  • Does Bryan Kohberger's Family Think He Is Guilty?
In the latest episode of "Hidden Killers With Tony Brueski," Tony discusses the new book "When the Night Comes Falling: A Requiem for the Idaho Student Murders" by Howard Blum with guest Eric Faddis, a former felony prosecutor and defense attorney. The book provides an in-depth look at the individuals involved in the Idaho student murders, particularly focusing on the paternal support provided by Bryan Kohberger's father. This dynamic echoes the support seen in the Gabby Petito and Brian Laundrie case. The conversation touches on the father's actions, such as accompanying Kohberger on a cross-country drive after the incident and suspicious behaviors like cleaning his car with bleach. The discussion raises questions about the extent of the father's knowledge or involvement, especially since he has not attended any of Kohberger's hearings. Faddis suggests that the father's absence could be due to potential legal implications, as he might be called to testify about his conversations with his son during the drive and subsequent events. The book and discussion shed light on the complexities and familial dynamics at play in this tragic case.

    **Main Points:**

    - Discussion of Howard Blum's book "When the Night Comes Falling: A Requiem for the Idaho Student Murders."

  • BREAKING NEWS-RAW COURT AUDIO-June 2025 Start Date Set for Bryan Kohberger Trial in University of Idaho Murders Case

A district court judge has set a June 2025 start date for the criminal trial of Bryan Kohberger, the suspect accused of the 2022 murders of four University of Idaho students. The trial, anticipated to last three months, will take place in Latah County, where the killings occurred.

During a hearing on Thursday, both the defense and prosecuting attorneys agreed to the proposed trial schedule. Latah County District Judge John Judge detailed the timeline, noting that it includes two weeks for jury selection, eight weeks for the trial itself, and an additional two weeks for the verdict, sentencing, and any other remaining matters.

Kohberger, 29, is charged with allegedly breaking into the off-campus home of University of Idaho students Kaylee Goncalves, 21, Madison Mogen, 21, and Xana Kernodle, 20, in November 2022. He is accused of fatally stabbing the three roommates along with Ethan Chapin, 20, who was Kernodle's boyfriend and present in the house at the time of the murders.

At the time of his arrest in Pennsylvania, about six weeks after the students were killed, Kohberger was a teaching assistant and Ph.D. candidate in criminology at Washington State University in Pullman, Washington. Pullman is a short drive from the University of Idaho campus in Moscow. Kohberger was extradited back to Idaho within weeks of his arrest and now faces charges including four counts of capital murder and one count of burglary.

The case has progressed slowly, with the recent scheduling hearing marking the first significant development in the legal proceedings for some time. Anne Taylor, Kohberger's public defender, reiterated that the defense does not support the trial being held in Latah County. Another hearing is set for August 29 to discuss a potential change of venue. Additionally, a deadline for the defense to file motions challenging the death penalty, which prosecutors are seeking, is set for September 5.

During an arraignment in May of the previous year, the judge entered not guilty pleas on Kohberger's behalf for all the charges brought against him. Kohberger appeared at the arraignment but did not respond when asked how he would plead.

Kohberger is currently being held without bond in Latah County.

    ### Bullet Points:

    - **Trial Date Set**: The criminal trial of Bryan Kohberger is scheduled to start in June 2025.
    - **Trial Duration**: The trial is expected to last three months, including jury selection, the trial itself, and verdict and sentencing.
    - **Charges**: Kohberger faces four counts of capital murder and one count of burglary for the November 2022 killings of four University of Idaho students.
    - **Defense Objections**: Kohberger's defense team opposes the trial taking place in Latah County and has a hearing scheduled to discuss a change of venue.
    - **Not Guilty Pleas**: Not guilty pleas were entered on Kohberger's behalf during an arraignment in May of the previous year.
    - **Custody Status**: Kohberger is being held without bond in Latah County.
    - **Upcoming Hearings**: A hearing to discuss the trial venue is set for August 29, with a deadline for challenging the death penalty on September 5.

  • New Book Reveals Bryan Kohberger Targeted Madison Mogen in Idaho Murders; Family Suspected Him Before Arrest
In a startling revelation, an explosive new book claims Bryan Kohberger, the suspect in the brutal murders of four Idaho college students, had a single target on the night of the crime. According to investigative journalist Howard Blum's forthcoming book, *When the Night Comes Falling: A Requiem for the Idaho Student Murders*, Kohberger intended to kill Madison Mogen specifically, dispelling notions of a random killing spree.

Blum's book, set to be released on June 25, unveils significant details about the tragic night in November 2022 when Mogen, along with Kaylee Goncalves, Xana Kernodle, and Ethan Chapin, lost their lives. “Officials believe Kohberger was after Mogen because he passed the rooms of two surviving roommates before starting the killing spree,” Blum explained in an interview with ABC News. “If he was just on a killing spree, it would have been natural, instinctive, to go to one of those doors. Instead, he goes up this narrow staircase and he turns directly into Maddie's room, and I think Maddie was his target.”

Further compounding the tragedy, Blum reveals that Kohberger's family had harbored suspicions about him even before his arrest. Kohberger’s father, Michael, reportedly felt uneasy when he picked up his son from school after the murders. “[Michael] has been reading the headlines - he knows that four students were killed 12 miles from his son’s house. He knows what a troubled son he has,” Blum noted. Despite these concerns, Michael did not confront his son about the possible connection.

The book also details an instance where one of Kohberger’s sisters approached their father to voice her suspicions. However, Michael chose to dismiss her concerns. “He can’t confront it,” Blum said about Michael's reaction at the time.

On the night of the murders, the two surviving roommates, Dylan Mortensen and Bethany Funke, reportedly used their cellphones to communicate during and after the incident. Mortensen, 21, allegedly called out to her friends and roommates during the early morning hours of November 13 to quiet down. “Calm down, you’re being loud!” she reportedly yelled around 4 a.m., followed by, “I’m trying to sleep!” Mortensen later opened her door and saw Kohberger, whom she believed to be a partygoer, walking past her toward the back exit of the house.

Law enforcement determined that the four students were killed between 4 and 4:25 a.m., but it took another eight hours before police were called to the off-campus residence. In December 2022, Kohberger was arrested in Pennsylvania at his parents' house and charged with the murders.

Despite the mounting evidence, Kohberger has pled not guilty. His trial has yet to be scheduled, as prosecutors and defense attorneys continue to wrangle over the evidence and other data gathered throughout the investigation. A hearing on June 27 will discuss the schedule for the rest of the case, including dates for the trial and possible sentencing.

In a significant development earlier this month, a judge allowed investigators working for Kohberger’s defense team to review sealed DNA records used to narrow the pool of potential suspects. The DNA was crucial in the investigative genetic genealogy process, which involves running material found at the crime scene through public genealogical databases to identify suspects or their relatives.

Kohberger’s attorneys are also seeking a change of venue, a request that the judge has yet to rule on. The case continues to grip the nation, with the upcoming book by Blum expected to shed more light on the complexities and heartbreaking details of the murders.

*When the Night Comes Falling: A Requiem for the Idaho Student Murders* promises to be a revealing account, offering new insights and provoking further questions about one of the most shocking crimes in recent memory.

  • Why Is Ann Taylor Begging For Evidence She Should Have In The Bryan Kohberger Case?
In a recent episode of "Hidden Killers With Tony Brueski," former felony prosecutor and attorney Eric Faddis discusses the ongoing pre-trial hearings for Bryan Kohberger. Defense attorney Ann Taylor has raised concerns about missing evidence, specifically location data crucial to the case. Faddis explains that disputes over evidence disclosure are common, with defense attorneys needing all available evidence to prepare their case effectively. The missing data, such as significant location information along the Moscow-Pullman Road and around the crime scene, could impact the prosecution's ability to place Kohberger at the crime scene. Taylor's concerns include missing video evidence from security cameras. Faddis notes that such oversight might stem from inexperience in handling high-profile cases in small communities. The conversation underscores the importance of a fair trial with both sides having access to all evidence, avoiding "trial by ambush."

    **Main Points:**
    - Bryan Kohberger's pre-trial hearings focus on evidence admissibility.
    - Defense attorney Ann Taylor highlights missing significant location data.
    - Missing data includes travel routes and areas around the crime scene.
    - Potential explanations for missing data include technical issues like dead zones.
    - Disputes over evidence disclosure are common and can impact trial fairness.
    - The defense could argue to exclude incomplete locational data, which would be detrimental to the prosecution.
    - Additional missing video evidence from security cameras has been requested.
    - Oversights in evidence disclosure might stem from lack of experience in high-profile cases.
    - Ensuring a fair trial requires transparent evidence sharing between prosecution and defense.

  • Cell Phone Data Challenges Emerge in Kohberger Murder Case
A pretrial hearing in the case against Bryan Kohberger, the graduate student accused of fatally stabbing four University of Idaho students, has brought to light significant challenges related to cell phone data collection and recordkeeping. Cellphone analyst Sy Ray, expected to testify as an expert witness at trial, expressed concerns about the accuracy and organization of evidence provided by law enforcement. A pretrial hearing in the case against Bryan Kohberger, the graduate student accused of fatally stabbing four University of Idaho students, revealed significant challenges related to cellphone data collection and recordkeeping. Cellphone analyst Sy Ray, who is expected to testify as an expert witness at trial, raised concerns about the accuracy and organization of the evidence provided by law enforcement.

Ray, a former police detective from Arizona, typically serves as an expert witness for prosecutors in criminal cases. However, his testimony in this case has raised eyebrows due to its potential impact on the prosecution’s narrative.

The key issues highlighted during the hearing include:

    1. Disorganized Data Collection:

      • Law enforcement’s approach to data collection, particularly regarding cell phone records, has been disorganized.
      • Not all of the data extracted from Kohberger’s phone around the time of the 2022 murders was accurately mapped.
      • Crucial Evidence Under Scrutiny:

        • Prosecutors are heavily relying on Kohberger’s cell phone use and cell tower records to link him to the location of the killings.
        • Ray emphasized the critical need for accurate data to establish probable cause.
        • Benefit to the Defense:

          • Ray’s testimony revealed that missing or inaccurate data favors the defense.
          • Every gap in the evidence potentially strengthens Kohberger’s case.
          • Unclear Circumstances:

            • Ray questioned whether the missing data resulted from human error, accidental oversight, or intentional actions.
          • Ongoing Legal Battles and Trial Delays:

            • The defense is pressing the judge to compel prosecutors to turn over specific evidence during the discovery phase.
            • DNA experts are expected to testify in a later closed hearing.
            • Trial delays have frustrated families of the victims, hindering their healing process.
            • Latah County Trial Location:

              • A hearing on whether to move the trial out of Latah County has been further delayed to Aug. 29.
The families of the victims, including Kaylee Goncalves, have expressed their frustration with the slow pace of legal proceedings. They seek justice and closure, but the ongoing delays continue to impede their healing process. As the trial date approaches, the courtroom drama intensifies, leaving everyone anxiously awaiting the resolution of this high-profile case.

            • Kohberger Has No Valid Alibi, What Next?
In a recent episode of the podcast 'Hidden Killers With Tony Brueski,' former prosecutor Eric Faddis discussed the ongoing case against Bryan Kohberger, who has been accused of a serious crime but has presented a questionable alibi involving his fondness for nocturnal activities like hiking under the moon and stars. This alibi has been scrutinized due to the lack of corroborative evidence and because Kohberger's cell phone was reportedly off during the time of the alleged crimes. Faddis elaborates on the legal complexities of presenting an alibi defense, the standards required for its acceptance, and the implications of failing to establish a convincing alibi. He also touched on the potential change of trial venue due to community and defendant's rights to a fair trial, illustrating the strategic maneuvers in high-profile legal battles.

              Main Points:
              - Bryan Kohberger's defense has offered an alibi involving his interest in the moon and stars, which the prosecution has challenged due to the lack of supportive evidence.
              - The defense's claim is weakened by the absence of an active cell phone to track Kohberger's location during the time of the alleged crimes.
              - Legal requirements for an alibi include substantial evidence, typically from a witness, which Kohberger's defense does not have.
              - If the alibi is deemed insufficient, the defense may need to indirectly suggest Kohberger's absence from the crime scene during the trial.
              - The decision on the trial's venue is pending, balancing community interests against the necessity of a fair trial to avoid appellate issues.

            • RAW COURT AUDIO: Courtroom Showdown: Bryan Kohberger's Defense Clashes with Prosecutors Over Evidence Transparency in Idaho Murder Case
In a tense courtroom session in Moscow, Idaho, Bryan Kohberger, the Ph.D. student facing charges for the murders of four University of Idaho students, contested a prosecution motion to close an upcoming hearing concerning key genetic evidence. Kohberger’s defense team levied serious accusations against the FBI, claiming that vital evidence had been altered before being handed over, including a surveillance video purportedly placing Kohberger’s vehicle at the crime scene.

During Thursday's hearing, Anne Taylor, Kohberger’s lead defense attorney and the Kootenai County public defender, disclosed frustrations with the prosecution's handling of evidence. "The public needs to know that they've withheld the audio," Taylor revealed, suggesting that the full extent of the surveillance recordings had not been shared with the defense or the public.

The courtroom battle is not just over the evidence, but also its visibility to the public. Taylor and her team are advocating for an open discovery hearing, opposing the prosecution's request for a closed session. Deputy Prosecuting Attorney Ashley Jennings argued that the proceedings have been and should remain under seal to protect the integrity of the ongoing case.

"This is entirely inconsistent," Jennings stated during the proceedings, emphasizing that the state would ensure transparency when appropriate, but maintained that "now is not the time for that."

The defense's motion suggests a growing concern over public perception and the potential influence of pretrial publicity. Taylor accused the prosecutors of trying to keep the evidence "in a vacuum," thus controlling how the public perceives Kohberger's involvement in the crimes. "Bryan's the one with the right," she argued, referencing his Sixth Amendment rights to a public hearing.

Judge John Judge, presiding over the hearing, expressed skepticism about the necessity of a fully public hearing at this stage. "I totally understand that Mr. Kohberger has a constitutional right to a public trial, but having a hearing is not a trial," he clarified. He hinted at the possibility of a closed-door hearing with subsequent information release, aiming to balance judicial transparency with the necessity of confidentiality during ongoing investigations.

As the hearing progressed, tensions flared, prompting Judge to call for professionalism. "Tone it down," he urged the attorneys, indicating the intense emotions and stakes involved in the proceedings.

The debate over the handling of the video evidence — specifically, the edited version allegedly connecting Kohberger to the crime scene — continues to stir controversy. David Gelman, a former prosecutor and defense attorney from New Jersey, sided with Taylor's perspective on the necessity of unedited evidence. "Prosecutors should not have handed over an edited video," Gelman commented, highlighting the critical role of complete and unaltered evidence in ensuring a fair trial.

The strategic legal battles in Kohberger’s case may also influence the trial's location, with discussions about potentially moving it out of Latah County to ensure a less biased jury pool. This legal maneuvering underscores the complexities of a case that has captured national attention, setting the stage for further dramatic developments as both sides prepare for the upcoming trial phases.
