This week begins the Sitzer/Burnette trial on cooperative commissions. Just in time for the trial, the Wall Street Journal, formerly a pro-business, pro-capitalism, and free-market newspaper, published a pathetic hit piece comparing REALTORs to cartels. Why stop there? Why not add Nazi and fascists? If you are going to use inflammatory language why not use the trifecta?
This ridiculous article demonstrates that the Plaintiffs and mainstream media have no idea what you all do for a living or how the system works for the protection of the parties. They certainly don't know or perhaps don't care how this will affect homebuying negatively in the future.
Today, I break down the WSJ article as well as the RE/Max and Anywhere settlements.

Contrary to the claim of 20th century philosopher Tiffany, "I think we're alone now," we are not alone. The struggles and challenges you face in your market are very similar to the struggles that other agents also face.
Real estate closing attorney, Mark Stevenson, joins Dishin' Dirt from the Peninsula of Virginia to discuss how real estate agents in his market are facing the same issues you are also facing today. It is a great chance to see you are not alone and see how other areas of the country are handling similar issues.

Is it illegal for a real estate agent to post a picture of your listing on social media asking potential buyers to contact them to see it? Can you do this legally if you simply provide information about the listing agent? Does the MLS agreement allowing brokers to share the IDX feed affect this argument?
In today's episode I will argue both sides of the issue including offering a few other examples that are also questioned.
Plus, an update on Redfin leaving NAR.

Many, if not all of you, are familiar with MV Realty's "Homeowner Benefit Program" that pays the homeowners a small sum of cash in exchange for what amounts to a 40-year lien on the property. This lien requires the homeowner and all future owners to use MV Realty as the listing agent for the entire 40-year term and contains stiff penalties for failing to do so. Luckily, these may be coming to the end as MV Realty made a huge move that may spell the end of this arrangement.

Part of the Sitzer and Moehrl cases involving the seller allegedly paying the buyer's agent's commission has been settled. Anywhere (formerly Realogy) settled the case this past week. While this does not end the case altogether, it could have a tremendous affect in the market.
SC REALTOR Association CEO Nick Kremydas joins Dishin' Dirt to discuss this case as well as many other issues that NARs is facing today.

This may very well be the most important Dishin' Dirt ever.
Real estate agents are under attack by plaintiff lawyers and the Department of (In)Justice. Both are attacking the way you are paid commissions as well as the clear cooperation rule that prohibits brokerage from hiding listings from other agencies. If successful, this could be disastrous for the industry. It could price buyers out of the market as well as allow big agencies to hide listings from anyone but their agents.
Jeff Wheeler joins me today to discuss the state of multiple cases against our industry that could absolutely change the face of real estate forever!
