"I got home from the haunted attraction around 1 a.m. and saw their shapes in the bed as I passed by their room," Garth testified. He watched YouTube videos until around 3 a.m. and was later awakened by his father’s call for help.

    "I heard a thump and then my dad said, 'Garth, come help,'" Garth recounted. He found his mother, Tammy, partially off the bed, and immediately tried to help her. "I realized she’s not been breathing," Garth said, describing his shock and helplessness.

    The following morning, Garth was met with law enforcement vehicles outside his home. "Several officers got out and surrounded me and insisted I go with them," he testified. His phone was confiscated, and both he and his wife were detained separately for hours. 

    Garth felt immense pressure from prosecutors to change his testimony, stating, "They were telling me my story was untrue and I needed to change it."   

    Forrest Fischer, Garth’s attorney, took the stand to provide his account. Fischer, based in Driggs, was called to provide legal services for Garth during the grand jury proceedings. "The focus of the grand jury was on Garth," Fischer explained, noting that Garth had previously testified and now faced follow-up questions, potentially about perjury.

    Fischer recounted his instructions to Garth during the proceedings. "I told him to answer only the questions being asked and if he wasn’t sure, Garth could consult with me," Fischer testified. He emphasized that Garth should not talk to the media. Fischer also addressed whether he warned Garth about potential traps in the grand jury. "I don’t recall exactly but wouldn’t have been surprised if I did because Garth had already testified," Fischer said.
    Garth’s testimony revealed the emotional toll of the events. He learned about his mother's exhumation unexpectedly from his sister Emma. "It was a complete surprise," Garth said. He described his normal school day interrupted by law enforcement’s presence at his home, leading to a deeply distressing experience.

    Garth also spoke about his father Chad Daybell’s religious beliefs, contrasting them with his own. Garth described his father's beliefs as more traditional, closer to how the LDS faith was practiced a hundred years ago. "I teach and believe in evolution. I teach that to my students. I teach the earth is 4.5 billion years old as opposed to 6,000," Garth said, highlighting his more scientific perspective.

    He also discussed his father's views on spiritual concepts like the 144,000 and the practice of casting out evil spirits. Garth acknowledged partially sharing some of his father's views on light and dark as opposing forces but did not fully align with Chad's more extreme beliefs.

    Throughout the testimony, attorneys from both sides engaged in detailed questioning. Prosecutor Lindsey Blake asked Garth about his awareness of the grand jury’s intent and his interactions with law enforcement. Defense attorney John Prior focused on Garth’s perceptions of his father’s beliefs and the pressure he felt from prosecutors.

    As the session concluded, Garth reaffirmed his belief that the prosecutors were pressuring him to alter his testimony. "It was made pretty plain that I needed to change my story to fit theirs," Garth said, highlighting the intense scrutiny and legal challenges he faced.

  • Jennifer McCabe Testifies in John O'Keefe Death Case, Reveals Key Details and Karen Read's Statements
    The trial concerning the tragic death of John O'Keefe on January 29, 2022, continues as Jennifer McCabe, a key witness, took the stand to provide her testimony. McCabe's account sheds light on the events leading up to the discovery of O'Keefe's body and the subsequent investigation.

    Jennifer McCabe, wife of Matthew McCabe, began her testimony. She is one of three women, alongside Kerry Roberts and Karen Read, who discovered O'Keefe's body on the lawn of 34 Fairview Road on that fateful morning.

    McCabe recounted how she and her husband met her sister at the Waterfall bar around 9 p.m. on January 28, 2022. "He was my friend. I loved John. He was an amazing guy," McCabe said when asked about her thoughts on O'Keefe. She recalled that O'Keefe mentioned he was dating someone new and wanted her to meet his girlfriend, Karen Read.

    She first met Read in July 2020 when O'Keefe introduced them. They occasionally socialized at sporting events, birthday parties, and other gatherings. "I enjoyed Ms. Read. I really liked her. I thought we connected from the beginning," McCabe shared, adding that both she and Read had multiple sclerosis (MS), which created a bond between them.

    On the night before O'Keefe's death, McCabe left the Waterfall around midnight. She described the bar's atmosphere that night as positive, consistent with previous witnesses' testimonies.

    The Night and Morning of January 29, 2022

    McCabe detailed her communication with O'Keefe that night. She gave him directions back to the Albert home after leaving the bar. However, O'Keefe never entered the house. She saw a dark SUV outside the Albert home and texted O'Keefe, "Here?" at 12:27 a.m., followed by "Pull behind me" four minutes later. Despite her attempts to reach him, McCabe never received a response.

    At 4:59 a.m., McCabe sent another text to O'Keefe, "Please answer. Karen is worried we need to find u." This message was prompted by a call from O'Keefe's niece, who was with Karen Read. Read had reportedly gotten into a fight with O'Keefe and was distraught, repeatedly asking, "Could I have hit him?" and mentioning a damaged tail light.

    Jennifer McCabe described how she, her husband, and Read began searching for O'Keefe. Read arrived at McCabe's home, hysterically screaming. They were joined by Kerry Roberts, and the three women drove to O'Keefe's home and then to Fairview Road. As they approached the Albert home, Read spotted O'Keefe's body and shouted, "There he is," banging on the car door to be let out. 
    "I saw Kerry wiping the snow off of John’s face, and I could not believe that that was John laying there," McCabe testified.
    She called 911, and Roberts and Read attempted CPR while waiting for first responders. McCabe stated that Read, in a state of panic, told the paramedics, "I hit him."

    McCabe also testified about a Google search requested by Read. Read asked her to search for information about hypothermia and how long it takes to die in the cold. "My hands were shaking," McCabe recalled, emphasizing her shock and disbelief.

    Additionally, McCabe informed the court about her conversation with police officer Lank, whom she contacted after the incident. She shared the details of Read's statements and behavior with him and the Massachusetts State Police. 

    Throughout the testimony, McCabe highlighted the chaotic and emotional state of the early morning hours following O'Keefe's death. Her detailed account provides critical insights into the moments leading up to and following the discovery of O'Keefe's body, contributing to the ongoing investigation and trial proceedings.

  • Diddy's Apology Criticized as Insincere Amid Ongoing Legal Troubles and Disturbing Video Evidence
    In the wake of serious allegations and a gut-wrenching video, hip-hop mogul Sean "Diddy" Combs issued a public apology on Sunday. However, the apology has been met with criticism from one of Cassie Ventura's attorneys, Meredith Firetog, who dismissed it as self-serving and insincere.

    "Combs’ most recent statement is more about himself than the many people he has hurt," Firetog said in a statement. "When Cassie and multiple other women came forward, he denied everything and suggested that his victims were looking for a payday. That he was only compelled to ‘apologize’ once his repeated denials were proven false shows his pathetic desperation, and no one will be swayed by his disingenuous words."

    Adding to the controversy, the Los Angeles County District Attorney's office announced they would not prosecute Diddy over the actions depicted in a 2016 video, citing the statute of limitations. "We find the images extremely disturbing and difficult to watch," read a statement from the office of L.A. District Attorney George Gascón on Instagram. "If the conduct depicted occurred in 2016, unfortunately we would be unable to charge as the conduct would have occurred beyond the timeline where a crime of assault can be prosecuted."

    The DA's office also mentioned that law enforcement had not presented a case related to the attack depicted in the video against Mr. Combs, but they encouraged any victims or witnesses to report crimes to law enforcement or reach out for support from their Bureau of Victims Services.

    The contents of the video closely match an assault allegation Ventura made in a lawsuit filed against Diddy in November. Ventura's lawsuit, now settled, also included allegations of rape and claims that Combs forced her to have sex with male sex workers while he masturbated.

    “The gut-wrenching video has only further confirmed the disturbing and predatory behavior of Mr. Combs,” said Ventura’s attorney, Douglas Wigdor, in a statement to Billboard. “Words cannot express the courage and fortitude that Ms. Ventura has shown in coming forward to bring this to light.”

    Ventura and Combs had an on-again, off-again relationship for 11 years, ending in 2018. In her lawsuit, Ventura stated she met Combs in 2005 when she was 19 and he was 37. After signing to his Bad Boy Records label, she claimed that Combs “lured” her into a romantic relationship where he "asserted complete control" over her life.

    Since Ventura's lawsuit late last year, Combs has faced four more sexual misconduct lawsuits. In November, he stepped down as chairman of his digital media company, Revolt, and reportedly sold his stake in the company in March. Additionally, federal agents conducted raids on Combs’ homes in Los Angeles and Miami as part of a federal sex trafficking investigation, according to CNN.

    Throughout these allegations, Combs has maintained his innocence. “Let me be absolutely clear: I did not do any of the awful things being alleged,” he said in a statement posted to social media on December 6. “I will fight for my name, my family, and for the truth.”

    Diddy's apology and the subsequent statements from Ventura's attorneys have intensified public scrutiny. The video evidence and ongoing legal battles have further complicated his public image, raising questions about accountability and justice in high-profile cases involving powerful figures in the entertainment industry.

AJ asked if Albert had ever been in a fight before, and Albert replied only with his brothers.

  • The Crazy Jailhouse Calls Between Chad Daybell & Lori Vallow
    In a major development in the Chad Daybell murder trial, new evidence was presented in court featuring a bizarre phone conversation between Daybell and his wife, Lori Vallow. This evidence, revealed for the first time, adds to the disturbing narrative surrounding the deaths of Vallow's two children and Daybell's first wife.*

    The phone call, recorded on June 8, 2020, from a jailhouse phone, was presented in court as a crucial piece of evidence. The call occurred a day before authorities discovered the remains of seven-year-old JJ Vallow and 16-year-old Tylee Ryan. At the time, Lori Vallow was accused of child abandonment.

    The Phone Conversation

    During the call, Chad Daybell and Lori Vallow spoke in a mixture of religious fervor and coded language. Vallow could be heard saying, "Before the second coming, the Lord had ordained for us to begin the millennial day within Zion while war and chaos reigned everywhere else." Daybell responded, mentioning that the new Jerusalem would grow "exponentially." He added, "They're doing all they can to destroy one of the key families, but they're not going to."

    Mention of Alex Cox

    The conversation took a more chilling turn when Daybell mentioned Vallow's deceased brother, Alex Cox. Despite Cox having been dead for six months, Daybell claimed to have been in contact with him, saying, "He did want me to say he misses you."

    "Through our investigation, we learned that Alex Cox often went by Ray Lamar," Ray Hermosillo of the Rexburg Police testified.

    Cryptic Project Discussions

    The couple's discussion then veered towards a "project" or "blueprint," with Vallow questioning how to manage issues within it. "But there's other things in the project when I'm going back over it that I could have easily done or been inspired to do to avoid a lot of the issues that were gonna come up with that," she said.

    Daybell responded with reassurance, "It's a marvelous plan."

    "How do you know so?" Vallow asked.

    "How do I know? It's been shown to me honey. You just are spectacular, and the Lord is going to use those talents. You're on earth on this time for that purpose," Daybell replied.
     Defense Response

    Daybell's defense attorney attempted to downplay the significance of the call, questioning the detective who listened to it. He pointed out that JJ, Tylee, and Tammy Daybell had all died before the call took place.

    "So there wasn't - from your knowledge in this - some nefarious plan to kill or murder anyone, was it?" the attorney asked.

    "It was in furtherance of the plan from our investigation," Hermosillo replied.

    As the prosecution's case moves forward, they have called a total of 67 witnesses to the stand. Judge Steven Boyce suggested that the state could rest its case after calling another witness on May 16. Following this, the defense will have the opportunity to present their witnesses.

    This latest evidence further complicates the defense's narrative and underscores the bizarre and disturbing elements of the case involving Chad Daybell and Lori Vallow.

"I don’t remember," she said when asked if state police asked to look at her phone. 

    The prosecution presented a photo of Colin Albert to the jury for the first time. McCabe’s testimony continued with questions about text exchanges with Albert regarding picking him up at 34 Fairview, leading to objections from the defense.

    Ryan Nagel, who arrived at 34 Fairview to pick up his sister, testified that he did not see the SUV reverse and hit a pedestrian. "No," he answered when asked by ADA Lally. Nagel described the scene, "I observed there was a person inside the car, there was an interior light on and a woman in the driver’s seat."

    **Forensic Testimony Highlights DNA Findings**

    Teri Kun, a veterinary scientist at UC Davis, provided crucial forensic evidence. She confirmed the absence of K9 DNA on the swabs tested, only detecting pig DNA, which she noted could have come from food. "We did not see any K9 DNA," Kun stated, adding that the pig DNA could have been from food sources.
