts have ruled that a retrial does not constitute double jeopardy. With the Supreme Court's decision, the retrial will proceed as scheduled, with jury selection continuing and opening statements expected soon.

At a recent motions hearing for Bryan Kohberger, the suspect in the University of Idaho student murders, both sides clashed over critical pieces of evidence and the defense’s attempts to challenge the prosecution’s case. The judge denied several of the defense’s motions, including a bid to dismiss the indictment due to grand jury irregularities. Kohberger’s team had argued that the grand jury was misled by an unreliable FBI genetic genealogy analysis and that it violated proper legal standards, but the court found the indictment sufficient to move forward. The defense also tried to suppress certain pieces of evidence, such as cell tower data and body cam footage, claiming they were improperly obtained or prejudicial—efforts that mostly failed.


However, not everything went the prosecution's way. The judge did grant the defense more time to scrutinize some of the state’s key evidence, particularly DNA and cellphone data that tie Kohberger to the crime scene. These materials were initially withheld or delayed, and the court acknowledged the defense’s right to fully analyze them. The ruling opens the door for further challenges to the state’s forensic evidence in the future. While the case remains on track for trial, the hearing showed that the defense still has leeway to poke holes in the prosecution’s foundation, especially on the scientific evidence front.

The evidence that has been presented against Bryan Kohberger is very strong. With not only DNA evidence tying him to the crime scene, but also a detailed digital map of his behavior has him at that house not only on the date of the murders, but at least 12 times previously. Not only that, but one of the surviving roommates saw a man leaving the house that fit his description. With all of that evidence, it would seem like a foregone conclusion that a conviction would come at the end of a trial.


However, some experts are pointing out that the evidence in the affidavit alone might not be enough to get the conviction that the government and the families want and expect.
