On May 13, 2025, a federal court in the Southern District of California granted a preliminary injunction against the Encinitas Union School District, requiring parental notification and opt-outs for gender ideology lessons in "buddy classes." The lawsuit, filed by First Liberty Institute and the National Center for Law & Policy in September 2024, stemmed from a May 2024 incident at La Costa Heights Elementary, where fifth graders were required to read My Shadow is Pink—a book about a boy exploring gender identity—and discuss it with kindergarteners, an activity that conflicted with the religious beliefs of two families. After the district denied the parents’ requests for notice and opt-outs, the court ruled that compelling students to support views against their faith violates the First Amendment, noting the buddy program’s mandatory role in the curriculum.
