  • Karen Read’s Defense Argues for Dismissal of Charges Following Mistrial in John O’Keefe Case
    Karen Read’s defense team is pushing for the dismissal of two charges in her ongoing legal battle over the death of Boston Police Officer John O’Keefe. During a hearing on Friday, Read's attorneys argued that retrying her on charges of second-degree murder and leaving the scene of a deadly accident would violate her constitutional protection against double jeopardy.

    The case against Read stems from a tragic incident in January 2022, where she is accused of striking O’Keefe with her SUV and leaving him to die in a snowstorm outside a Canton, Massachusetts home. O’Keefe, a 16-year veteran of the Boston Police Department, was found with injuries consistent with blunt force trauma and hypothermia. The prosecution argues that Read intentionally hit O’Keefe, while the defense maintains that he was killed inside the home and that Read was framed.
    The original trial ended in a mistrial after jurors reported they were deadlocked on the manslaughter charge, but Read's defense contends that the jury had already unanimously acquitted her on the charges of second-degree murder and leaving the scene. Attorney Marty Weinberg, representing Read, emphasized that “strong uncontradicted evidence” shows the jury reached a not guilty verdict on these two charges.
    Weinberg argued that the jury's note indicating they were deadlocked was ambiguous, and the judge should have polled the jurors or sought additional clarification before declaring a mistrial. "It’s the right thing to do," Weinberg stated, urging the judge to dismiss the charges that had allegedly been acquitted.
    Prosecutors, however, challenged the defense’s assertions, labeling them as "unsubstantiated but sensational post-trial claims." They argue that the defense is relying on hearsay and conjecture about the jury’s deliberations. According to Norfolk County Assistant District Attorney Adam Lally, the jury did not return a verdict slip, and neither the guilty nor not guilty boxes were checked for any of the charges. Lally insisted that the defense is "twisting the law" with their request and that no extraneous influence or bias affected the jury.

    In their motion, the prosecution also pointed out that Read’s defense team had the opportunity to object to the mistrial when it was declared but chose not to. "Contrary to the representation made in the defendant’s motion and supporting affidavits, the defendant advocated for and consented to a mistrial," the prosecution noted. They further argued that this consent removes any double jeopardy bar to retrial.
    Prosecutors acknowledged that they received a voicemail and emails from individuals who identified themselves as jurors, confirming that the jury had reached a unanimous decision on two of the charges. However, they maintained that they are ethically prohibited from inquiring into the substance of the jury’s deliberations and cannot guarantee confidentiality for those jurors.
    The defense’s request to dismiss the charges comes ahead of a new trial set to begin on January 27. As part of their strategy to prevent a retrial, Read's attorneys are calling for a "post-verdict inquiry" to question all 12 jurors and establish that they had unanimously acquitted her on the two charges before the mistrial was declared.

    Judge Beverly Cannone, who presided over the initial trial, heard the arguments from both sides during the Friday hearing but has not yet made a decision. “I’ll take it under advisement,” Judge Cannone told the court, indicating that she will rule on the matter at a later date.
    The case has attracted significant attention, not only because of the tragic death of a Boston police officer but also due to the contentious legal battle over Read’s alleged role in the incident. As the retrial date approaches, both the defense and prosecution are preparing for what is likely to be another high-profile courtroom confrontation.

  • Wisconsin Woman in Custody Following Charges in Death of 4-Month-Old Child
    Ann Marie Spaude, a 54-year-old woman from Rothschild/Wausau, has been taken into custody nearly a year after being charged in connection with the tragic death of a 4-month-old child in Wausau. Spaude faces a felony charge of child neglect where the consequence is death, along with additional related charges.

    The case dates back to the early hours of September 23, when emergency responders were called to a home on Jackson Street in Wausau after receiving a report of an unresponsive infant. According to the incident report, the child was found without a pulse and had blood coming from his nose when paramedics arrived. Despite their best efforts, the child was pronounced dead at the scene.

    Witness statements provided to the police indicate that Spaude was responsible for watching the child during a party that took place at the residence. She was reportedly expected to remain sober while caring for the infant. However, the complaint alleges that Spaude consumed a significant amount of alcohol, including multiple 40-ounce bottles of Mickey’s malt liquor and a considerable amount of beer.

    One witness told authorities that he went to check on the baby and discovered the child face down with his head positioned beneath Spaude. Another witness reportedly rolled Spaude off the child and lifted him up, but he was already lifeless. According to the complaint, Spaude slept through the entire time that police and paramedics were on the scene, desperately attempting to revive the child.

    An autopsy later determined the cause of death to be "probable asphyxia due to overlay," citing the fact that the infant was found prone under an adult. Other contributing factors also supported this conclusion, according to the report.

    Following the incident, an arrest warrant was authorized in June for Spaude, who had been free on a cash bond ordered in March. The charges against her were amended on June 21, leading to her eventual arrest. Spaude is currently being held in the Marathon County Jail and was scheduled to appear in court on Friday, August 10.

    The tragic nature of this case has shocked the local community, raising awareness about the critical importance of responsible caregiving, particularly when young children are involved. As Spaude faces the legal consequences of her actions, the court will seek to determine her level of responsibility in this heartbreaking event.

    The Norfolk County District Attorney's Office, responsible for prosecuting Karen Read, recently sent a Brady letter to 13 criminal defense attorneys across four different cases. This letter disclosed that Proctor is under investigation and has been suspended without pay. The letter also highlighted issues regarding potential conflicts of interest and bias in his investigations, which could have far-reaching implications for the cases he was involved in.

    Proctor’s role as the lead investigator in the 2022 death of Boston Police Officer John O'Keefe, in which Karen Read was charged with second-degree murder, has been particularly scrutinized. During the trial, Proctor admitted to sending texts where he referred to Read in derogatory terms and expressed hope that she would "kill herself." Additionally, Proctor’s close connections with other witnesses, including his sister, who is friends with the sister-in-law of the homeowner where O'Keefe was found, have further complicated the case.

    The trial, which ended in a mistrial due to a hung jury, is set to be retried. However, the implications of Proctor’s testimony and the ongoing investigation could significantly impact how the prosecution proceeds. According to Suffolk Law Professor Chris Dearborn, "Anytime the government is trying to use a witness with this kind of baggage, it will call into question his credibility and whether or not proper procedures were followed."

    Attorney Joseph Cataldo, who received the Brady letter, expressed concern over the use of Proctor as a witness in ongoing and future cases. Cataldo, whose client was indicted in connection to a July Fourth murder in Randolph last year, stated, "I don't know what the commonwealth is going to do with these witnesses, but I know that we'll be filing more motions."

    Proctor’s involvement in other high-profile cases, including a prominent doctor's case in Dover, the murder of a moped driver in Milton, and a child abuse case in Quincy, is also under scrutiny. The unofficial transcript of Proctor's testimony from the Read trial has been circulated among attorneys handling these cases, prompting further legal challenges.

    As the investigation into Proctor continues, legal experts predict that additional motions will be filed to uncover more details about his background and conduct. "Even looking forward to the second Karen Read trial, what are they going to do with him as a witness in that case now that all of this is out there? Are they going to call him again? Are they going to not call him?" asked Dearborn, highlighting the uncertainty surrounding the upcoming retrial.

    The situation is expected to be addressed further at a hearing scheduled for Friday, where Read's attorneys will argue for the charges of murder and leaving the scene to be dropped. The outcome of this hearing, and the decisions made regarding Proctor’s involvement, could have a significant impact on the direction of the retrial and other cases where Proctor played a key role.

  • New Jersey Father Sentenced to 25 Years for Death of 6-Year-Old Son Forced to Run on Treadmill
    The New Jersey father convicted of killing his 6-year-old son by forcing him to run and fall off a treadmill has been sentenced to 25 years in prison. On Friday, Aug. 2, Ocean County Judge Guy P. Ryan sentenced Christopher Gregor to 20 years for aggravated manslaughter and five years for endangering the welfare of a child, more than three years after his son, Corey Micciolo, died.

    Gregor was originally charged with child endangerment following Corey's death on Apr. 2, 2021. In March 2022, the Ocean County Prosecutor's Office announced he was being charged with murder, which was later changed to aggravated manslaughter. Judge Ryan ordered the two prison terms to run consecutively because the aggravated manslaughter was separate from the earlier act of child endangerment.

    During the sentencing on Friday, Breanna Micciolo, Corey’s mother, called Gregor a "monster" during a victim impact statement. "Corey was and still is my life, my world and my everything," Breanna said, crying. "What this monster did was pathetic, disgusting, and I wish him nothing but the worst."

    Gregor, meanwhile, maintained his innocence, telling the courthouse prior to his sentence being read, "I want to assure you, on Apr. 2, I did nothing to cause Corey's passing. ... I did not hurt my son.''

    During the six-week trial, jurors were shown footage taken at the Atlantic Heights Clubhouse on Mar. 20, 2021, that showed Corey running on a treadmill as Gregor stood nearby. Gregor began increasing the speed, causing the 6-year-old to stumble and fall. Whenever Corey would fall off, Gregor would put him back on the treadmill and increase the speed. At one point, he seemingly bit Corey on the head.

    Days after the security camera footage was captured, Corey was taken to see a doctor and said his father made him run on the treadmill because he was "too fat." Just one day later, Corey was taken to the hospital after he began stumbling, having slurred speech, nausea, and trouble breathing after a nap. He had a seizure during a CT scan and died.

    The Ocean County Medical Examiner's Office determined Corey had sustained injuries due to blunt force trauma, and Gregor was charged with endangering the welfare of a child on July 7, 2021. In March 2022, the Ocean County Prosecutor's Office announced the second charge of manslaughter after a report from the state's expert witness indicated Corey died as a result of "blunt force impact of the chest and abdomen" and determined the manner of the child's death to be homicide.

    Prosecutors argued during the trial that Gregor inflicted injuries on his son to punish him because Breanna had been late bringing him home. Gregor's legal team challenged the prosecution's arguments and brought in a forensic pathologist to testify, who claimed that CPR performed on Corey in the emergency room may have caused the blunt force trauma.

    On May 31, Gregor was found guilty of aggravated manslaughter. The prosecutor's office said that Gregor's 25-year sentence was subject to the No Early Release Act, meaning that he will be required to serve at least 85 percent of his prison sentence before he may be considered for parole eligibility.

    "Christopher Gregor will spend the rest of his days here on earth knowing that he caused the death of his son Corey,'' Ocean County Prosecutor Bradley D. Billhimer said after the sentencing. "While nothing can bring this precious child back to his family, I hope that today's sentence brings some sense of closure for those who knew and loved Corey. At long last, justice for Corey has been accomplished."

  • Ben Affleck and Jennifer Lopez’s Love Story May End Amid Allegations from Suge Knight and the Diddy Drama
    The entertainment world celebrated when Ben Affleck and Jennifer Lopez reunited and got married a few years ago, but it seems like their love story could be ending once again. According to Suge Knight, their rumored impending divorce is a result of the FBI providing Affleck with footage of Lopez engaging in illicit activities, recovered from raids on Sean "Diddy" Combs’ homes a few months ago.

    Knight detailed his theory on the most recent episode of his "Collect Calls With Suge Knight" podcast. “They go raid Puffy’s house and they get all these videos of J. Lo doing this and J. Lo doing that,” Knight said, recalling her involvement in the 1999 nightclub shooting where Shyne took the fall for Diddy. “And they know the fact that J. Lo lied and said that the gun was Shyne’s or whatever and sent that man to prison, destroyed his life and she knew it was Puffy’s.”

    The former Death Row Records CEO claims the FBI gave the footage to Affleck as a courtesy so he could be aware of the situation before the videos potentially went public, especially given the impact of the footage showing the Bad Boy founder assaulting Cassie. “It’s a white man who got respect in the white world,” Knight said. “I’m quite sure they said, ‘We want to show you some things about your wife.’”

    Knight believes that upon seeing the footage, Affleck could not look at Lopez the same way. “I’m quite sure they headed for divorce because that’s a man who had a good life,” he said. “Great parents don’t spend a lot of money. Ain’t tripping off paparazzi, he’s living his life. He got his own team. She done brought all that extra sh*t out and now that motherf**ker wants out.”

    These claims gain depth when considering Diddy and Lopez’s romantic history. They dated from 1999 to 2001, and Rolling Stone recently reported that he attempted to get her back after their breakup. Over the last several months, Diddy has been accused of sexual assault and other crimes that allegedly took place around that time.

    In March, Homeland Security raided Diddy's Los Angeles and Miami homes. Just under two months later, footage of him assaulting Cassie in 2016 was shared online. Knight gave Diddy an ominous warning earlier this year, though it was unclear whether he was referring to this footage or something else. “Your life’s in danger ‘cause you know the secrets, who’s involved in that little secret room you guys are participating in,” Knight said. “So, you know they’re going to get you if they can.”

    Meanwhile, an OK Magazine report stated that Ben Affleck wasn't happy with the way things turned out between him and Jennifer Lopez. “Jennifer was Ben's dream woman. It was a drama all the time. He's feeling down about it and is upset and depressed that it didn't work out, even though he knows ending it is the right thing to do."

    The shocking revelation in February regarding Miles Harford, a former funeral home owner accused of keeping a woman's corpse in a hearse for nearly two years and mishandling the cremated remains of over 30 individuals, sent shockwaves across Colorado. As the state grapples with the aftermath of this disturbing case, a new bill aims to overhaul regulations in the funeral industry.

    Colorado, the only state in the nation lacking licensing requirements for funeral home operators, has been under scrutiny following several high-profile incidents. From the discovery of nearly 200 human remains in an abandoned Penrose funeral home to the sale of hundreds of body parts by an unchecked Montrose funeral home, the state's lax regulations have come under intense scrutiny.

    The proposed legislation, Senate Bill 24-137, unanimously passed the Colorado Senate Committee on Business, Labor and Technology on March 26, signaling a pivotal moment in the state's efforts to address funeral home mismanagement. The bipartisan bill is now headed to the Senate Finance Committee for further review.

    If enacted, the bill would establish stringent mandates for operating a funeral home in Colorado. Funeral directors would be required to graduate from an accredited mortuary science school, pass the industry's standard National Board Exam (NBE), and complete a one-year apprenticeship. Similar educational and certification requirements would apply to other positions within funeral homes, including mortuary science practitioners, embalmers, cremationists, and natural reductionists.

    While the bill has garnered broad support, concerns have been raised, particularly by funeral home operators who lack formal licensing but have operated in the industry for years without incident. However, the bill includes provisions for grandfathering in existing practitioners, subject to specific requirements and oversight.

    Under the proposed legislation, licenses for funeral industry professionals would be subject to renewal and would require ongoing education to ensure compliance with evolving standards. The bill also outlines disciplinary measures, including license suspension or revocation, for non-compliance or misconduct.

    As Colorado takes steps to tighten regulations in the funeral industry, the bill reflects a commitment to protecting the dignity of the deceased and restoring public trust in funeral home operations. With bipartisan support and a clear mandate for reform, the state aims to prevent future tragedies and ensure accountability within the mortuary science profession.

  • Former Teacher Released on Parole After 17 Years for Attempted Murder of Teen Student
    Samson Shelton, the former teacher and professional wrestler who admitted to attempting to murder 17-year-old Ashley Reeves in 2006, has been released on parole after serving about 17 years of his 20-year sentence. The Illinois Department of Corrections confirmed his release this Monday, April 22, marking the end of a case that captured national attention and was later depicted in a Lifetime movie.

    In 2006, Shelton, then a 26-year-old driver’s education teacher and known in wrestling circles as "The Teacher," became infamously linked to the brutal attack on Reeves, who had once been a student at the middle school where he taught. The incident occurred after Shelton and Reeves, who had been involved romantically, got into an altercation while he was driving. According to reports, Shelton choked Reeves and broke her neck before discarding her body in a wooded area of Citizens Park in Belleville.

    Reeves was found barely alive around 2 a.m. on April 29, 2006, after a 30-hour search initiated when she was reported missing. Miraculously surviving the attack, she endured significant brain trauma and underwent a painstaking recovery process to relearn fundamental skills such as swallowing, walking, and talking.

    During his incarceration, Shelton was housed at Illinois River Correctional Center, beginning in June 2007. His early release on parole, scheduled to last until April 2027, has reignited discussions about justice and rehabilitation.

    The case garnered extensive media coverage due to the shocking nature of the crime and Shelton's dual life as an educator and wrestler. His confession and the subsequent discovery of Reeves alive were pivotal moments in the investigation, which revealed the extent of his betrayal.

    In a recent interview, Reeves, now in her 30s, shared her ongoing recovery journey and her determination to move forward. "It’s been a long and challenging road, but I’m focused on my future and continuing to heal," she told KSDK.

    As the community reflects on Shelton's release, many continue to be haunted by the severity of the crime and its impact on a young student. The case remains a profound example of survival and the complex questions surrounding sentencing and parole in the criminal justice system.
