The United States incarcerates its citizens for property crime, drug use, and violent crime at a rate that exceeds any other developed nation – and disproportionately affects the poor and racial minorities. Yet the U.S. has never developed the capacity to consistently prosecute corporate wrongdoing. This disjuncture between the treatment of street and corporate crime is often narrated as hypocrisy. Others suggest that the disparity is rooted in a conservative backlash after the civil rights movement and the Great Society or a legacy of slavery, Jim Crow, and the racialization of crime.

In Dual Justice: America's Divergent Approaches to Street and Corporate Crime (U Chicago Press, 2024), Dr. Anthony Grasso interrogates the intertwined histories of street and corporate crime to find that the differences in punishment are more than modern hypocrisy. Examining the carceral and regulatory states' evolutions from 1870 through today, Grasso argues that divergent approaches to street and corporate crime share common, self-reinforcing origins. During the Progressive Era, scholars and lawmakers championed naturalized theories of human difference such as eugenics to justify instituting punitive measures for poor offenders and regulatory controls for corporate lawbreakers. These ideas laid the foundation for dual justice systems: criminal justice institutions harshly governing street crime and regulatory institutions governing corporate misconduct.

Even after eugenics was discredited, criminal justice and regulatory institutions have developed in tandem to reinforce politically constructed understandings about who counts as a criminal. Using an impressive array of sources and methods, Dr. Grasso analyzes the intellectual history, policy debates, and state and federal institutional reforms that consolidated these ideas, along with their racial and class biases, into America's legal system.

The United States stands at a crossroads in international security. The backbone of its international position for the last 70 years has been the massive network of overseas military deployments. However, the US now faces pressures to limit its overseas presence and spending.

In Beyond the Wire: US Military Deployments and Host Country Public Opinion (Oxford University Press, 2023), Michael Allen, Michael Flynn, Carla Martinez Machain, and Andrew Stravers argue that the US has entered into a "Domain of Competitive Consent" where the longevity of overseas deployments relies upon the buy-in from host-state populations and what other major powers offer in security guarantees.

Drawing from three years of surveys and interviews across fourteen countries, they demonstrate that a key component of building support for the US mission is the service members themselves as they interact with local community members.

Highlighting both the positive contact and economic benefits that flow from military deployments and the negative interactions like crime and anti-base protests, this book shows in the most rigorous and concrete way possible how US policy on the ground shapes its ability to advance its foreign policy goals.

In this week’s episode we step into conversation with Keith Whittington about his new book, The Impeachment Power: The Law, Politics, and Purpose of an Extraordinary Constitutional Tool (Princeton UP, 2024), we explored the historical and constitutional dimensions of impeachment in American politics. Whittington provided a detailed account of how the Founders intended impeachment to function as a safeguard against executive overreach. We discussed the evolution of impeachment cases, from Andrew Johnson to more recent examples, examining how political partisanship and public opinion have shaped its application over time. Whittington also reflected on the implications of impeachment for the health of democratic institutions and constitutional governance today. It was an enlightening discussion on one of the most important, yet often misunderstood, mechanisms in the U.S. Constitution.

Keith E. Whittington is the David Boies Professor of Law at Yale Law School. Whittington’s teaching and scholarship span American constitutional theory, American political and constitutional history, judicial politics, the presidency, and free speech and the law. He is the author of You Can't Teach That! The Battle Over University Classrooms (2024), Repugnant Laws: Judicial Review of Acts of Congress from the Founding to the Present (2019), and Speak Freely: Why Universities Must Defend Free Speech (2018), as well as Constitutional Interpretation (1999), Political Foundations of Judicial Supremacy (2007), and other works on constitutional theory and law and politics.

Dan Slater is the James Orin Murfin Professor of Political Science and Director of the Center of Emerging Democracies at the University of Michigan, where he’s been since 2017 after receiving his PhD from Emory University in 2005 and teaching at the University of Chicago. Dan is one of the most prolific and prominent scholars of Southeast Asian politics, publishing a raft of important and influential articles in leading Political Science and Southeast Asian Studies journals over the years as well as two major book-length studies, Ordering Power: Contentious Politics and Authoritarian Leviathans in Southeast Asia (Cambridge University Press, 2010) and (with Joseph Wong) From Development to Democracy: The Transformations of Modern Asia (Princeton University Press, 2022).

The essay "The Failed Concepts That Brought Israel to October 7" (Mosaic Magazine) by Shany Mor, dated October 7, 2024, examines the intellectual and policy failures leading up to the October 7 attack on Israel. Mor critiques several conceptual frameworks that have guided Israeli and international policy, particularly in dealing with Gaza and Hamas. These failed ideas include:

1. Netanyahu’s Leadership - Mor argues that Israeli Prime Minister Benjamin Netanyahu’s long-standing skepticism, indecision, and focus on messaging over strategic action contributed to the failure. His belief that Israel could contain Hamas while ignoring broader strategic decisions proved disastrous.

2. Religious Settler Ideology -The right-wing settler movement has, according to Mor, distorted Israeli policy for years. This ideological shift, prioritizing the West Bank settlement agenda over national security interests, has resulted in misguided policies that left Gaza's threat underestimated and unaddressed.

3. Peace Processors’ Delusion -The international peace processors, particularly in Western liberal circles, have perpetuated unrealistic frameworks for Israeli-Palestinian conflict resolution. Mor critiques their belief that diplomacy and incremental concessions could resolve deep-seated ideological conflicts with groups like Hamas, which remain fundamentally opposed to Israel’s existence.

4. The Role of the International Community - Global organizations, including the United Nations and humanitarian NGOs, have indirectly supported the hostile status quo by empowering non-state actors like Hamas. Mor criticizes these bodies for exacerbating rather than mitigating conflict, enabling militias to exercise power without responsibility.

The essay argues that these failed concepts need to be dismantled for Israel and the international community to avoid repeating the mistakes that led to the tragic events of October 7 and to establish a more secure and realistic policy moving forward.
