SYS 009: GDPR and Privacy, your questions answered - Interview with Punit Bhatia

Listen Later

In this episode Steve interviews GDPR and  privacy expert, author, podcaster and data privacy consultant Punit Bhatia.

They discuss GDPR in depth, attempting to demystify some of the misconceptions and help any business owners listening understand and know what they should be doing.

KEY TAKEAWAYS

  • When Punit was looking to change careers, he knew he wanted to go into something in the regulatory space. When he began to research opportunities, he heard about a project which was sold to him as ‘systems’ but was actually around GDPR, he hasn’t looked back since and has gone on to write four books about GDPR.

  • Often smaller business do not realise the importance of GDPR. It’s just as legally important as taxes, and audit of your business can happen at any time. Not being compliant and taking it seriously could put you out of business.

  • You need to be aware of GDPR even if you are just starting out with a website, particularly your privacy statement and what data you are collecting. It is worth investing some time in researching the steps you need to take, such as following Punit’s 12 steps to being GDPR compliant or doing one of Punit’s free courses.

  • When using freelancers, whether they are in or outside of the EU, it’s important to set up a contract around data processing, to ensure they are compliant. You, the company collecting the data, are liable for any breeches but if you can prove you have a solid contract this can help protect you.

  • Other ways of protecting yourself when using freelancers, particularly when outside of the EU, is using a VPN, allowing them read only access to sensitive data on a drive or keeping the tasks that require sensitive data to remain in-house rather than being outsourced.

  • Sometimes it’s not just about taking GDPR and legalities into consideration. When collecting information about someone, for instance from social media, ask yourself what are you doing with that information, is it ethical?

  • Just because someone is on your mailing list, that doesn’t mean every email you send out should go to them. You could limit the emails that go to everyone and ask people to ‘opt in’ to emails for certain campaigns. This serves three purposes 1. You are less likely to irritate customers with lots of unnecessary emails 2. You get a more fine-tuned list of potential clients for each campaign 3. It helps protect you in terms of GDPR.
